AN ORDINANCE DESIGNATING THE BUREAU OF HOUSING
OF THE DIVISION OF COMMUNITY DEVELOPMENT OF THE
CITY OF SOUTH BEND TO BE THE AGENCY OF THE CITY
TO ADMINISTER A LOCAL URBAN HOMESTEADING PROGRAM
STATEMENT OF PURPOSE AND INTENT
Public Law 195 Acts of 1975, I.C. 18 -7 -21 provide that a
city may administer an urban homesteading program under which one
and two family dwellings may be conveyed to individuals or families
who must occupy and rehabilitate such dwellings. The statute provides
that the common council of the city may by ordinance designate an
existing agency of the city to administer the program. The City of
South Bend by Ordinance No. 5689 -74 enacted July 2, 1974 created a
division of community development within the City of South Bend and
provided therein for the establishment of a bureau of housing. The
Common Council by Resolution No. 494 -75 enacted August 27, 1975
authorized the bureau of housing to be the public agency responsible
for administering a HUD urban homesteading demonstration program in
the City of South Bend. It is now necessary that the city pursuant
to the requirements of the 1975 statute designate by ordinance an
agency of the city to administer its local urban homesteading program
within the intended purposes of the statute.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. The Bureau of Housing of the Division of
Community Development of the Department of Human Resources of the City
of South Bend, Indiana is hereby designated as the agency of the city
to administer a local urban homesteading program for the City of
South Bend pursuant to the provisions of Public Law 195 of the Acts
of 1975, being I.C. 18 -7 -21, such agency to have all of the rights,
powers and duties provided for in said statute.
SECTION II. This Ordinance shall be in full force and effect
from and after its passage by the Common Council of the City of South
Bend, and its proper execution by the Mayor.

Dear Members of the Common Council:

Public Law 195 of the Acts of 1975 of the Indiana
Legislature provide for an urban homesteading program to be
administered by a city for the conveying of one and two family
dwellings to individuals or families who must occupy and rehabilitate
the dwellings. The city previously operated under HUD an urban
homesteading demonstration program and the Common Council by
Resolution 494 -75 approved August 27, 1975, designated the Bureau
of Housing as the administering agency.
The city is now preparing to undertake its own urban
homesteading program and the statute requires the city by ordinance
to designate the agency which will administer the city's urban
homesteading program. The Bureau of Housing of the Division of
Community Development is an existing agency of the city and is
qualified under the statute to administer such program.
The attached ordinance is submitted as the necessary
qualifying ordinance under the 1975 statute to designate the
appropriate agency to administer the urban homesteading program
and to thus comply with the statutory requirements.
