REGULAR MEETING MARCH 26th, 1956
The Common Council of the City of South Bend, Indiana, met in the Council Chamber on the 26th day of March, 1956,
at the hour of 8:27 P.M., C. D. S. T. (7:27 P.M., C.S.T.), in regular session in accordance with the rules of
the Council.
The Meeting was called to order by President Stanley C. Korpal, who presided.
Present: Councilmen Korpal, Carr, Tellson, Christman, Kroll,
Erler and Muszynski.
Absent: Councilmen Hahn and Glass.
REPORT OF COMMITTEE ON MINUTES:
To the Common Council of the City of South Bend, Indiana:
Your committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the-previous meeting of the Council and found them correct. They, therefore, recommend
that the same be approved.

10 inclusive of Chapin Place Addition between Forrest and Park Avenues are zoned "B" Residential and the,Sotith
half of lot 1 of said Chapin Park Addition which is also on the North side of LaMonte Terrace is zoned "A" Resi-
dential that consideration should be given to rezoning the South half of lot 1 from "A" to "B" Residential.
This home i2' admirably located and adaptable for use as a day nursery for pre - school age children for which
purpose it is now desired to use this property.
Accordingly petition is hereby made to have this property rezoned as "B" Residential.

REPORT OF ORDINANCE COMMITTEE
RE COMMENDED REPORT BY THE ORDINANCE COMMITTEE FOR THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA
In regard to the:.proposed ordinance amending the Building Code and establishing new fees for
building permits, the Ordinance Committee recommends the following amendments to the proposed
ordinance before consideration for adoption.
1. That paragraph 7 of Section 37a be stricken from the proposed ordinance.
2. That paragraph 8 be amended so that said paragraph shall read: "For altera-
tions and repairs not otherwise provided for, for roofing repairs, re- roofing,
for tanks, towers, platforms, stacks and other miscellaneous buildings and
structures not included in the preceding schedule and for which volumes cannot
be computed, the fee shall be two dollars ($2.00) for the first one thousand
($1,000) dollars of cost or fraction thereof, one dollar and fifty cents
($1.50) for each one thousand dollars ($1,000) of cost or fraction thereof
above one thousand dollars ($1,000) up to and including ten thousand dollars
($10,000), one dollar ($1.00) for each one thousand dollars ($1,000) of cost
or fraction thereof above ten thousand ($10,000) dollars up to and including
one hundred thousand dollars ($100,000), and fifty cents (0.50) for each one
thousand dollars ($1,000) of cost or fraction thereof above one hundred
thousand dollars ($100,000).
3.. That paragraph 13 of Section 37a be amended so that
for signboards shall be at the rate of one dollar
feet (250 sq. ft.) of area or fraction thereof.
This committee having made a study of the proposed ordinance
as-contained in this report, the ordinance is acceptable and
to all concerned.

REPORT OF THE COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole, to whom was referred "An Ordinance:Amending Ordinance No. 3702 commonly known
as "The Zoning Ordinance of the City of South Bend, Indiana"' Lots 7, 8, and the east 33 feet of lot 6 in
Herrick and Gran Addition as per petition of Charles H. Gerhardt, et al., respectfully report that they have
examined the matter , and that, in their opinion, the matter should be continued until April 23rd, 1956, at
which time public hearing will be had on same.
Motion by Councilman Kroll and Seconded by 'Councilman Carr, that the report be accepted and placed on file.
Motion carried.
ORDINANCE .
AN ORDINANCE. AMENDING ORDINANCE NO. 2243 COMMONLY KNOWN AS THE BUILDING
CODE OF THE CITY OF SOUTH BEND, INDIANA, AND MORE PARTICULARLY REPEALING
SECTION 37:a AND ANY AMENDMENTS THERETO, KNOWN AS THE SECTION ESTABLISHING
FEES FOR BUILDING PERMITS, AND ENACTING IN LIEU THEREOF A NEW SECTION 37a
ON THE SAME SUBJECT, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT.
The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion
that the Ordinance be set for public hearing on:. April 23rd, 1956. Seconded by Councilman Kroll. Motion
carried.
ORDINANCE
AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $1602.00 TO SEWER DEPARTMENT
J -726 OTHER EQUIPMENT $1602.00, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH
BEND, INDIANA, FOR 1956, AND DECLARING AN EXTRA - ORDINARY EMERGENCY.
The Ordinance wassgiven first reading by title and second reading in full. Councilman Kroll made a motion that
the Ordinance be set for public hearing on April 23rd, 1956. Councilman Muszynski seconded the motion. Motion
carried.

Dear Mayor Voorde:
March 23, 1956
A survey of conditions relative to vehicular delay caused by train operations was made on March 7th and
March 8, 1956 at the intersection of Sample and Olive Streets in South Bend, Indiana.
The survey was conducted for a 29 hour consecutive period between the hours of 11 A.M., and 12 midnight
on March 7th and between the hours of 12 midnight and 4 P.M., on March 8th.

During the 29 hour period 266 trains from the three railroad companies using this crossing and 10,430
motor vehicles entered the intersection from all directions.

The total train volume over the 29 hour period was as follows:
New York Central Railroad Company - 159 switch, 5 freight and 1
passenger train occupied the crossing for a total of 165 trains.
Grand Trunk Western Railroad - 47 switch, 31 freight and 8 passenger
trains occupied the crossing for a total of 86 trains.
New Jersey Railroad Company - 15 switch, 0 freight and 0 passenger
trains occupied the crossing for a total of 15 trains.
The total motor vehicle volume over the 29 hour period was as follows:

Of the 266 trains occupying the crossing over the survey period, 240 of the trains caused delay to
2450 motor vehicles. The maximum delay was 17 minutes, the average delay was 2 minutes. The number of persons
delayed, considering a car occupancy of 1.7 persons per car, was 4,165. With an average delay of 2 minutes,
4.8 man hours of delay occurred every hour at this crossing.
During the 29 hour period the crossing was actually blocked for 8 hours and 2 minutes due to train
opera :tions. In other words, the crossing was blocked 28% of the time.
A'tabulation of delay at the crossing by 30 minute intervals during the 29 hour period is shown on the
accompanying table which is self- explanatory. It is surprising to note, however, that in some instances the
crossing was blocked 707. of the time. Also, that more than 90% of the vehicles during one one -half hour period were
delayed,' due to train operations. On an average 247. of the vehicles passing through the intersection were delayed
during ach one -half hour period.

Councilman Erler made a motion that the Traffic Engineer be commended on the excellent statistical report. The
motion was seconddd':by Councilman Muszynski. Motion carried.
UNFINISHED BUSINESS:
A report from the Traffic Engineer, Ernest H. Miller, relative to South Shore rails, was read, which is as follows:
Board of Public Works and Safety
City of South Bend,, Indiana
Gentlemen: RE: Council Resolution adopted February 27, 1956,
requesting investigation of traffic condition
of South Shore rails and pavement on LaSalle
Street between Lincolnway West and Main Street.
A detailed study of traffic conditions on LaSalle Street between Lincoln Way West and Michigan Street and
in this area in general has been in progress since early January 1956. While no definite decisioh has been
reached at this time as to the general solution to the congestion and traffic accident problem, it is apparent
from the information gathered that some relief is possible, Corrective steps will be taken as soon as factual
information can be obtained to support the contemplated improvements.
One immediate step, however, will be to re -time signals on LaSalle Avenue at Lafayette and Main Streets, which
should result in some relief in congestion.during peak traffic periods.
At a meeting Thursday, March 22, 1956, with Mr. Frederick J. Corporon, Supt. of Ways and Structures and Mr.
D. E. Ferner, Supt. of Transportation for the South Shore Railroad, the matter of pavement condition under their
jurisdiction in connection with the South Shore tracks was discussed. They assured me, as they had Mr. Andrysiak,
City Engineer, several weeks ago, that they would start work on this matter as soon as the money could be
requisitioned, which should be the early part of April, 1956.

Mr. Smith, City Attorney, stated that the above report, which he read, was by no means a complete report. He said
that flasher lights would be considered and also something is going to be done on the hill below Michigan Street
on LaSalle Avenue. When the whole plan is ready, Mr. Miller feels that it will be a solution to the problem.
Motion by Councilman Kroll that the report be accepted and placed on file. Seconded by Councilman Muszynski.
Motion carried.

tickets for truck on Blvd. on W. Ewing Ave.
MARCH 20, 1956
Officers Martinczak & Knepper; Officer Knepper reports Altgeld Avenue quiet. No violations. Officer Martinczak
issued warning to speeder thirty -five in thirty. Otherwise very quiet.
March 19, 1956
Officers Martinczak and Knepper assigned. Martinczak issued ticket of forty -five in thirty on W. Ewing Avenue.
Officer Knepper reports E. Altgeld Avenue very quiet this day.

Motion carried.
There being no further business before the Council, Councilman Carr made a motion to adjourn. Councilman
Kroll seconded the motion. Motion carried. Meeting adjourned at 9:16 P.M.
