Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Chambers, Monday, May 27, 1957, at 8:30 P.M., C.D.S.T., with all members present except Councilman Stanley C. Korpal called the meeting to order and presided. Al1T T rAT T . PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Erler and Muszynski. ABSENT: Councilman Hahn. REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend; Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION Clerk, dity of South Bend City Hall South Bend, Indiana Dear Madam: South Bend, Indiana Mau 22, 1957 It has come to my attention that certain petitions which were introduced at the council meeting of the 20th of May, 1957, with reference to the trucking problem did not represent the facts as presented to me prior to my introduction of same. You will recall that I introduced the petitions informing the President of the Council that all of said petitions represented all streets from Kosciusko west to the city limits. I have learned through investigation that, in essence, said petitions represented Kaley, Bendix, Liberty, Camden, Olive, Meade and Dundee beginning at the four hundred block south of Western Avenue thence south to Sample Street. In as much as the representation made to me and which I, in turn, made to the Council, does not represent the proper description of said petitions, I respectfully request that all of said petitions be withdrawn as of this date. I wish to further bring,to your attention that the petition with reference to the PTA shall remain on file. Respectfully submitted, Joseph Kroll x. PETITION Petition of Blenke Brothers Realty Company, Inc., for annexation to the City of South Bend, Indiana, of the property located from Albert Street North to the present City Limits between Michigan and Main Streets. Councilman Erler made a motion that the petition be referred to the City Planning Commission. -Councilman Carr secondei the motion. Motion carried. PETITION Petition of C. M. Daniels to rezone from B Residential to C Commercial and from A Height and Area to D Height and Area real estate known as Lots Numbered 309 and 310 in Lincoln Manor Addition to the City of South Bend. Councilman Kroll made a motion that the petition be referred to the City Planning Commission. Councilman Christman seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE: Report of Ordinance Committee on an Ordinance to amend several sections of Ordinance No. 3973 on Heating. Councilman Carr, Chairman of the Ordinance Committee reported that the matter is still in Committee. No report as yet. REPORT OF THE COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the whole to whom was referred AN ORDINANCE APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($1,000,000.00) to be applied to the cost of construction, re- construction and improvement of streets and expenses incurred in connection therewith, Respectfully report that they have examined the matter and that in their opinion it should be reported Favorable. /s/ G. ORDINANCE NO. 4166 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS $1,000,000.00) TO BE APPLIED TO THE CONSTRUCTION, RE- CONSTRUC- TION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent (Mr. Hahn). ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $306.66 TO OFFICE OF CITY JUDGE, Account E -212, POSTAGE, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1957 AND DECLARING AN EXTRAORDINARY EMERGENCY. k The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set for public hearing on June 10, 1957. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE NO. 4167 AN ORDINANCE AUTHORIZING THE SALE OF A ?WELLING HOUSE LOCATED ON THE FOLLOWING DESCRIBED REAL ESTATE: A LOT OR PARCEL OF LAND THIRTY -THREE (33) FEET IN WIDTH, NORTH AND SOUTH, TAKEN OFF OF AND FROM THE ENTIRE WIDTH OF THE SOUTH ENDS OF LOTS NUMBERED 17, 18, 19, and 20 AS SHOWN ON THE RECORDED PLAT OF THOMAS E. A. BYERLEY'9 ADDITION TO THE TOWN OF MYLER, NOW A PART OF THE CITY OF SOUTH BEND, AND COMMONLY DESCRIBED AS THE CORNER OF INDIANA AVENUE AND KEMBLE STREET IN THE CITY OF SOUTH BEND, INDIANA, OWNED BY THE MUNICIPAL CITY OF SOUTH BEND The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion for suspen- sion of rules. Councilman Erler seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Mr. Hahn)., The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, I absent (Mr. Hahn). NOTICE OF INTENTION TO RECONSIDER VOTE ON THE RESOLUTION OF THE COUNCIL NOTICE OF INTENTION TO RECONSIDER VOTE TO THE COUNCILMEN OF COMMON COUNCIL OF THE CITY OF SOUTH BEND: You are hereby notified that the undersigned in accordance with Paragraph 18 of Section 27 of Chapter 2 of the "Municipal Code of South Bend, Indiana" (1949) does hereby intend to move, at the next regular meeting of this Council, for the reconsideration of the vote on the Resolution of this Council relating to re- routing of inter- city trucks caused by the construction work being done on Sample Street. /s/ Walter G. Glass Walter Glass, Councilman RECESS 8 :45 P.M., to 9:00 P.M. Councilman Kroll made a motion to reconsider the vote on the Resolution. Councilman Christman seconded the motion. Motion carried. Councilman Kroll made a motion to amend the Resolution in the following manner: "That in between the 3rd from the last paragraph on page 2 and the 2nd from the last paragraph on page 2, there be inserted the following paragraph: "IT IS FURTHER RESOLVED: That intra -city trucks shall be permitted to use Olive Street." Councilman Muszynski seconded the motion. Motion carried. Councilman Kroll made a motion to adopt the Resolution as amended. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 6 ayes (Councilmen Korpal, Carr, Tellson, Kroll, Glass and Muszynski), 2 nays (Council- men Christman and Erler), 1 absent (Councilman Hahn). Attorney Miller filed petitions containing 1741 signatures of Remonstrators to the Resolution. There being no further business before the Council, Councilman Kroll made a motion to adjourn.
