HomeMy WebLinkAbout09-09-57 Council Committee of the Whole Meeting MinutesCOMMITTEE OF THE WHOLE MEETING SEPTEMBER 9, 1957- Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the Council Chambers, Monday, September 9, 1957, at 8, :17 P.M., with all members present/ Councilman Carr, Chairman, called the meeting to order and presided. Except C uncilm nn Mass, ORDINANCE AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Moose Lodge Petition) Proponents and opponents were given an opportunity to be heard on this ordinance. Councilman Hahm made a motion the the Ordinance go to the Council as favorable. Councilman Korpal seconded the motion. Motion carried. The Public Hearings on Ordinance requesting transfers of funds for the Police Pension Funds and for the City Judge Account set for this meeting will be on September 23, 1957. There being no further business before the Committee of the Whole, Councilman Hahn made a motion to adjourn. Council - man Korpal seconded the ^meeting. President Stanley C. Korpal called the meeting to order and presided. ROLL CALL :x PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Hahn, Erler and Muszynski. ABSENT: Councilman Glass MINUTES: REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee--on the inspection and supervision of the minutes would respectfully report that they have in- spected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. G. W. COMMUNICATION South Bend Firemen's Association September 4, 1957 Office of City Clerk City of South Bend City Hall South Bend, Indiana Members of Common Council, Mr. Stanley Korpal, Pres. Dear Sirs: May I take this opportunity to express the appreciation and gratitude of the Wage Committee, representing the members of the South Bend Fire Department, on your action relative to the wage increase granted us for the year of 1958. We also appreciate the fact that the Members of the Common Council taak the time to meet with us and discuss the problem of wages prior to the budget hearings. It is the aim of all firemen to make our department and keep our department one of the finest in the State of Indiana. We have the finest equipment to work with and the best of quarters to live and to work in, thanks to you and the men who have preceeded you in the Council. With modern training methods and the incentive to progress the South Bend Fire Department will hold the high place it has achieved as an efficient and well trained Department. Councilman Carr seconded the motion. Motion carried. PETITION Petition of Frank and Joseph Arch to rezone property at 1142 West Washington Street, South Bend, Indiana. Councilman Carr moved that the petition be referred to the City Planning Commission. Councilman Erler seconded the motion. Motion carried. PETITION Petition of Bert Szaulewicz, et al, to rezone land on West Washington Street -1100 Block. Councilman Kroll moved that the petition be referred to the City Planning Commission. Councilman Carr seconded the motion. Motion carried. Grant St. South Bend, Indiana House being used for storage purposes Gentlemen: Attached is a copy of a Cease and Desist order which has been executed by this office. Dubail Sub - division in the City of South Bend, more commonly known as 839 S. Grant Street. REGULAR MEETING SEPTEMBER 9, 1957 Our investigation has revealed that the frame dwelling at that location is presently being used for storage purposes, in violation of Ordinance No. 3702, commonly known as the Zoning Ordinance of the City of South Bend. More specifically, the subject property is located in a "B" Residential use district and storage is a use expressly pro- hibited therein. Consequently, we must hereby order that use of the subject property for storage purposes cease and desist immediately. Yours very truly, VERNER L. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY A report was read from the Police Department stating that officers had been assigned the duty of checking Olive Street from Western to Sample for semi - trucks who were violating the Ordinance. Councilman Erler moved that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. REPORT OF TRANSPORTATION COMMITTEE To the Common Council of the City of South Bend: Your Committee'on Transportation has examined the contents of the proposed Resolution with reference to the use of Olive Street between Sample and Western as an intra -city common carrier truck route and the Committee finds the Resolution unacceptable and not recommended for passage. Their finding is based on the fact that they believe the conditions of the resolution to be discriminatory. /s/ Joseph T. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, Respectfully report that they have examined the matter and that in their opinion, it should be reported favorable. /s/ G. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council 6 September 1957 City of South Bend South Bend, Indiana Gentlemen: The attached petition of Associates Investment Company to rezone land at Esther and Ruskin Streets from "B" Residen- tial to "D" Light Industrial was legally advertised on 26 August 1957 and given public hearing under date of 5 Sep - tember, 1957. The following action was taken: After due consideration, it was moved, seconded and unanimously carried that the petition be recommended favor -; ably to the Common Council. REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 6 September 1957 The attached petition of C. M. Daniels to zone from "B" Residential to "C" Commercial, 2 lots at the southwest corner of Lincoln Way West and Eclipse Place was legally advertised on 26 August 1957 and given public hearing under date of 5 September, 1957. The following action was taken: After due consideration the Commission found that the granting of the petiton would result in spot zoning and would therefore be illegal. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. Councilman Erler made a motion for sus - pension of rules. Councilman Hahn seconded the motion. Motion lost by a roll call vote of 7 ayes, 1 nay (Councilman Muszynski) 1 absent (Councilman Glass). Councilman Carr then moved that the Ordinance be set for public hearing on September 23, 1957. Councilman Kroll seconded the motion: -.Motion carried. ORDINANCE No Ordinance had been filed on the petition of C. M. Daniels to rezone. ORDINANCE NO. 4182: >: ` AN ORDINANCE AMENDING ORDIIA NCE NO. 3702 ADOPTED BY THE COMMON COUNCIL OF THE 13th day of JUNE, 1949. The Ordinance was given first reading by title and second reading in full. Councilman Christman made a motion for suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 ahsent (Councilman Glass). The Ordinance was then given.third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Glass). ORDINANCE ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Tellson moved that the Ordinance be set for public .hearing on September 23, 1957. Councilman Carr seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING FROM DOG POUND ACCOUNT K -724, MOTOR EQUIPMENT $600.00 TO DOG POUND ACCOUNT K -317 DOG FOOD $400.00 AND TO DOG POUND ACCOUNT K -38 GENERAL SUPPLIES $200.00, ALL OF THE BUDGET FOR THE YEAR 1957 OF THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The Ordinance was given first reading by title and second reading in full. Councilman Tellson moved that the Ordinance be set for public hearing on September 23, 1957. Councilman Carr seconded the motion. The Ordinance was given first reading by title and second reading in full. Councilman Carr moved that the Ordinance be set for public hearing on September 23, Councilman Hahn seconded the motion.
