(E.S.T.), in regular session in accordance with the rules of the Council. The meeting was called to order by President, Walter C. Erler, Sr., who presided. Present: Councilmen Walter C. Erler Sr., Stanley Korpal, Michael Pinter, Cloyd Bestle, Clem Niezgodski, Walter Glass, William Hahn and Chester Muszynski. Absent: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. RAHN ) Councilman Glass moved that the report be accepted and placed on file. Councilman Niezgodski seconded the motion. Motion carried. COMMUNICATION Mr. Walter Erler, President South tend City Council City Hall South Bend, Indiana Dear Mr. Erler: August 26, 1955 Enclosed herewith for your information is a copy of a Resolution in regard to the important community concern of governmental buildings and facilities. This Resolution was adopted by the Board of Directors of the Association of Commerce at their regular meeting August 26, 1955. All directors expressed a most lively intarest and fully recognized the tremendous importance' of -- -this matter. They also expressed a desire and"eagerness to be of assistance in such ways as they could offering the counsel and talents of business and industrial leaders who compose our membership to the public officials who will ultimately make the final decision. BRUNER President WH /nt ASSOCIATION OF COMMERCE R E S O L U T I O N IN THAT: The needs of municipal and county governmental units for improved offices "school administration, library and jail facilities and buildings are manifest and obvious; and, (Continued) REGULAR MEETING R E S O L U T I O N (Continued) SEPTEMBER 12TH, 1955 IN THAT: The "REPORT ON GOVERNMENT BUILDINGS SITE LOCATION FOR ST, JOSEPH COUNTY AND SOUTH BEND" represents a detailed, professional stAdy to which this subject of public interest is deserving and full and serious consideration should be given to both the advantages claimed for and the possible disadvantages of the proposed site; THEREFORE, BE IT RESOLVED: That the Board of Directors of the Association of Commerce reaffirm its position as expressed in a Resolution adopted February 25, 1955, which urges all governmental units and political sub - divisions to work with the utmost harmony to find the most feasible solution to this community problem utilizing to the greatest advantage the competent and professional guidance available, and enlisting the counsel and talents of business and industrial leaders. Furthermore, officials are strongly urged to refrain and desist from originating or starting any.separate projects until all proposals are throughly studied in detail and resolved: AND, BE IT FURTHER RESOLVED: That local governmental units and political sub - divisions be and are assured of the continued interest, cooperation and aid of the Association of Commerce as a community betterment organization working through its membership to effect the benefits desired by the community. Councilman Korpal moved that the communication and resolution be accepted and placed on file. Councilman Rahn seconded the motion. Motion carried. PETITION Petiti.on`of.Herman R. Larson, et al., for rezoning of Mishawaka Avenue on the north side of the street between Twenty- eighbh and Twenty -ninth Sts., from its present status to that of commercial in conformity with most of the other property in this vicinity facing Mishawaka Avenue. (Signed) Herman R. Larson, et al. Councilman Glass -made a motion that the petition be referred to the City Plan Commission. Councilman Bestle seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend': September 12th, 1955 Your Committee of the Whole to whom was referred "An Ordinance - appropriating from the General Fund $21,820.51 to Police Department P -11 Services Personal $10,131.15; to P -341 Clothing and Household $2,700.00; tp P -724 Motor Equipment $7,887.36 and to P -726 Other Equipment $1,102.00, all of the budget for the Civil City of South Bend, Indiana, for 1955 and declaring an extraordinary,emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. WILLIAM A. HAHN, Chairman Councilman Korpal moved that the report-be accepted. Councilman Niezgodski seconded the motion. Motion carried. REPORT OF CITT 4LAN COMMISSION Honorable Common Council of the City of South Bend South Bend, Indiana Gentlemen: September 8, 1955 Attached petition of Endre Vadas to zone lots numbered 199 20 and 21 in Lincoln Plaza Addition, located at the Northwest corner of Lincolnway West and Chicago Street, from "A" residential and "A" height and area district to "C" commercial and "C" height and area district was legally advertised on August 22nd, 1955 and given public hearing by your Planning Commission on September 1st, 1955. The Commission found that the granting of the petition would constitute spot- zoning inasmuch as it would allow uses on subject property which were denied to surrounding property and would further be an unwarranted intrusion into a residential area. It was therefore moved, seconded and carried that the petition be unfavorably rcommended to the Common Council. Your attention is respectfully drawn to remonstrance topetition bearing the signatures of approximately thirty property owners in the immediate vicinity of this property. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NUMBER 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Northwest corner of Lincolnway West and Chicago Street) The ordinance was given first reading by title and second reading in full. Councilman Pinter made a motion that the ordinance be referred for public hearing on September 26th. Councilman Niezgodski seconded the motion. Motion carried. REGULAR MEETING ORDINANCE AN ORDINANCE AMENDING ORDINANCE N0, 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Certificate of Occupancy) SEPTEMBER 12TH, 1955 The ordinance was given third reading and lost by a roll call vote of 3 ayes (Councilmen Erler,. Glass and Hahn) - 5 nays (Councilmen Korpal, Pinter, Best`la, Niezgodski and Muszynski). ORDINANCE NO. 4063 AN ORDINANCE AUTHORIZING THE SALE OF VACANT PROPERTY ON LINCOLNWAY EAST BELONGING TO THE WATER WORKS DEPART- MENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA. The - ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. - Councilman Glass seconded the motion. Motion carried by a roll call vote-of 8 ayes - 0.nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM CITY PLAN FUND 721 FURNITURE AND FIXTURES $230.00 TO CITY PLAN 212 POSTAGE $10.00, 36 OFFICE SUPPLIES $200.00 AND 55 SUBSCRIPTIONS AND DUES $20.00; FROM GENERAL FUND, BOARD OF PUBLIC NORKS, H -223 HEAT $1200.00 TO H -211 FREIGHT AND EXPRESS $50.00, H -214 TELEPHONE AND TELEGRAPH.$200.00, H -252 REPAIRS OF EQUIPMENT $300.00, H -263 LAUNDRY $50.00, H -36 OFFICE SUPPLIES $200.00 AND H -38 GENERAL SUPPLIES $400.60; AND FROM GENERAL FUND, FIRE DEPARTMENT Q -41 BUILDING MATERIALS $1000.00 TO Q -38 GENERAL SUPPLIES $1000.00 AND FROM Q -251 REPAIRS OF BUILDINGS AND STRUCTURES $500.00 TO Q -222 GAS $500.00, ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1955 AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Muszynski.made a motion that the ordinance be referred to the Committee of the Whole for public hearing on September 26th. Councilman Korpal seconded the motion. Motion carried. NEW BUSINESS Councilman Korpal made a motion that the City-Attorney check on the possibility of setting "load limits" on "C" classification streets, preventing semi - trailers from breaking up pavements. Councilman Muszynski seconded the motion. Motion carried. There being no further business before the Council, Councilman Bestle made a motion to adjourn, which motion was seconded by Councilman Niezgodski. Motion carried, and Council adjourned at 9 :45 P.M.
