( 313-7g AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 1, OF THE MUNICIPAL CODE BY REQUIRING THE LICENSING OF CERTAIN AMUSEMENT DEVICES STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend, Indiana, in response to the concerns of the citizens of South Bend in the area of juvenile delinquency, recognizes the need to license, and there- by regulate the ownership and management of arcades and other places where juveniles congregate to operate amusement devices. For the betterment of the health, safety and welfare of the South Bend community, the Common Council recognizes the need to license such amusement devices. NOti ^i, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION I. Chapter 4, Article 1, section 4 -1 of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read as follows: Sec. 4 -1. No person shall keep, maintain or operate for hire or for the use of patrons an automatic baseball court, pool or billiard table, shuffleboard, shooting gallery, bowling or tenpin alley, trampoline, strength- testing machine, swings, merry -go- round, ferris wheel, roller coaster, pinball machine, electronic games of skill, switch back or any other ali4lap device used for amuse- ment purpose and €ev ese e€ wk }eA any €ee }s e4avged 44!Vee�6ly e*, without first having obtained a license from the controller. SECTION II. Chapter 4, Article 1, section 4 -2 of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read as follows: Sec. 4 -2. 8) Pinball machines electronic games of skill or other similar device; Trrienty -five Dollars 25700 per game table or crevice. SECTION III. Chapter 4, Article 1, section 4 -3 of the Municipal Code of the City of South Bend, Indiana, is hereby amended as follows: Sec. 4 -3. a) Any person desiring a license for the devices men- tioned in Section 4 -1 and 4 -2 shall pay to the controller the license fee charged by Section 4 -2. Severability. If any provisions of this bill are held invalid, such invalidity shall not affect other provisions or applications which can be given effect without the invalid pro- vision or application and to that end the provisions of this bill are declared to be severable. DOMBROWSKI The attached Amendment to the South Bend At Large FRANK HORVATH Licensing Ordinance, which licences amusement At Large arcade devices, corrects an oversight in the present ordinance, in that, the City of South Bend does not presently license pinball.machines and electronic games of skill. I believe that this ordinance is necessary in order to collect additional revenues for the City of South Bend; and, will provide an addi- tional control on amusement arcades.
