HomeMy WebLinkAbout05-28-56 Council Meeting MinutesREGULAR MEETING MAY 28TH, 1956 Be it remembered that the Common Council of the City of South Bend, Indiana, met in Regular session in the Council Chamber, Monday, May 28th, 1956, at 9:04 P.M., (C.D.S.T.)., with all members present. President Korpal presided. 'REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They, therefore, recommend that the same be approved. Meeting of May 14th, 1956. COMMUNICATION STANLEY C. KORPAL JULIUS B. CHRISTMAN, JR. COMMITTEE GEORGE W. CARR A Communication was read from Dillon Geiger, M.D., of the Toll Road Commission, acknowledging receipt of a copy of the Resolution passed by the Common Council. Councilman Erler made a motion that the communication be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. Councilman Kroll seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred: "An Ordinance to rezone unplatted parcel of land at Main and Sherwood Streets, from "B" to "C" Commercial'; respectfully report that they have examined the matter and that in their opinion, it should be reported to the Council as favorable: Motion by Councilman Erler, seconded by Councilman Hahn, that the report be accepted and placed on file. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To "Ithe Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred: "An Ordinance to rezone lots 52 through 55 in Bimm and Moores Addition from "B" to "C" Commercial, respectfully report that they have examined the matter and that in their opinion, it should be reported to the Council as favorable. Motion by Councilman Tellson, and seconded by Councilman Muszynski, that the report be accepted and placed on file. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was.referred: "An Ordinance to regulate the production; transpor.tation,.process- ing;`handling, sampling; examination, grading, labeling, regrading and sale of Milk and Milk Products ", respectfully report that they have examined the matter and that in their opinion, it should be reported to the Council as favorable. Motion by Councilman Muszynski, seconded by Councilman Kroll, that the report be accepted and placed on file. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred: "An Ordinance authorizing the transfer and conveyance of vacant property on Northside Boulevard to Indiana University, " respectfully report that they have examined the matter, and that in their opinion, it should be reported to the Council as favorable. Motion by Councilman Erler, and seconded by Councilman Hahn, that the report be accepted and placed on file. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred: "An Ordinance appropriating from the General Fund $3,040.00 to Fire Department Q -73 (SE Fire Stationl.$1,000.00; to Board of Health W -11 Assistant Clerk $1,700.00; to office of City Judge E -363 Other Office Supplies (Law Books) $340.00, all of the Budget for the Civil City of South Bend, Indiana, for 1956 and declaring an extraordinary emergency " -- Motion by Councilman Korpal to amend the ordinance -- To Board of Health, W -11 Assistant Clerk $1,400.00 - -Total requested $2,740.00 from the General Fund. Motion seconded by Councilman Muszynski. Motion carried. Respectfully report that they have examined the matter and that in their opinion it should be reported to the Council as favorable. ORDINANCES, THIRD READING: ORDINANCE NO. 4094 AN ORDINANCE AMENDING ORDINANCE 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Main & Sherwood Streets -- Walz) The Ordinance was given third reading and passed by a roll call vote of 7 ayes, 2 nays (Councilmen Erler and Glass). ORDINANCE NO. 4095 AN ORDINANCE AMENDING ORDINANCE #3702 ADOPTED BY THE COMMON COUNCIL-ON THE 13th day OF JUNE, 1949. (Lots 52 - 55 Bimm & Moore's Add. - Morey) The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4096• AN, ORDINANCE ENTITLED AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION, PROCESSING, HANDLING, SAMPLING, EXAMINATION, GRADING, LABELING, REGRADING, AND SALE OF MILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, AND MILK PLANTS; THE ISSUING AND REVOCATION OF PERMITS TO MILK PRODUCERS, MILK HAULERS, AND DISTRIBUTORS; PERMIT FEES; APPOINTMENT OF INSPECTORS AND SANITARY POLICE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND FIXING PENALTIES. ORDINANCE NO. 4097 AN ORDINANCE AUTHORIZING THE TRANSFER AND CONVEYANCE OF VACANT PROPERTY ON NORTHSIDE BOULEVARD OWNED BY THE CITY OF SOUTH BEND FOR THE USE OF ITS PARK DEPARTMENT TO THE BOARD OF TRUSTEES OF INDIANA UNIVERSITY, IN ACCORDANCE WITH THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF IND. OF 1951, Chap 72 The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. ORDINANCE NO. 4098 AN ORDNANCE APPROPRIATING FROM THE GENERAL FUND $2,740.00 TO FIRE DEPARTMENT Q -73 (SE FIRE STATION) $1,000.00; TO BOARD OF HEALTH W -11 ASSISTANT CLERK $1,400.00; TO OFFICE OF CITY JUDGE E -363 OTHER OFFICE SUPPLIES (LAW BOOKS) $340.00, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR 1956 AND DECLARING AN EXTRAORDINARY EMERGENCY. The Ordinance was given third reading and passed by a roll call vote of 9 ayes, 0 nays. RESOLUTION A RESOLUTION DETERMINING TO COOPERATE WITH THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND IN THE DEVELOPMENT AND ADMINISTRATION OF A LOW -RENT HOUSING PROJECT ON A SITE COMMONLY KNOWN AS "MAGGIE'S COURT," APPROVING A FORM OF CONTRACT WITH THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA, WITH RESPECT THERETO, AND AUTHORIZING THE EXECUTION THEREOF Councilman Kroll made a motion to refer this resolution to a committee appointed by President Korpal to study the resolution and report back to the Council as soon as possible. Motion seconded by Councilman Glass. Motion carried. President Korpal appointed Councilmen Hahn and Carr to serve with him on a committee to study the resolution. Councilman Hahn requested that President Korpal appoint some other member to serve with the committee since he felt he was not able at this time to do so. Councilman Erler was then appointed by President Korpal. The Committee will study the resolution and report to the Common Council on June 11th, 1956. UNFINISHED BUSINESS Councilman Christman informed the President of the Council that he voted Aye in favor of the F. E. P. C. Ordinance with a reservation to bring the matter up again at the next council meeting, but that he now wished to vote Aye without reservation, making the vote unanimous. There being no further business before the Council, motion was made by Councilman Carr to Adjourn. Motion was seconded by Councilman Kroll. Motion carried and the meeting adjourned at 10:00 P.M.
