HomeMy WebLinkAbout04-08-57 Council Meeting MinutesREGULAR MEETING APRIL 8, 1957 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, April 8, 1957, at 8:39 P.M. with all members present. President Stanley C. Korpal called the meet- ing to order and presided. ROLL CALL: PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Hahn, Erler, and Muszynski. ABSENT: None. REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspec- ted the minutes of the previous meeting of the Council and found them correct. Councilman Hahn seconded the motion. Motion carried. COMMUNICATION• The Clerk read the following Communication: ' REGULAR MEETING COMMUNICATION (Cont.) April 2, 1957 To members of City Council: APRIL 8, 1957 Inasmuch as Governor Handley's Gas Tax has gone into effect, Wouldn't it be a good time to put pressure on him for the north -south truck by -pass? I believe this was to be financed through this tax. Thank You. R. A. PETITION Petition of Steve A. Krause, et al, to rezone Lots, 1, 2, 3 and 4 in Mayr's Michigan Avenue Addition from B use and A Height and Area to C Commercial Use and E Height and Area District. Councilman Erler made a motion that the Petition be referred to the City Planning Commission. Councilman Kroll seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE: Report of- Ordinance Committee on Ordinance amending several sections of Ordinance No. 3893 on Heating. Councilman Carr, Chairman,,reported that the Ordinance is still in Committee. REPORT OF COMMITTEE OF THE WHOLE: To the Common- Gouncil of the City of South Bend: Your Committee of the Whole, to whom was referred AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF $1650.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT E -11, SALARY OF TRAFFIC CLERK (4) ALL OF THE BUDGET FOR THE CIVIL CITY O SOUTH BEND, INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY, and . Respectfully report that they have examined the matter /that in their opinion it should be reported as favorable. E /s/ G. W. (ORDINANCE NO. 4155 AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF $1650.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT Erll, SALARY OF TRAFFIC CLERK (4), ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, =_ INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY. IThe Ordinance was given third reading and passed by a roll call vote of 9 ayes, O nays,. (REPORT OF CITY PLANNING COMMISSION: Honorable Common Council City of South Bend, South Bend, Indiana !Gentlemen: 5 April 1957 The attached petition of Associates Investment Company to rezone land at the intersection of Esther and Ruskin Streets from "B" Residential use District and "A" Height and Area District to "D" Light Industrial Use District and "E" Height and Area District being: Lots 1, 2 and 3 in John Adams First Addition located-at the northeast corner of Ruskin and Esther Streets, AND Also a tract of land south of Ruskin Street, to -wit: Commencing on the south line of Ruskin Street at a point 136 feet East of the east line of Esther Street, thence South 297 feet; thence East 332.45-feet;'thence North 297 feet to the south line of Ruskin Street, thence West 333.46 feet, more or less, along the south-line of Ruskin Street to the place of beginning. This petition was legally advertised under date of 25 March 1957 and given public hearing under date of 4 April 1957. The following action was taken: After due consideration the Commission found that the general area south of Ruskin Street is residential as to use and zoning, that the subject area is adequate in size, shape and area for residential development; that light industrial use of subject area would be an unwarranted and unjustifiable intrusion into a residential area; that no general neighborhood need was shown for increased industrial land and that in fact, ample industrial land suitable for the purpose proposed in Associates Investment Company petition existed in the light industrially zoned tract north of Ruskin Street. The Commission further found that aforesaid Lots 1, 2, and 3 of John Adams First Addition are in a block which is predominately zoned for light industrial purposes and that the best use of said land would be light industrial It was therefore mooed by Mr. Van DeVeire, seconded by Mr. Muszynski that the Planning Commission recommend Lots 1, 2, and 3.of John Adams First Addition favorably to the Common Council and further that petition area south of Ruskin Street be unfavorably recommended. ) tL (Remonstrance petition with 30 signatures is attached to the petition. REPORT OF CITY PLAN COMMISSION: Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 5 April 1957 The attached petition of Melvin Pasalich to annex to the City of South Bend a tract of land in the northeast k of the southwest k of Section 25, T37N, R2E, described as follows: Beginning at a point 66.3 feet west of the northeast k of the southwest 4 of section 25, thence west 81.7 feet, thence south 219.95 feet, thence east 81.7 feet, thence north 219.95 feet to the place of beginning, subject to legal highways. This petition was legally advertised under date of 25 March 1957 and given public hearing under date of 4 April 1957. The following action was taken. After due consideration it was moved by Mr. Andrysiak, seconded by Mr..Muszynski, and unanimously carried tha the petition for annexation be favorably recommended to the Common Council. REPORT OF CITY PLAN COMMISSION: Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 5 April 1957 The attached ordinance, originated by your City Planning Commission, was legally advertised under date of 25 March 1957 and given public hearing under date of 4 April 1957. The following action was taken: After due consideration it was moved by Mr. Worden and seconded by Mr. Andrysiak that the ordinance be favorably recommended to.the Common Council. BEING AN ORDINANCE AMENDING ORDINANCE NO. 3702, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Esther and Ruskin-Streets) The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set for public hearing on April 22, 1957. Councilman Kroll seconded the motion. Motion carried. ORDINANCE NO. 4156 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA ( Ireland Road and Fellows Street) The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for Suspension of Rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 9 ayes, 0 nays. The Ordinance was then given third reading and passed by a roll call vote of 9 ayes, o nays. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA The Ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the Ordinance be set for public hearing on April 22, 1957. Councilman Carr seconded the motion. Motion carried. nvnTTTANIOV AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM THE GENERAL FUND THE SUM OF $7,000.00 TO FIRE DEPARTMENT ACCOUNT Q -711, BUILDINGS AND FIXTURES DEPARTMENT, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. Councilman Erler made a motion to suspend the 48 hour rule on the receiving of the ordinance in order to take action ` 1222 REGULAR MEETING APRIL 8, 1957 on the Ordinance at this time. Councilman Carr seconded the motion. Motion carried. Councilman Erler then made a motion that the Ordinance be set for public hearing on April 22, 1957. Councilman Kroll seconded the motion. Motion carried. OLD BUSINESS Councilman Kroll, Chairman of the Traffic and Transportation Committee made a report of activities of the Committee relative to traffic on Olive Street. He stated that during the past two weeks several conferences have been had with members of the Truckers Association and Residents of the area. He stated that one member of the Trucking Association was out of the City but would be back within the week and some compromise should be reached within a couple of weeks. Councilman Muszynski made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. NEW BUSINESS .. Councilman Tellson made a motion that the City attorney prepare a resolution proclaiming April 19, a Holiday in com- memoration of the First shot fired in the Revolutionary War on April 19, 1775, 182 years ago; and that copies of the Resolution be sent to the Federal Government and to the State of Indiana. There was no second to the motion. Motion lost. Councilman Kroll made a motion that the Clerk of the Board of Public Works and Safety be directed to write letters to all railroads having grade crossings within the city limits of South Bend, advising them that according to Ordinance, they must keep all grade crossings in repair. Councilman Muszynski seconded the motion. Motion carried. The above motion came as'a result of complaints from several Councilmen about chuck -holes within the right -of -way and bad conditions of grade crossings in South Bend, especially the Kemble Street Crossing. Also, Arnold, Walnut, Harris, Ford and Prairie Crossings. Councilman-Kroll stated that something be done about the condition of the property at 219 LaPorte Avenue. He stated that the Fire_Inspector had been out but that no condemnation had been ordered. He also asked that the Health De- partment.make an investigation of the conditions. There being no further business before the Council, Councilman Hahn made a motion to adjourn. Councilman Tellson seconded the motion.
