HomeMy WebLinkAbout11-25-57 Council Meeting MinutesREGULAR MEETING NOVEMBER 2`5, 1957 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, November 25, 1957, at 8:09 P.M., with all members present. The meeting was called to order by President Stanley C. Korpal, who presided. ROLL CALL: PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: None. MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION:, To the City Council of South Bend Frieda Noble,`,Dorothy Shear, Irvin Smith and members of the Administration: We wish to express our appreciation for the kind thoughts and good wishes you have extended to us during our fiftieth wedding anniversary. We want to thank you for the beautiful flowers. We shall cherish the memories of this occasion the rest of our lives. /s/ Mn & Mrs. Walter C. PETITION: Petition to annex land at Olive Street and Prairie Avenue. Petitioner is Ervin Lodyga. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION: Petition signed by Stanley C. Korpal, Member of the Common Council, to annex land at Rose Street along Eastgate Addition. Councilman Tellson made a motion that the petition be referred to the City Planning Commission. Councilman Erler seconded the motion. Motion carried. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council November 8, 1957 City of South Bend South Bend, Indiana Gentlemen: The attached petition of James Borden, et al, to rezone land located at the southwest corner of Bulla Street and Anderson Avenue, from "A" Residential to "B" Residential was legally advertised on 28 October 1957 and given public hearing under date of 7 November 1957. The following action was taken: After due consideration the Commission found that the entire area surrounding subject property was zoned "A" Residential and that the granting of the petition would constitute spot zoning and was, therefore, illegal. REGULAR MEETING REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council November 8, 1957 City of South Bend South Bend, Indiana Gentlemen: November 25, 1957 The attached ordinance originated by the City Planning Commission to amend "The Zoning Ordinance of South Bend, Ind- iana" by the addition of the following to Section 1: DWELLING: A building or portion thereof arranged or designed to provide living facilities for one or more families. The term "dwelling" shall include a house trailer, but shall not be deemed to include a motel, hotel, or automobile courts was legally advertised on 28 October 1957 and given public hearing under date of 7 November 1957. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the attached ordinance to amend "The Zoning Ordinance of South Bend, Indiana" be recommended favorably to the Common Council. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South,, Bend South Bend, Indiana Gentlemen: November 8, 1957 The attached ordinance originated by the City Planning Commission to amend "The Zoning Ordinance of South Bend, Indiana" by the addition of the following to SECTION 4, Sub - Section 2, "and Tourist Homes," so that the same shall be and read "apartment houses, boarding and lodging houses, and tourist homes" was legally advertised on 28 October 1957 and given public hearing under date of 7 November 1957. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the attached ordinance to amend "the Zoning Ordinance of South Bend, Indiana" be recommended favorably to the Common Council. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: November 8, 1957 The attached ordinance originated by the City Planning Commission to amend "The Zoning Ordinance of South Bend, Indiana" by repealing the definition of "Lodging House" under Section 1. and substituting therefor the following: LODGING HOUSE: A dwelling in which more than two rooms and less than eight (8) are let for hire, or more than five (5) persons.are given lodging for compensation was legally advertised on 28 October 1957 and given public hear- ing under date of 7 November 1957. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the attached ordinance to amend "The Zoning. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: November 8, 1957 The attached ordinance originated by the City Planning Commission to amend "The Zoning Ordinance of South Bend, Indiana" by repealing the definition of "Hotel" under Section 1, substituting therefore the following: HOTEL: A building in which lodging, with or without meals, is provided and offered to the public for compensation, and which is open to transient guests. Hotels include motels and automobile courts, but do not include lodging houses and tourist homes was legally advertised on 28 October 1957 and given public hearing under date of 7 November, 1957. the following action was taken: REGULAR MEETING NOVEMBER 25, 1957 After due consideration it was moved, seconded and unanimously carried that the attached ordinance to amend "The Zoning Ordinance of South Bend, Indiana" be recommended favorably to the Common Council. The Ordinance was given first reading by title and second reading in full. Councilman Christman made a motion that the Ordinance be set for public hearing on December 9, 1957. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN . AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Lodging House) The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set fob public hearing on December 9, 1957. Councilman Glass seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Hotel) The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for public Hearing on December 9, 1957. Councilman Carr seconded the motion. Motion carried. ORDINANCE AN ORDINANCE CONTROLLING THE OPERATION OF SELF - SERVICE LAUNDRIES The Ordinance was given first reading by title and second reading in full. Councilman Kroll made a motion that the Ordinance be set for public hearing on December 9, 1957. Councilman Erler seconded the motion. Motion carried. ORDINANCE NO. 4198 AN ORDINANCE AMENDING ORDINANCE NO. 4117 WHICH IS AN ORDINANCE AMENDING GENERAL ORDINANCE NO. 3709 OF THE CITY OF SOUTH BEND, CHAPTER 26, SECTION 4 THEREOF PROVIDING FOR THE RATES OF FARE The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Kroll seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE AMENDING SECTION 6 OF SUB - PARAGRAPH (b) OF CHAPTER 26 OF GENERAL ORDINANCE NO. 3709 (Insurance -- Taxicabs) The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set for public hearing on December 9, 1957. Councilman Erler seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AUTHORIZING THE INCREASE OF SEWAGE SERVICE CHARGE TO ALL USERS FOR THE PURPOSE OF REPAIR AND /OR REPLACEMENT OF WATER SERVICE LINES AND SHUT -OFF BOXES WITHIN AND /OR UNDER PUBLIC PROPERTY The Ordinance was given first reading by title and second reading in full. Councilman Musyznski made a motion that the Ordinance be set for public hearing on December 9, 1957. Councilman Carr seconded the motion. Motion carried. 1284 REGULAR MEETING NOVEMBER 25, 1957 RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED CITY EMPLOYEES. WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year; and, WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous and complicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana; SECTION I. That all salaried officers and employees of the City shall be paid their salaries for the month of December, 1957, on the 20th day of said month. SECTION 2. The Controller of the City of South Bend is hereby authorized to make said salary payments upon said date. SECTION 3. This Resolution shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. /s/ Chester Muszynski . Member of the Common Council Councilman Muszynski made a motion for adoption of the Resolution. Councilman Kroll seconded the motion. Motion carried by.a vote of 9 ayes, 0 nays. Resolution adopted. OLD BUSINESS: Councilman Kroll stated that he wished to thank the Board of Public Works and Safety for the information they have given him on the Hancock Street project. Councilman Kroll then made a motion that the City Attorney investigate the private alleys shown on the Hancock Street plat, to see whether an easement can be granted. Councilman Muszynski seconded the motion. Motion carried and the matter was referred to the Streets and Alleys committee for further study. NEW BUSINESS: Councilman Tellson asked that the Board of Public Works and Safety be instructed to.give immediate attention to the deplorable condition existing in the alleys in the four hundred block of North Eddy Street and to report to the Council at the December 9, 1957 meeting. Councilman Hahn asked.that a copy of a request by several residents in the area of Oak Park Drive and Ironwood Road to maintain the "A" Residential Zoning Classificiation of that area, be referred to the Board of Zoning Appeals, for appropriate act4on. There being no further business before the Council, Councilman Kroll made a motion to adjourn. Councilman Hahn seconded the motion.
