The meeting was called to odder by President Stanley C. Korpal, who presided. ROLL CALL: PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn and Muszynski. ABSENT: Councilman Erler. MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. CARR Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. PETITION Petition of Edward Nowak, et al, to annex Lots 45, 46, 62 and 63 in Homeland Addition. Councilman Hahn made a motion that the petition be referred to the City Planning Commission. Councilman Kroll seconded the motion. Motion carried. PETITION Petition of Frank Nowaczewski to rezone Lots 3 and 4 of L. F. Bakers Sub - division of Bank Out Lot 87 from B to D. Councilman Kroll made a motion that the petiton be referred to the City Planning Commission: Councilman Carr seconded'', the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE: To the Common Council of the City of South Bend: (From Albert Street North to City Limits) Your Committee on Ordinances to whom was referred an Ordinance to annex certain parcels of land in the City of South Bend, Indiana, Respectfully report that they have examined the matter and that in their opinion the petition for annexation be denied at this time. The Committee found that the Plan Commission did not have information before it JULY 22, 1957 that an action was pending in the Court. It is the belief of the Committee that as long as there is an action pend- ing, in reference to this matter, that no approval be given. Is/ G. W. REPORT OF ORDINANCE COMMITTEE: To the Common Council of the City of South Bend: Your Committee on Ordinances to whom was referred An Ordinance to amend Ordinance No. 3702 as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana (Seven Parcels of land on Lincoln Way West), Respectfully report that they have examined the matter and that in their opinion it should be held in Committee until the Attorney representing the petitioners returnsto town. Isl George W. Carr, Chairman Councilman Kroll made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE: To the Common Council of the City of South Bend: Your Committee on Ordinances to whom was referred An Ordinance amending Ordinance No. 3702 commonly known as the zoning ordinance of the City of South Bend, Indiana (real estate involved located on the South side of McKinley Highway and East of Manchester Driae continued across McKinley), Respectfully report that they have examined the matter and that'in their opinion It is still in committee for further study. Is/ George W. Carr, Chairman Councilman Tellson made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion.carried. REPORT FROM CITY ENGINEER: The City Engineer, Mr. Andrysiak, made a report on the complaint about the water which was referred to the Board of Water Works Commissioners. Mr. Andrysiak stated that the extremely hot weather, which necessitated the usage of large amounts ofewater� have, in part, correcte& the situation. He suggested, also, that in sections of the City where the situation existed, it could be remedied by residents turning on the water taps the first thing in the morning to drain the pipes of water which had lain in then' all night. Mr. Andrysiak stressed the fact that samples of water are taken from each pumping station daily and tested by the South Bend Medical Foundation and that a weekly test is made by the Indiana State Board of Health to make sure the water is pure.. Councilman Kroll made a motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. REPORT FROM,CITY ENGINEER: At the July 9, 1957; 1253 REGULAR MEETING REPORT OF CITY PLANNING COMMISSION The Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: JULY 22, 1957 July 12, 1957 The attached petition of Belleville Investment Company to zone land at the northeast corner of Mayflower Road and Sample Street from '.'C -1" Commercial to "C" Commercial was legally advertised on July 1, 1957 and given public hearing under date of July 11, 1957. No one appeared in remonstrance. It was therefore duly moved, seconded, and unanimously carried that the petition be favorably recommended to the Com- mon Council. ORDINANCE NO. 4175 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspen- sion of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 abse The ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Erler). ORDINANCE NO. 4176 11 AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for sus- pension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, I absent (Counci man Erler). OD BUSINESS �. A complaint was made that the New Jersey,Railroad is blocking Western Avenue in the morning when people are on their way to work. Councilman Tellson made a motion, seconded by Councilman Muszynski, that the Board of Public Works and Safety contact the New Jersey Railroad and ask them if they can cease switching cars, which results in the blocking of the crossing,,;while people are on their way to work in the morning. Motion carried. NEW BUSINESS Councilman Tellson reported that he had complaints of people living in the 200 block South St. Peter Street who are burning garbage. Councilman Tellson made a motion, seconded by Councilman Kroll, that the Health Department investi- gate the complaint to see if they can determine who is burning garbage in that vicinity and see that they desist. Motion carried. A report is to be made a- the next meeting of the Council, August 12th. Councilman Kroll made a motion, seconded by Councilman Carr, that the Health Department the large number of hronets in the 2500 block of South Gertrude Street, and to see if they can be exterminated. Motion carried. A report is to be made at the next meeting of the Council, August 12th. A complaint was received that a house located at 839 South Grant Street is being used as a warehouse in 'violation of the existing zoning ordinance which covers that location. Councilman Kroll made a motion, seconded by Councilman Muszynski, that the building Department investigate the above complaint and made a report back to the Council at their next meeting, August 12th. Motion carried. There being no further business before the Council, Councilman Carr made a motion to adjourn. Councilman Tellson seconded the motion.
