COMMITTEE OF THE WHOLE MEETING JANUARY 14, 1957
Be it remembered that the Common Council of the City of South Bend, Indiana, met in the Committee of the Whole in the
Council Chambers, Monday, January 14, 1957, at 8:16 P.M., with all members present except Councilman Hahn. Council-
man Carr, Chairman, Presided.
ORDINANCE
AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $75.00 TO OFFICE OF THE CITY JUDGE, ACCOUNT E -13,
PAUPER ATTORNEY, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1956, AND DECLARING
AN EXTRAORDINARY EMERGENCY.
The above Ordinance was called out of Committee. Proponents and opponents were given an opportunity to be heard on
this matter. City Attorney Irving Smith stated that, in his opinion, the City Judge could mandate the City to pay
Attorney fees for Pauper Attorneys,
Councilman Korpal made a motion that the Committee of the Whole recommend to the Council that the present Ordinance
be withdrawn. Councilman Kroll seconded the motion. Motion carried.
Councilman Korpal made a motion that the Committee of the Whole recommend to the Council that the Ordinance Committee
meet with the City Attorney and the City Judge in order to draft an Ordinance that would cover Pauper Attorney Fees
for the entire year instead of for each individual case. Councilman Muszynski seconded the motion. Motion carried.
There being no further business before the Committee of the Whole, Councilman Muszynski made a motion to adjourn.
Councilman Erler-,seconded the motion. Motion carried and the Committee of the Whole meeting adjourned at 8:54 P.M.
