Korpal, who presided. TNnT T rAT.T.. PRESENT: Councilmen Korpal,,Tellson, Christman, Kroll, G1ass,Hahn and Muszynski. ABSENT: Councilmen Carr and Erler. MINUTES: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Minutes of Regular Meeting of July 22, 1957 Special Meeting July 29, 1957. Councilman Glass made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. COMMUNICATION: The Clerk read,a communication from Mrs. Consuelo L. Opelt, 601 South Thirtieth Street, South Bend, Indiana, relative to the -water situation in her home. Councilman Kroll made a motion.that the communication be accepted and placed on file.. Councilman Muszynski seconded the motion. Motion carried. PETITION`:.., Petition of Standard Oil Company and Charles and Lois Drukten to rezone part of Lot No. 7 in A. H. Cushing Addition. Councilman Glass made a motion that the petition be referred to the City Planning Commission. Councilman Muszynski seconded the motion. Motion carried. PETITION: Petition of Associates Investment Company to rezone land at Esther and Ruskin Streets. Councilman Christman made a motion that the petition be referred to the City Planning Commission. Councilman Glass seconded the motion. Motion carried. REPORT FROM HEALTH DEPARTMENT: Relative to a complaint that garbage was being burned in the 200 Block of South St. Peter Street, The Board of Health reported that the residents of'the entire block had been advised on disposal of garbage and trash and that they are now complying with the City Ordinance. Relative to a complaint that there were a large number of hornets in the 2500 Block of South Gertrude Street, the Board of Health reported that the hornets have been exterminated by Sgt. Podell with the assistance of the South Bend Exterminating Company. Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Muszynski seconded the mot Motion carried. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council 7 August 1957 City of South Bend South Bend, Indiana Gentlemen: The attached petition of Moose Lodge #58 to zone from "A" Residential to "B" Residential lots at the ' northeast corner of Lincoln Way West and Maplewood Avenue, and 2 lots on the west side of Knoblock Street north of Lincoln Way West, was legally advertised on 1 July 1957 and given public hearing under date of 11 July 1957. The following action was taken: After due consideration it was moved, seconded, and unanimously carried that the petition be recommended favorably except lots 3 and 4 in Knoblock /Subdivision of Lots in Post Place. REPORT OF CITY PLANNING COMMISSION: The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 7 August, 1957 The attached petition of Edward B. Nowak, et al, to annex Lots 45, 46, 62 and 63of Homeland Addition being 2303 and 2401 South Meade Street, to the City of South Bend, Indiana was legally advertised on 25 July 1957 and given public he ring under date of 1 August, 1957. The following action was taken: After due consideration it was moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. Councilman Christman seconded the motion. Motion carried. President Korpal asked for a report from the Ordinance Committee on the Ordinance to amend the zoning Ordinance which concerns seven parcels of land on Lincoln Way West. There being no report from the Ordinance Committee, Councilman Kroll made a motion that the Ordinance be sent back to the City Planning Commission for further study. Councilman Glass seconded the motion. After further discussion, it was decided not to bring the Ordinance out of Committee, then Councilman Kroll withdrew his motion and Councilman Glass withdrew his second to the motion and the Ordinance was left in Committee. 5 MINUTE RECESS - -- -8:45 P.M., to-8:50 P.M. ORDINANCE NO. 4177 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (REAL ESTATE INVOLVED LOCATED ON THE SOUTH SIDE OF MC KINLEY HIGHWAY, AND EAST OF MANCHESTER DRIVE CONTINUED ACROSS MC KINLEY HIGHWAY) The Ordinance was given third reading and passed by a roll call vote of 7 ayes, 0 nays. ORDINANCE AN ORDINANCE TO AMEND ORDINANCE NO. 37020 AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED „THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the Ordinance be set for public hearing on September 9, 1957. Councilman Kroll seconded the motion. Councilman Hahn made a motion that the Ordinance be referred to the Ordinance Committee. Councilman Kroll seconded the motion. Motion carried. Councilman Hahn seconded the motion. Motion carried. OLD BUSINESS Councilman Glass requested that the Street ' Commissioner do whatever necessary to help correct the condition on Misha- waka Avenue which has been caused by the Northern Indiana Public Service Company cuts in the pavement to reach-their services. Mr. Glass requested that a report be made at the August 26th meeting. 1 Councilman Tellson made a motion that the Board of Public Works and Safety make an investigation of duplication of names of streets within the City of South Bend and report back at the August 26th meeting of the Council. Counci Hahn seconded the motion. Motion carried. MR. IRVING J. SMITH, CITY ATTORNEY, reported with reference to Hancock Street as follows: "According to public records, Hancock Street terminates at the West line of Bank Out Lot 92. There is nothing in the public record to indicate that it was ever intended to go beyond this point." "No where in the City's records do any permits for sewer or water connection appear for the three homes situated on Lots 1, 2 and 3 of Baker's Sub- division of Bank Out Lot 92. Each of said homes were built to face onto the Grand Trunk tracks, one of which you will note from the drawing, is only 12 feet from the edge of the Grand Trunk right -of -way, which would preclude the opening or extension of Hancock (since it is a 24 foot street) without the purchase of land from the railroad." "These people have used the alley on either the West or East side of said Bank Out Lot 92 as a means of ingress and egress for-many'.years,and had they-applied for water:.or sewer permits Cohen building, would have been refused the same." Mr. Kroll made a motion, seconded by Mr. Muszynski, that the Hancock Street matter be referred to the Streets and Alleys Committee. Motion carried. Councilman Kroll requested that the Board of Public Works and Safety be directed to ask the Chief of Police to have his men patrol more aggressively the area between Sample Street and Western Avenue on Olive Street relative to inter- city truck traffic. They are also to patrol the parallel streets east and west of Olive Street as no trucks are 1257 REGULAR MEETING AUGUST 12th, 1957 to use these streets and complaints have been received that trucks are using them. There being no further business before the Council, Councilman Hahn made a motion to ,adjourn. Councilman Kroll seconded the motion.
