AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. Ordinance No. 4990 -68 as amended, which
ordinance is commonly known as the Zoning Ordinance of the City of
South Bend, Indiana, be and the same hereby is amended in order that
the zoning classification of the following described real estate in
the City of South Bend, St. Joseph County, State of Indiana:
PART I Lots numbered 43 through 62 and 68 through 171
of Westchester 2nd unit addition to the City
of South Bend; also vacated right-,of-,way of'
Kentucky Street, Iowa Street, Falcon Street
and Kenmore Street contained within the sub
division
be and the same is hereby established as "Cn2' Commercial-

IN RE: Legal Description, Ordinance 6310 -78, For the LaSalle Square Project
A review of the legal description rezoning the subject property, indicates
two drafting errors were committed in preparing this description. These
errors were not discovered until the City's zoning was being updated.
The errors are as follows:
Part II and III of the Ordinance states, 'part of Lot No. 176
in Westchester 2nd Unit Addition to the City of South Bend'.
Part III of the Ordinances states, 'Lots Numbered 177 through
183 in Westchester lst Addition to the City of South Bend',
That part of said Lot No. 176, which was intended to be rezoned is, 'That
part of Lot No. 176 in Westchester 2nd Unit Addition to the City of South
Bend, located at the Southeast corner of Prast Boulevard and Ardmore Trail'.
The reason that only a part of said Lot No. 176 was rezoned is that Prast
Boulevard along the South boundary of said Lot Mo. 176 was vacated and
realignment through said Lot No. 176.
That part of said Lot No. 176 located at the Southwest corner of Prast
Boulevard and Ardmore Trail, was intended to remain zoned "E" Heavy
Industrial.
Part III refers to Westchester 1st Addition to the City of South Bend. There
is no such subdivision in the City of South Bend. The correct name of the
subdivision for the subject property is Westchester 2nd Unit Addition to
the City of South Bend.
The intent of the legal description describing the land to be rezoned is
very clear and supported by the site plan,

Area, to "C -2" Planned Commercial -, "D" Height and Area, property
located between Ardmore Trail, Bendix Drive, Prast Boulevard, and
Wellington Street; from "B" Residential, "A" Height and Area, to "C"
Commercial, "D" Height and Area, property located between Ardmore Trail,
Wellington Street and Prast Boulevard; from "B" Residential, "A" Height
and Area, to "E" Industrial, "C" Height and Area, property located between
Ardmore Trail, Prast Boulevard and Bendix Drive to a depth of 160 feet
south of Prast Boulevard, City of South Bend
Gentlemen:
The attached rezoning petition of Von Blankenbaker, Blankenbaker Associates,
was legally advertised January 7, 1978. The Area Plan Commission gave it a
public hearing on January 17, 1978, at which time the following action was taken:
"Upon a motion by Joseph-serge,., being secpnded by Earl K%me, and carried,
with June Stratton voting Nay, the petition of "Von Blankenbaker,
Blankenbaker Associates; as amended, to zone from "B" Residential,
"A" Height and Area, to "C-2" Planned Commercial, "D" Height and Area,
property located between Ardmore Trail, Bendix Drive, Prast Bouleyard
and Wellington street.; from "B 1" Residential,, "A" Height and Area, to
"C" Commercial, "D" Height and Area, property located between Ardmore
Trail, Wellington Street and Prast Boulevard,, from "B" Residential,
"A" Height and Area, and "E" Heavy Tndus:trial to "E" Heavy Industrial,,
"C" Height and Area, property, located between Ardmore Trail,, Bendix Drive
and south of Prast Boulevard, City of South Bend, is returned to the.
Common Council with a favorable recommendation, subject to a, final
site plan, a landscape and screening plan per the zoning Ordinance
requirements- for south of Ardmore Trail, west of Bendix Drive, and
that part of Prast Boulevard adjacent to residential; a traffic and
signal plan to be approved by the City Engineer;"
The above recommendation is made subject to a final site plan and the
preliminary site plan is attached hereto,
