NOVEMBER 28TH, 1955
The Common Council of the City of South Bend, Indiana, met in the Council Chamber on the 28th day of November,
1955, at the hour of 8:42 P.M., in regular session in accordance with the rules of the Council.
The meeting was called to order by President, Walter C. Erler, Sr., who presided.

Clem Niezgodski, Cloyd Bestle, Walter Glass,
William Hahn and Chester Muszynski.
Councilman Michael Pinter.
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Councilman Muszynski moved that the report be accepted and placed on file. Councilman Korpal seconded the
motion. Motion carried.
'PETITION
Petition of Stanley R. Cope and Company, Inc. to rezone Lots 203, 204, 266 and 267 and 268 in D. M. Shively
Addition to the City of South Bend from "B" Use and "A" Height and Area Districts to "D" Use and "E" Height
and Area District.
Councilman Hahn moved that the petition be referred to the City Plan Commission. Councilman Korpal seconded
the motion. Motion carried.

REGULAR MEETING
REPORT OF THE COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
NOVEMBER 28TH, 1955
Your Committee of the Whole to whom was referred "An Ordinance transferring and appropriating certain funds in
the General Fund, Street and Traffic Fund, Firemen's Pension Fund and City Plan Fund, all of the budget for the
Civil City of South Bend, Indiana for 1955 and declaring an extraordinary emergency ".
Respectfully report that they have examined the matter and that in their opinion this ordinance be reported to
the Council as favorable.

Councilman Korpal moved that the report be accepted and placed on file. Councilman Glass seconded the motion.
Motion carried.
ORDINANCE NO. 4068
AN ORDINANCE TRANSFERRING AND APPROPRIATING
CERTAIN FUNDS IN THE GENERAL FUND, STREET AND
TRAFFIC FUND, FIREMEN'S PENSION FUND AND CITY
PLAN FUND, ALL OF THE BUDGET FOR THE CIVIL CITY
OF SOUTH BEND, INDIANA FOR 1955 AND DECLARING AN
EXTRAORDINARY EMERGENCY.
The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman
Pinter) .-.
ORDINANCE NO. 4069
AN ORDINANCE AUTHORIZING THE INSPECTOR OF THE DEPARTMENT
OF SUB- STANDARD BUILDINGS AND DWELLINGS OF THE CITY OF
SOUTH BEND TO REMOVE OR DEMOLISH A CERTAIN DWELLING KNOWN
AS NO. 229 -231 SOUTH CHAPIN STREET IN THE CITY OF SOUTH
BEND, INDIANA.
The ordinance was given first reading by title and second reading in full. Councilman Hahn moved that the
ordinance be set for public hearing on December 12th. Councilman Korpal seconded the motion.
Councilman.Hahn withdraws his motion, and Councilman Korpal withdraws his second to the motion.
Councilman Muszynski moved for suspension of rules. Councilman Niezgodski seconded the motion. Motion carried
by a roll call vote of 7 ayes - 0 nays - 1 absent `Councilman Pinter).
The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman
Pinter).
ORDINANCE
AN ORDINANCE AMENDING ORDINANCE NO. 2243 COMMONLY KNOWN AS THE
BUILDING CODE OF THE CITY OF SOUTH BEND, INDIANA, AND MORE
PARTICULARLY REPEALING SECTION 37-a AND ANY AMENDMENTS THERETO,
" KNOWN AS THE SECTION ESTABLISHING FEES FOR BUILDING PERMITS,
AND ENACTING IN LIEU THEREOF A NEW SECTION 37 -a ON THE SAME
SUBJECT, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT.
Councilman Korpal moved that the Ordinance Committee report at the next meeting on December 12th. Councilman
Hahn seconded the motion. Motion carried.
RESOLUTION
RESOLUTION AUTHORIZING CERTAIN PAYMENTS
TO BE MADE TO SALARIED CITY EMPLOYEES.
WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year, and
WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous
and complicated accounts; and,
WHEREAS, it is desirable that the work of said office be simplified when possible; now,
THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana;
SECTION 1. That all salaried officers and employees of the City shall be paid their salaries for month of
D b 1955 on the 20th day of said month.

SECTION 2. The Controller of the City of South Bend is hereby authorized to make said salary payments upon
said date.
SECTION 3. This Resolution shall be in full force and effect from and after its passage by the Common Council!:

The Resolution was adopted by a roll call vote of 7:1.ayes • 0 nays - 1 absent (Councilman Pinter).
There being no further business before the Council, Councilman Hahn moved to adjourn, which motion was seconded
by Councilman Niezgodski. Motion carried, and Council adjourned at 9 :15 P.M.
