GAMMON Approved and signed by me � a�_"c.A (i . 19 ? it Clerk ORDINANCE NO. 6317 -78 AN ORDINANCE AMENDING VARIOUS SECTIONS WITHIN CHAPTER 20, ARTICLE 7, SNOW ROUTES OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend recognizes that quick and efficient snow removal procedures are essential to the health, safety and economic benefit of this community. The Council further acknowledges that residential areas can best be cleared of snow during normal working hours, and that the designated snow routes can be cleared more effectively during the evening and early morn- ing hours. Since the Council is concerned about keeping all of its City streets functioning during the snow season, it hereby introduces an Ordinance which will serve this interest, and the citizens of the City of South Bend. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Chapter 20, Article 7, Section 20 -101 Definitions, of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read in its entirety as follows: Section. 20 -101. Definitions. (a) As used in this Article: (1) CITY -WIDE SNOW EMERGENCY means a formal declaration by the Snow Removal Coordinator that in his opinion the actual or expected precipita- tion of snow will create hazardous or dangerous street and sidewalk condi- tions. (2) PUSHING SNOW means the moving of an amount of snow that may impede or unnecessarily hamper traffic flow. (3) SNOW means any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice and freezing rain. (4) SNOW REMOVAL CONDITIONS means the accumulation of four (4) or more inches of snow in any one continuous period of time as reported by the U.S. Weather Bureau. (5) SNOW REMOVAL COORDINATOR means the Mayor or in his absence the following succession of people shall qualify: City Controller, City Engineer, or the Manager of the Bureau of Streets. (6) SNOW ROUTES means all streets in the City so designated and marked. (7) VEHICLES means all self - propelled motorized licensed vehicles using City streets and highways, excluding public transportation con- veyances. (8) WEATHER DISASTER means a formal declaration by the Snow Removal Coordinator that occurrence or eminent threat of wide - spread or severe damage, injury or loss of life or property resulting from a snow storm requires emergency action to avert danger, damage or distress. SECTION-II. Chapter 20, Article 7, Section 20 -102 Snow Routes; Desig- nations; Posting, of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read in its entirety as follows: Sec. 20 -102. Snow Routes; Designations; Posting; Filings with the City Clerk. (a) The Board of Public Works shall designate streets which. are heavily traveled and are necessary throughfares for the movement of vehicular traffic through the City as snow routes. An annual review of the snow routes by the'._Traffic "Engriineer arid_the_Common Council_Committee on Public Works shall be done and a written report filed with the City Clerk by July 1st of each year. (b) All streets designated as snow routes shall be posted with suitable signs or markers. (c) A master plan designating street priorities for snow removal must be formulated by the Board of Public Works and filed with the City Clerk by July lst. Any changes or additions to such plan shall be filed within forty -eight (48) hours of the effective change or addition. SECTION IV. Chapter 20, Article 7, Section 20 -103 Snow Removal Condition of the Municipal Code of the City of South Bend is hereby amended to read in its entirety as follows: Sec. 20 -103. Snow Removal Condition I (a) A Snow Removal Condition shall be in effect when four (4) or more inches of snow has accumulated in one continuous period and has been reported publicly, by the U.S. Weather Bureau, or as called by the Snow Removal Coordinator. (b) A Snow Removal Condition shall continue in force and effect until the Snow Removal Coordinator declares it to be over by issuing a press release to the local radio, television, and news services. SECTION V. Chapter 20, Article 7, Section 20 -103A Formal Declara- tion of a City -wide Snow Emergency, of the Municipal Code of the City of South Bend is hereby amended to read in its entirety as follows: Sec. 20 -103A Formal Declaration of a City -wide Snow Emergency (a) When, in the opinion of the Snow Removal Coordinator, the actual or expected precipitation of snow will create hazardous or dangerous high- way conditions for vehicular or pedestrain traffic, he shall have the authority to declare a City -wide Snow Emergency. (b) The Snow Removal Coordinator shall immediately inform the public of the City -wide Snow Emergency by issuing a press release to the local radio, television, and news services. (c) The City -wide Snow Emergency shall continue in force and effect until the Snow Removal Coordinator declares it to be over in the same manner as provided for in sub - section (b). SECTION VI. Chapter 20, Article 7, Section 20 -104 Traffic Regula- tions During a Snow Removal Condition and During a City -wide Snow Emergency, of the Municipal Code of the City of South Bend is hereby amended to read in its entirety as follows: Sec. 20 -104 Traffic Regulations During a Snow Removal Condition and During a City -wide Snow Emergency. (a) Once the U.S. Weather Bureau publicly announces that four (4) or more inches of snow has accumulated a Snow Removal Condition shall be in effect, or as called by the Snow Removal Coordinator. (b) Once either a Snow Removal Condition is in effect or a City -wide Snow Emergency has been delcared and during their existence: (1) No vehicle shall be parked on a snow route. (2) The pushing of snow onto any City street by an individual is prohibited. (3) Any vehicle parked, stalled, incapable of moving under its own power, or left unattended upon any street designated as a snow route shall be impounded. (4) All vehicles on streets not designated as a snow route must be parked on the even -side of the street. All vehicles shall remain parked on the even -side of the street until the opposite side has been cleared of snow. Once the opposite side has been cleared of snow, vehicles shall be parked on the cleared side. Once the entire street has been cleared to the curb -line vehicles may be parked on both sides, unless otherwise prohibited. Vehicles violating this sub - section shall be impounded. (5) The Snow Removal Coordinator shall. have the power to designate vehicles such as Bureau of Street-vehicles and.:..snow mobiles.as "Temporary Emergency Vehicles" if in his opinion such designation is necessary to in- sure the health and safety of the citizens of the community. (6) Any individual abusing the services of City Emergency Vehicles shall be subject to the penalty provisions of Section 20 -105 and shall reim- burse the City for all costs expended in responding to any false call. (7) The Snow Removal Coordinator may declare any snow route or any part of a snow route to be free from the restrictions herein imposed when, in his opinion the weather or street conditions warrant such an exclusion. The Snow Removal Coordinator shall give notice of this determination in the manner provided for in Sub- section (b) of Section 20 -103A. SECTION VII. Chapter 20 Article a Weather Disaster of the Municipal Code hereby amended to read as follows: 7, Section 20 -103B Declaration of of the City of South Bend is Sec. 20 -1O3B Declaration of a Weather Disaster (a) The Snow Removal Coordinator shall immediately inform the public of a Weather Disaster by issuing a press release to the local radio, tele- vision, and news media. (b) The Snow Removal Coordinator shall have the power to limit traffic within the City. Any one traveling on City streets without a valid emergency reason shall be subject to the penalty clause of Section 20 -105. (c) The Snow Removal Coordinator shall have the power to take whatever action is reasonably necessary to insure the health, safety, and welfare of the citizens during a weather disaster. (d) The Weather Disaster shall continue in force and effect until the Snow Removal Coordinator declares it to be over in the same manner as Sub - section (a). SECTION VIII. Chapter 20, Article 7, Section 20 -105 Penalties shall remain as follows: Sec. 20 -105 Penalties Any person violating the provisions of this Article may be fined not more than three hundred ($300.00) dollars. SECTION IX. SEVERABILITY. If any provisions of this bill are held invalid, such invalidity shall not affect other provisions or applications which can be given without the invalid provisions or application and to that end the provisions of this bill are declared to be severable. SECTION X. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor, and after legal publication. !'
