President Stanley C. Korpal called the meeting to order and presided. i ROLL CALL PRESENT: Councilmen Korpal, Carr, Tellson, Kroll, Glass, Hahn, Erler and Muszynski. ABSENT: Councilman Christman. REPORT OF THE.COMMITTEE ON MINUTES: To the Common, Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Muszynski made a.motion that the report be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. PETITIDN Petition of Marshall Heights Realty Company to Annex a plat of land adjacent to Twyckenham Hills and North of Ireland Road Councilman Erler made a motion that the Petition be referred to the City Planning Commission. Councilman Kroll seconded the motion. Motion carried. .REPORT ON FILM Councilman Kroll reported that the traffic film being prepared by the Truckers" Association was not available as yet. Councilman Glass made a.motion that the report be accepted and placed on file. Councilman Carr seconded the motion. Motion carried. REPORT OF ORDINANCE COMMITTEE AN ORDINANCE AMENDING SECTIONS 1, 2, 3, 5, b; 7, 9, 10 and 17, OF ORDINANCE NO. 3973 ADOPTED ON THE 12th DAY OF APRIL, 1954. Chairman of the Ordinance Committee, George W. Carr, reported that the above Ordinance is still in Committee. REPORT OF COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend: Your Committee of the Whole, to whom.was referred AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND TO OFFICE OF CITY JUDGE, ACCOUNT E -13 SPECIAL (PAUPER) ATTORNEY FUND THE SUM OF $1200.00 ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1957, AND DECLARING AN EXTRAORDINARY EMERGENCY, Respectfully report that they have examined the matter and that in their opinion it should be reported favorable. G. W. CARR, Chairman Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Kroll seconded the motion. Motion carried. REGULAR MEETING REPORT OF COMMITTEE OF THE WHOLE: To the Common Council of the City of South Bend; FEBRUARY 11, 1957 Your Committee of the Whole, to whom was referred AN ORDINANCE TO CHANGE THE NAME OF ROBINHOOD COURT, FROM MICHIGAN STREET (U. S. HIGHWAY NO. 31), EAST TO BARBIE STREET, TO BARBIE STREET, Respectfully report that they have examined the matter and that in their opinion it should be reported favorable. G. W. Carr, Chairman Councilman Hahn made a motion that the report be accepted and placed on file. Councilman Carr seconded the motion. Motion carried. The Ordinance was given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Christman ORDINANCE NO. 4142 AN ORDINANCE TO CHANGE THE NAME OF ROBINHOOD COURT, from MICHIGAN STREET ( U.S. HIGHWAY NO. 31) EAST TO BARBIE STREET, TO BARBIE STREET The Ordinance was given third reading and passed by a roll call vote of 7 ayes (Councilmen Korpal, Carr, Tellson, Kroll, Glass, Hahn, Erler ), 1 nay, (Councilman Muszynski), 1 absent, (Councilman Christman). REPORT OF CITY PLAN COMMISSION: Annual report of City Plan Commission. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION: k Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 9 February 1957 The Attached petition of Nellie E. Kelsey to zone from "A" Residential to "C" Commercial and "D" Height and Area District lots 1, 2,' and 3 of Logan Heights Proposed Addition; was legally advertised under date of 28 January 1957 andt)�iven public hearing under `date of 8 February 1957. The following action was taken: The Commission found that the other three corners of the intersection of Jefferson and Logan Streets are being used commercially and are so zoned. Subject - property is entirely unsuitable for residential use. It was therefore, moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. Councilman Hahn seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TO AMEND ZONING ORDINANCE NO. 3702, APPROVED JUNE 14, 1949, OF THE CITY OF SOUTH BEND, AND PUBLISHED JUNE 21, 1949, SO FAR AS THE SAME RELATES TO LOTS NUMBERED ONE (1), TWO (2) AND THREE (3) IN THE PROPOSED ADDITION OF LOGAN HEIGHTS. The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent (Councilman Christman). The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Christman. ORDINANCE AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM THE GENERAL FUND THE SUM OF $1,900.00, TO OFFICE OF THE BOARD, ACCOUNT H -726, OTHER EQUIPMENT (PUBLIC ADDRESS SYSTEM) AND FROM ELECTRICAL DEPARTMENT ACCOUNT V -38, GENERAL SUPPLIES, THE SUM OF $172.50 TO ELECTRICAL DEPARTMENT ACCOUNT V -725, OFFICE EQUIPMENT (TYPEWRITER) ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1957. AND DECLARING AN EXTRAORDINARY EMERGENCY. The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set for public hearing on February 25, 1957. Councilman Kroll seconded the motion. Motion carried. AWenr rrrTnu WHEREAS, the State of Indiana is enjoying great growth and development, and 1207 REGULAR MEETING FEBRUARY 11, 1957 WHEREAS, much of this industrial progrees has been due to friendly labor - management relations in Indiana in recent years, and, WHEREAS, the citizens of Indiana believe in the free enterprise system, the right of labor to organize, and in the process of collective bargaining between labor and management, and WHEREAS, the Indiana General Assembly is considering proposed, legislation for our State which would destroy the basis of the present industrial progress of Indiana, now, therefore, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that we earnestly recommend to the Indiana General Assembly, now in session, that no legislation be enacted by the General Assembly which is designated to change or alter the present system of free collective bargaining in labor- management relations in Indiana, which system has proved successful in the industrial growth of Indiana, and is in the best interests of all Indiana citizens. BE IT FURTHER RESOLVED, that a,copy of this RESOLUTION be sent to the President of the Indiana Senate, the Speaker of the Indiana House of Representatives, the majority and minority leaders of the Indiana Senate, and the majority and minority leaders of the Indiana House of Representatives. Unanimously adopted by the Common Council of the CITY OF SOUTH BEND, IM IANA, this 11th day of February, 1957. The motion was seconded by Councilman Carr. Motion tarried. OLD BUSINESS: Traffic Engineer Ernest Miller appeared before the Council at the request of the Council to answer questions regard- ing control of speed, speed signs acid regulations on State Routes intersecting Streets in the City of South. Bend. NEW BUSINESS: Councilman Carr requested information as to whether there would be any way of mandating the State of Indiana to con- struct a truck by -pass around South Bend inasmuch as Federal Funds received for that purpose appear to have been depleted before any such road was planned for the Northern part of the State. Delegates from Several P. T. A. Groups attended the Council Meeting. Councilman Tellson made a motion that the Ordinance Committee investigate the possiUlity of placing larger "speed" signs in school.zopes. Councilman Muszynski seconded the motion. Councilman Erler moved that the motion be amended by striking out "Ordinance Committee" and inserting " Traffic and Transportation Committee ". Councilman Kroll seconded the motion. Motion carried. President Korpal requested that the Clerk write a letter to the Executive Director of the Boy Scouts of this city requesting that the Boy Scouts,who were elected to serve as Councilmen on Boy Scout Day, be present at the February 25, 19571 meeting`-'of the Council. Councilman Erlevfrequested an investigation of the brick side - walks at the Garst Street entrance to the Studebaker Corporation. Councilman Kroll requested an investigation by the Police Department of trucks parked on the sidewalk and between the sidewalk and curb on Rupel Street between Wilber and College Streets. There being no further business before the Council, Councilman Tellson made a motion to adjourn. Councilman Muszynski seconded the motion.
