ORDINANCE NO. 6193 -77
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 4,
SECTION 2 -27 OF THE MUNICIPAL CODE OF THE
CITY OF SOUTH BEND, INDIANA, COMMONLY REFERRED
TO AS PARTICIPATION IN STATE AND FEDERAL PRO -
GRAMS BY REQUIRING APPROVAL OF THE COMMON
COUNCIL FOR ALL PARTICIPATION IN SUCH PROGRAMS.
STATEMENT OF PURPOSE AND INTENT
The Common-Council of the City of South Bend recognizes the need
for developing procedures.which will insure the most effective use and
application of funds regardless of their source. The Council further
recognizes that fiscal responsibility requires systematic procedures
in all areas of City government to insure the appropriate use of ex-
penditures.
Since the Common Council believes that these objectives can be
achieved by the establishment of reasonable procedures, it thereby
sets forth in this ordinance the necessary amendments to meet such
objectives.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana, as follows:
SECTION I. Chapter 2, Article 4, Section 2 -27, is hereby amended
to read in its entirety as follows:
SECTION 2 -27. PARTICIPATION IN STATE, AND FEDERAL, AND OTHER
RELATED PROGRAMS.
(a) The City of South Bend through its departments, agencies,
officers, boards, bureaus, commissions, or any other executive agency
thereof, are ,encouraged to utilize to the fullest extent possible all
avenues of securing funding.from State, Federal and private sources
which would further the effective and efficient operation of their res-
pective offices.
{a} (b) No executive agency of the City may participate in, or
negotiate and contract for participation in, any State or Federally
assisted programs or projects without prior approval of the Mayor
and, where required by State or Federal law or regulation, without
approval by the Council.

(c) All applications or similar forms for which.the approval
of the Common .Council is not required for the participation in any
State, Federal or privately assisted program(s), shall be `submitted
in capsulized form to the Common Council when the application is made
to such State, Federal or private body.
(d) All moneys received pursuant to this Section shall be re-
ceived by the City Controller and shall be deposited in the appropriate
special fund(s).

program(s) or proiect(s).
(f) Nothing in this Section shall be construed to apply to funds
for which application is made to the Law Enforcement Assistance Agency,
or to the submittal o forms required in connection with receiving
Motor Vehicle Highway excise tax funds, Cigarette excise tax un s,
Alcoholic Beverage Gallonage excise tax funds, or Federal Revenue
Sharing grants, or to the submittal of other applications and forms
which are mere formal prerequisites of receiving funds allocated to
the Citv.
SECTION II. This ordinance shall be in full force and effect
from and after its passage by the Common Council, and approval by
the Mayor.

Dear Council Members:
I am submitting the attached bill for your favorable
review.
Basically, it requires that all applications seeking
funding assistance, regardless of the source, first
be submitted in resolution form to the Council for
approval. Additionally, the bill calls for the
filing of semi - annual written progress reports de-
tailing how the moneys are being spent. This again,
is aimed at a twofold objective of keeping all parties
and citizens current on the progress of all programs
and provides a better means of accountability.
One of the reasons I am prompted to file this bill
is to insure that Council Members are kept informed
by the Administration.
