HomeMy WebLinkAbout03-12-56 Council Meeting MinutesREGULAR MEETING March 12, 1956 The Common Council of the City of South Bend, Indiana, met in the Council Chamber on the 12th day of March, 1956, at 8:15 P.M., (C.S.T.) in regular session in accordance with the rules of the Council. REPORT,OF COMMITTEE ON MINUTES: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have in- spected the minutes of the previous meeting of the Council and found them correct. They, therefore, recommend that the -same be approved. GEORGE W. CARR JULIUS B. CHRISTMAN, JR. COMMITTEE STANLEY C. KORPAL COMMUNICATION: An Invitation was read from the South Bend Civic Planning Association to attend an Open House commemorating their Twenty -fifth Anniversary. Ceremonies will be held at 8 P.M., March 21, 1956. Open House 2 to 4 P.M. Motion by Councilman Tellson that the communication be accepted and placed on file. Seconded by Councilman Kroll. Motion carried. PETITION.' Petition of Mr. -& Mrs. Jim Meerstan, et al, to rezone the West side of South Main Street from the 3200 block through the 3400,block from E -Heavy Industrial, F Height and Area District to B Residential and A Height and Area District, -v� Mr. Erler made a motion that the petition be referred to the City Plan Commission. Seconded by Councilman Muszynski. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole, to whom was referred "An Ordinance amending Ordinance Zoning 3702 Commonly known as the Zoning Ordinance of the City of South Bend, Indiana, (Lots 236, 237 and 238, D. M. Shiveley 1st Addition), respectfully report that they have examined the matter and that, in their opinion, this ordinance be reported to the Council as unfavorable. Motion by Councilman Erler that the report be accepted and placed on file. Seconded by Councilman Muszynski. Motion carried. ORDINANCE An Ordinance amending Ordinance Zoning 3702 Commonly known as the Zoning Ordinance of the City of South Bend, Indiana, (Lots 236, 237 and 238 D. M. Shiveley 1st Addition). The Ordinance was given third reading and lost by a roll call vote of 8 nays - 0 ayes, 1 absent (Councilman Hahn). REPORT OF CITY PLAN COMMISSION: Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: March 5, 1956 The attached petition of Charles W. Gerhardt, et al, to rezone the 22 lots East of William Street, on the South Side of Marion Street, was legally advertised under date of February 20, 1956. The public hearing was held under date of March 1, 1956, at which time the Commission took the following action: After due consideration, the Commission found that there is a need for additional office space for certain types of professional offices in the general central business area, and that a gradual expansion of said area is necessitated by population growth within the South Bend metropolitan area and to keep pace with an expanding economy. The Commission further found that the approval of the petition would result in the logical expansion of an existing commercial zoning district.. The Commission further found that a certain small and irregular parcel of land would remain in a residential zoning district. It was, therefore, moved, seconded, and carried that the petition be recommended favorably to the Common Council, and that the necessary steps be taken to initiate a petition to zone commercially said irregular land parcel. Seconded by Councilman Carr. Motion carried. REPORT OF CITY PLAN COMMISSION`: Honorable Common Council City of South Bend, South Bend, Indiana Gentlemen: t, The attached petition of Herman N. Light to zone 35 acres of East Jefferson Boulevard to "C -2" Shopping Center District, as returned to the Planning Commission by the Common Council on February 14, 1956, was considered by your Planning Commission on March 1, 1956, on which date the Commission in executive session, haveing reconsidered the petition, took the following action: RESOLVED, THAT the findings adopted by the Commission on January 19, 1956, and the favorable recommendation of the Commission to the Common Council be reaffirmed; that the action of the Council rejecting said petition be disapproved; and that a report of this action be filed with the Common Council. Discussion was then had upon the pending action against the Commissioner brought by Louis E. Mundell wherein it is claimed that on January 19, 1956, the Commission found that the area involved in the Light petition does not meet the requirements of the zoning ordinance. It was the consensus that the findings of the Commission show that said area does meet the requirements of the Zoning Ordinance, but to remove any doubt concerning the find- ings of the Commission it was on motion duly made, seconded, and unanimously carried: RESOLVED, that it was the finding of the Commission on January 19, 1956, and that it is now the finding of the Commission.that the area involved in the Light petition has an ac- ceptable relationship to improved major thoroughfares which possess an adequate cap- acity to carry the additional traffic generated by the commercial district. ORDINANCE N0, 4080 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (A part of the Wk of the NE'k, S8, T37N, R3E, now within and a part of South Bend, Indiana, Herman Light Petition) President Korpal asked for a roll call vote on the passage of the Ordinance. There were 4 ayes, Councilmen Korpal, Carr, Kroll and Muszynski; 4 nays, Councilmen Tellson, Christman, Glass and Erler. 1 Absent, Councilman Hahn. According to State Statute, a two- thirds (2/3) negative vote is required for failure to pass. Not having received the required two - thirds (2/3) negative vote, the Ordinance was duly passed. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA" (Gearhardt - -22 lots E. of William St. - -B. Side Marion St.). REGULAR MEETING MARCH 12th, 1956 The ordinance was given first reading by title and second reading in full. Councilman Christman made a motion that the ordinance be referrdd to the Committee of the Whole for public hearing on March 26th, 1956. Motion seconded by Councilman Muszynski. Motion carried. 5 MINUTE RECESS Motion by Councilman Kroll,Seconded by Councilman Muszynski UNFINISHED BUSINESS: Motion carried. The following report from the South Bend Police Department was read: SOUTH BEND POLICE DEPARTMENT - -- TRAFFIC BUREAU REPORT TO PUBLIC WORKS AND SAFETY Board: RE: TRUCKS ON WEST EWING AVENUE, AND ON EAST ALTGELD STREET. Four Traffic cars were assigned, on March 5, 1956, (Officers Plencner, Molenda, Knepper, Kwasneski, there were no violations and no speeding, or trucks in this area on this date, other than light panel delivery trucks, delivering to the homes on these streets. March 6, 1956. Three traffic cars were assigned to this area for a full day of surveliance, Day Officer reports traffic very light ( Altgeld) Nite Officers, (Klimczak, Knepper_ Traffic very light, Officer Knepper counted only twenty -three vehicles from nine P.M., to Nine -fifty P.M. March 7, 1956 Day Officer Kwasneski, Traffic very light, no speeders on Altgeld. Nite Officers Knepper, Klimczak, no violations, one offense, thiryy -five in thirty, Warning to Sylvia Kercher, 420 W'. Madison, City. Officer Gloyeski West Ewing Assignment reported: In regard to speeding, the street in bad condition and almost impossible to speed in this area. Issued one ticket for truck on Blvd. March j 8, 1956. No violations, traffic very light, all people in Altgeld area who approached officers knew of their surveliance, and stated that they hoped we could keep it up. March 9, 1956. Day and also night officers report that traffic was very light, no violations. end of report. To the Officers, the following information was given to continue their surveliance when not on other traffic assignments. /s/ J. Klaybor Lt. John Klaybor NEWt" BUSINESS : Councilman Tellson asked that an investigation be made of encroachments being made on the Bank of the St. Joseph River at Jefferson Street. He stated that private individuals are filling in and using the land for their personal use, Councilman Erler stated that it had always been one of his greatest desires to have the citizens care for the St. Joseph River and:-thus be able to�enjoy it as a natural source of beauty. Mr. Glass asked that a Citizens committee be appointed by Mayor Voorde to work some week -end, or at a specified time, to clean up the river. He suggested using the citizens who are willing to help, contractors with equipment, as well as the Police, Fire and Civil Defense Departments. *r. Irving J. Smith, City Attorney, advised the Council that Mayor Voorde had already formulated plans for cleanipg of the river and also had requested the Police Department to enforce the No Dumping Ordinance. Mr. Smith also stated that it was through the office of the Mayor and Mr. V oorde's insistance, that the Indiana & Michigan Electric Company Twin Branch, cooperated in the lowering of the river to aid in the search for the body of Mary Martin. Mr. Voorde has plans for beautifying the river.. OLD BUSINESS: Mr. Smith, City Attorney, reported that the Board of Works would like two more weeks to report on the LaSalle Ave., & Lincolnway West crossing of the South Shore Railroad, and the Ewing Avenue Traffic investigation. There being no further business before the Council, Councilman Muszynski made a motion to adjourn. Motion seconded by Councilman Erler. Motion carried. Meeting adjourned at 8:59 P.M. ATTEST: CLERK
