OCTOBER 14, 1947
Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council
Chambers, Monday, October-14, 1957, at 8:00 P.M., with all members present except Councilman Muszynski. President
Stanley C. Korpal called the meeting to order and presided.
ROLL CALL:
PRESENT: Councilmen Kropal, Carr, Tellson, Christman, Kroll, Glass, Hahn and Erler.
ABSENT: Councilman Muszynski.
MINUTES:
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected
the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same
be approved.

The attached ordinance originated by the City Planning Commission to zone Lots 3 and 4 of Baker's Subdivision of
B.O.L. 87 from "B" Residential to "C" Commercial Use and "C" Height and Area District was legally advertised on
16 September 1957 and given public hearing under date of 26 September 1957. The following action was taken:
After due consideration it was moved, seconded and unanimously carried that the petition be recommended
favorably to the Common Council.

Gentlemen:
The attached petition of Virgil Place, et al, to rezone land located at the northwest corner of Manchester Drive and
Corby Blvd. from "C" Commercial and "A" Height and Area District, to "A" Residential and "A" Height and Area District
was legally advertised on 23 September 1957 and given public hearing under date of 3 October 1957. The following action
was taken:
After due consideration the Commission found that the best use of subject property would be residential and that
there was no need for Commercial zoning in general area, it being adequately served by existing commercial facilities.'.
It was therefore duly moved, seconded and unanimously carried that the - petition be recommended favorably.

The attached petition of Bert Szaulewicz, et al, to rezone land located on the south side of West Washington Street,
Lot 2, Bakers Subdivision of Bank Out Lot 87 and Lots 23, 24 and the west 12 feet of Lot 22 in Evans Subdivision of
Bank Out Lot 88, from "B" Residential to "C" Commercial and "A" Height and Area District was legally advertised on

23 September 1957 and given public hearing under date of 3 October, 1957. The following action was taken:
After due consideration the Commission found that:
1. The Commercial zoning of Lots 23, 24 and the west 12 feet of Lot 22 in Evans Subdivision of
B.O.L. 88 as above would constitute spot zoning and would therefore be illegal.
2. There was no need for additional commercial zoning in the general area, that commercial zoning in the
general area,.that commercially zoned vacant land now existed which was not used commercially.
3. The granting of the petition would tend to create strip zoning.
4. The best use of subject property now and in the immediate future would be residential use and
that the area immediately surrounding subject property was now used single family residential.
It was therefore duly moved, seconded and unanimously carried that the petition be recommended unfavorably.

The Ordinance was given first reading by title and second reading in full. Councilman Carr made.a motion for sus-
pension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays,
1 absent (Councilman Muszynksi). The Ordinance was then given third reading and passed by a roll call vote of
8 ayes, 0 nays, 1 absent (Councilman Muszynski).

The - Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for sus-
pension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays,
1 absent (Councilman Muszynski). The Ordinance was then given third reading and passed by a roll call vote of
8 ayes, 0 nays, 1 absent (Councilman Muszynski).

OF CITY JUDGE, ACCOUNT 216A TRAVEL EXPENSES - BAILIFF, $200.00 AND
TO OFFICE OF CITY JUDGE, ACCOUNT 216 B, TRAVEL EXPENSES - PROBATION
OFFICER, $80.00, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND,
INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY.
The Ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the
Ordinance be set for - public hearing on October 28, 1957. Councilman Carr seconded the motion.. Motion carried.

The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the
Ordinance be set for public hearing on October 28, 1957. Councilman Hahn seconded the motion. Motion carried.

INTER -CITY TRUCK TRAFFIC.
The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the
Ordinance be set for public hearing on October 28, 1957. Councilman Kroll seconded the motion. Motion carried.

OLD BUSINESS -- -NONE
NEW BUSINESS
OCTOBER 14, 1957
Councilman Christman stated that he had received several complaints about smoke from Drewrys. The Council asked the
Clerk to advise the Board of Public Works and Safety to direct Sergeant Podell of the Board of Health to investigate
the smoke and soot emanating from the chimneys at Drewrys Plant, to see if they are using any sort of air - pollution
devices and to make a report back to the Board of Works before October 21, 1957.
Mr. Walter White, 1418 North Adams Street, South Bend, Indiana, appeared before the Council to request action with
regard to the control of burning rubbish within the City. The Clerk was requested to write to the Fire Board of
Appeals advising of this complaint and asking that the Board have a meeting and invite Mr. White to attend to in-
vestigate the possibility of such action. The Fire Board of Appeals was requested to report the results of their
meeting before the October 28, 1957 meeting of the Common C ouncil.
There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Carr
seconded the motion. Motion carried and the regular meeting of the Common Council adjourned at 8:54 P.M.
