HomeMy WebLinkAbout07-23-56 Council Meeting MinutesREGULAR MEETING JULY 23,1956 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regu;ar Session in the Council Chamber, Monday, July 23rd, 1956, at 8:11 P.M., C.D.S.T. (7:11 P.M., C.S.T.), with all members present. President Korpal presided. REPORT OF COMMITTEE ON MINUTES: To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They, therefore, recommend that the same be approved. Meeting of July 9th, 1956. STANLEY C. KORPAL JULIUS B. CHRISTMAN, JR. COMMITTEE GEORGE W. CARR COMMUNICATION A Communication from Judge Edward Olczak was read relative to the request made by the Council for a report of transactions in Cafeteria Court. The communication stated figures covering receipts for the first six months of 1956, and-also stated that the present quarters of the Cafeteria Court are inadequate and a request made for larger off ices: Motion was made by Councilman Muszynski that the communication be accepted and placed on file. Motion seconded by Councilman Kroll. Motion carried. COMMUNICATION A Communication from Mayor Edward F. Voorde relative to the establishment of an Urban Redevelopment Commission and request for action by said commission in eleiminating the slum areas in South Bend, and providing adequate, clean housing. Motion was made by Councilman Kroll, seconded by Councilman Muszynski, that the Communication be accepted and placed on file, Motion carried. PETITION Petition of the First Bank and Trust Company to rezone Lots 247 to 254, inclusive, in the revised plat of Broadmoor 3rd- section from '4B" Residence use district and "B" height and area district to "C" Commercial Use district and "D'" Height and area district. Councilman Erler made a motion that the petition be referred to the City Plan Commission. Councilman Carr seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE 4 To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred An Ordinance authorizing the Inspector of Sub - standard Buildings and Dwellings to demolish an unsafe building and appropriating $125.00 for same, respectfully report that they have examined the matter and that in their opinion it should be reported favorable. /s/ George W. Council of the City of South Bend: JULY 23rd, 1956 Your Committee of the Whole to whom was referred An Ordinance appropriating from the General Fund $1,424.00 to office of Controller B252, repair of equipment $150.00 and to Office Equipment B725 $1,274.00, all of the budget for the civil City of South Bend, Indiana, for 1956, and declaring an extraordinary emergency, respectfully report that they have examined the matter and that in their opinion it should be reported favorable. Carr, Chairman AN ORDINANCE AUTHORIZING THE INSPECTOR OF SUB- STANDARD BUILDINGS AND DWELLINGS TO DEMOLISH AN UNSAFE BUILDING, AND APPROPRIATING $125.00 FOR SAME, FROM THE GENERAL FUND TO B261 CONTRACTUAL SERVICE The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4106. "4107 AN ORDINANCE AMENDING ORDINANCE #3702 ADOPTED BY THE COMMON COUNCIL ON THE 13th DAY OF JUNE, 1949, Lot 1, Dunn's 1st Add -2112 Mishawaka Avenue) The Ordinance was given first reading by title and second reading in full. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE AN ORDINANCE AUTHORIZING THE CITY CONTROLLER OF THE CITY OF SOUTH BEND, INDIANA, TO MAKE A TEMPORARY LOAN OF $30,000.00 FROM THE STATE OF INDIANA, OR OTHER GOVERNMENT AGENCY, FOR THE PURPOSE OF MAKING A SEWER SURVEY OF- THE CITY,OF SOUTH BEND, INDIANA. The Ordinance was given first reading by title and second reading in full. Motion by Councilman Erler that the word "temporary" be deleted in the title and in Section I &2.Motion was seconded by Councilman Hahn. Motion carried. Councilman Muszynski moved for suspension of rules. Motion seconded by Councilman Hahn. Upon roll call vote, 8 ayes, 1 nay (Councilman Christman) the motion was lost. Councilman Tellson moved that the above ordinance be set for public hearing on August 13th, 1956. Motion seconded by Councilman Muszynski. Motion carried. ` ORDINANCE AN ORDINANCE TRANSFERRING AND APPROPRIATING $360.00 FROM SERVICES 242 CITY PLAN COMMISSION TO PROPERTIES 724 - MOTOR EQUIPMENT CITY PLAN COMMISSION; ALT ,OF THE BUDGET FOR 1956 OF THE CIVIL CITY. OF SOUTH BEND, INDIANA, AND DECLARING AN EMERGENCY. The Ordinance was given first reading by title and second reading in full. Motion by Councilman Muszynski, seconded by Councilman Erler, that the ordinance be set for public hearing on August 13, 1956. Motion carried. 01? nTM ATTrP, AN ORDINANCE CREATING THE SOUTH BEND REDEVELOPMENT COMMISSION The Ordinance was given first reading by title and second reading in full. Motion by Councilman Kroll that the Ordinance be feferred to the Ordinance Committee for further study. Motion seconded by Councilman Muszynski. Motion carried. OLD BUSINESS: Councilman Muszynski informed the Council that switching operations at theOlive and Sample Street grade crossing and the Ford and Walnut Street grade crossing are again holding up traffic for periods from fifteen to thirty minutes. The Clerk was directed to refer this matter to the Board of Public Works and Safety for dis- position, andit was suggested that the Transportation Committee of the Council meet with representatives of the Railroads to discuss this matter. NEW BUSINESS: Mr. Robert Crane and Mr. William Smith came before the Council to ask for relief from a situation in the neighborhood of Barbie and Terri Streets, relative to improper drainage from Pierre Navarre Park. The Clerk was directed to refer this matter to the Board of Public Works and Safety to determine who has juresdiction over the adjacent property to Pierre Navarre Park as to drainage, walls and street lights. Councilman Glass asked that the City Attorney check the record to see if there was any limitation to the size of fireworks allowed, as he had been getting complaints about fireworks in the park shaking houses. There being no further business before the Council, Councilman Muszynski made a motion to adjourn, which motion was seconded by Councilman Tellson. Motion carried and the meeting adjourned at 9:07 P.M., C.D.S.T., (8:07 P.M.,C.S.T.). ATTEST: APPROVED-
