HomeMy WebLinkAbout01-14-57 Council Meeting MinutesREGULAR MEETING JANUARY 14, 1957 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular Session in the Council Chambers, Monday, January 14, 1957, with all members present except Councilman Hahn. President Stanley Korpal called the meeting, to order and presided. The meeting was called to order at 8:56 P.M. ROLL CALL PRESENT: Councilmen Korpal, Carr, Tellson, Christman, Kroll, Glass, Erler and Muszynski. ABSENT: Councilman Hahn. REPORT OF THE-COMMITTEE ON MINUTES: To the Common ..Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Kelsey to rezone the following described real estate from A- Residential and A- Height and Area to C- Commercial and D- Height and Area: Lots Numbered One(1), Two (2) and Three (3), Logan Heights Proposed Addition to the City of South Bend, described as beginning at the intersection of the West Line of Logan Street at the South line of Jefferson Boulevard thence West one hundred thirty -four (134) feet; thence South one Hundred fifty (150) feet; thence East one hundred thirty -three and sixty -eight hundredths (133.68) feet; thence North one hundred fifty (150) feet -to the place of beginning. Councilman Kroll d-ade a motion that the petition be referred to the City Planning Commission. Councilman Carr second- ed the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred An Ordinance appropriating from the General Fund $75.00 to Office of the City'Judge, Account E -13, Pauper Attorney, all of the Budget for the Civil City of South Bend, Indiana, for 1956, and declaring an extraordinary.emergency, Respectfully report that they have examined the matter and that in their opinion this Ordinance should be withdrawn. It was recommended by the Committee of the Whole that the Ordinance Committee meet with the City Attorney and the City Judge in order to draft an Ordinance that would cover Pauper Attorney Fees - for the entire year instead of for each individual case. REPORT OF CITY PLAN COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 11 January 1957 The attached petition of Colpaert Realty Corporation was legally advertised under date of 24 December 1956 and given Publ c hearing uiideV* date of 3 January 1957. This Petition seeks to change the following described land from "C" Commercial to "B" Height and Area District: Beginning 175 feet from the intersection of Huron and Lombardy Drive and being 45 feet.North therefrom on Lombardy and 250 feet in depth; And in addition to change from "B" Residential to "C" Commercial and "E" Height and Area District, the following land: Beginning 175 feet North of Huron Street and the North -South alley immediately West of Gladstone Street, thence 58 -4 feet North, thence 435 feet West, thence 58.4 feet South, thence 435 feet East. The following action was taken: After due consideration, it was moved, seconded and unanimously carried that the petition be recommended favorabl to the Common Council. REPORT OF CITY PLANNING COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: 11 January 1957 The attached Petition of Belleville Investment Company to zone from "B" Residential to "A" Residential and "A" Height And Area District all land abutting Scenic Drive from Ford Street to Mayflower Road, being Lots 704 through 749 of Belleville Unit "E" Addition; was legally advertised under date of 24 December 1956 and given public hearing under date of 3 January, 1957. The following action was taken: After due consideration, it was moved, seconded and unanimously carried that the petition be recommended favorably to the Common Council. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $75.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT E 13, PAUPER ATTORNEY, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1956, AND DECLARING AN EXTRAORDINARY EMERGENCY. The Ordinance was given third reading and lost by a roll call vote of 8 nays, 0 ayes, 1 absent, Mr. Hahn. Upon the recommendation of Mr. Korpal, it w?s moved by Mr. Carr, and seconded by Mr. Kroll that the Ordinance Committee meet with the City Attorney and City Judge in order to draft an Ordinance that would cover Pauper Attorney Fees for the entire year instead of for each individual case. Motion carried. ORDINANCE NO. 4133 AMENDMENT OF ZONING ORDINANCE (Land bonded by Western Avenue, Lombardy Drive, Huron Street and the alley west of Gladstone) The Ordinance was given first reading by title and second reading in full.. Councilman Muszynski made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. ORDINANCE NO. 4134 AMENDMENT OF ZONING ORDINANCE (Land abutting Scenic Drive fromFord Street to Mayflower Road) The Ordinance was given first reading by title Pnd second reading in full. ORDINANCE NO. 4135 AN ORDINANCE AMENDING ORDINANCE NO. 4128 (Pierre Navarre Park Annexation) The Ordinance was given first reading by title and second reading in full. Councilman Erler made a motion for suspension of rules. Councilman Carr seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, l absent, Councilman Hahn. ' ORDINANCE NO. 4136 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 393 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951. The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion for sus- pension of rules. Councilman Kroll seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. 4 ORDINANCE NO. 4137 AN ORDINANCE APPROVING A CONTRACT BETWEEN THE SOUTH BEND BOARD OF PUBLIC WORKS AND SAFETY AND THE MAXIM MOTOR COMPANY OF MIDDLEBORO, MASSACHUSETTS, FOR THE PURCHASE OF ONE MAXIM CUSTOM BUILT ONE THOUSAND GALLONS PER MINUTE TRIPLE COMBINATION ON MOTORIZED PUMPTING FIRE APPARATUS FOR $23,899.05. The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion for suspen- sion of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, 1 absent, Councilman Hahn. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, 0 na 1 absent, Councilman Hahn. ORDINANCE AN ORDINANCE AMENDING SECTION 3, 6 and 8 of CHAPTER 7 OF GENERAL ORDINANCE NO. 3709, WHICH IS AN ORDINANCE AMENDING SECTION 2, 5 and 8 OF ARTICLE II OF ORDINANCE NO. 3312 ADOPTED ON THE 8th DAY OF JANUARY, 1940. The Ordinance was given first reading by title and second reading in full. Councilman Carr made a motion that the Ordinance be set for public hearing on Monday, January 28th, 1957. Councilman Kroll seconded the motion. Motion carried. NEW BUSINESS Councilman Carr made a motion that the Traffic and Transportation Committee meet with the St. Joseph County Commissi, ers and the officials of the Standard Oil Company relative to rerouting truck traffic away from South Bend Avenue (Route 23). Councilman Erler seconded the motion. Motion carried. Councilman Christman requested that legal advertisements be submitted as they should be and not ambiguous as the previous one was relative to advertising for bids on Fire apparatus. Councilman Glass made a motion that the Chairman appoint a committee to study ways and means of acquiring a new City Hall. Councilman Muszynski seconded the motion. Motion carried. President Korpal appointed the Urban Redevelop- ment and Housing Committee to work on this matter. Councilman Kroll made a motion that the Clerk instruct Mr. Sabo, Clerk of the Board of Public Works and Safety, to rearrange the desks of the Councilman as they were previously and that the desks should be left in that position at 12 i7'2 REGULAR MEETING JANUARY 14th, 1957 all times. Councilman Carr seconded the motion.. Motion carried. There being no further business before the Council, Councilman Carr made a motion to adjourn. Councilman Muszynski seconded the motion.
