REGULAR MEETING AUGUST 22ND, 1955
The Common Council of the City of South Bend, Indiana, met in the Council Chamber on the 22nd day of August,
1955, at the hour of 8:20 P.M. (E.S.T.), in regular session in accordance with the rules of the Council.
The meeting was called to order by President, Walter C. Erler, Sr., who presided.
Present: Councilmen Walter C. Erler Sr., Stanley Korpal,
Michael Pinter, Cloyd Bestle, Clem Niezgodski,
Walter Glass, William Hahn and Chester Muszynski.
Absent: None.
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Councilman Muszynski made a motion that the report go to the Council as favorable. Councilman Glass seconded
the motion. Motion carried.
PETITION
Petition of Herman N. Light to rezone 35 acres from "A" Residence District and "A" Height and Area District to
"C -2 " Planned Shopping Center District.
Councilman Niezgodski made a motion "that the petition be referred to the City Plan Commission. Councilman
Korpal seconded the motion. Motion carried.

Councilman Glass made a motion that the report be accepted and placed on file. Councilman Hahn seconded the

Your Committee of the Whole to whom was referred "An Ordinance transferring and appropriating from Street and
Traffic Fund Street Department S -724 Motor Equipment $12,000.00 to Street Department S -43 Materials (Street
and Alley) $12,000.00; from General Fund Sewer Department Services Contractual J -262 Repairs to Sewer Replace-
ment $2,250.00 to Office of Controller Service Contractual B -262 Other Contractual Services $2,250.00, all of
the budget for the Civil City of South Bend, Indiana for 1955 and declaring an extraordinary emergency".
Respectfully report that they have examined the matter and that in their opinion this ordinance be reported to
the Council as favorable.

ORDINANCE NO. 4059 (AS AMENDED)
AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM

MOTOR EQUIPMENT $12,000.00 TO STREET DEPARTMENT
S -43 MATERIALS (STREET AND ALLEY) $12,000.00; FROM

The ordinance, as amended, was given third reading and passed by a roll call vote of 8 ayes - 0 nays.
REPORT FROM ORDINANCE COMMITTEE FOR OCCUPANCY PERMIT
To the Common Council:
REPORT OF ORDINANCE COMMITTEE ON ORDINANCE
FOR OCCUPANCY PERMIT.
Permit for Occupancy is now a part of the Building Code for new construction.
This Ordinance requires that this be put into Zoning Ordinance as an amendment for better control, in case there
is a change in the use of the building. This would give better control. There is no fee involved in this
Permit.
This committee, therefore, recommends the adoption of this ordinance.

ORDINANCE
AN ORDINANCE AMENDING ORDINANCE NO. 3702
COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF SOUTH BEND, INDIANA.
(Occupancy Permit)
Councilman Niezgodski made a motion that the ordinance be held in the Council until September 12th. Councilman
Muszynski seconded the motion. Motion carried.
ORDINANCE
AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $21,820.51
TO POLICE DEPARTMENT P -11 SERVICES PERSONAL $10,131.15; TO
P -341 CLOTHING AND HOUSEHOLD $2,700.00 TO P -724 MOTOR EQUIPMENT
$7,887.36; AND TO P -726 OTHER EQUIPMENT $1,102.00, ALL OF THE
BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA FOR 1955 AND
DECLARING AN EXTRAORDINARY EMERGENCY.
The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that
the ordinance be referred to the Committee of the Whole for public hearing on September 12th. Councilman
Muszynski seconded the motion. Motion carried.
RESOLUTION
BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the contract heretofore entered
into by and between the Board of Public Works and Safety of the City of South Bend, Indiana, and the Mack Motor
Truck Corporation, for one (1) Type B -95 Mack 1000 G.P.M. Pumper for the contract price of $18,061.00, is
confirmed and approved.

Councilman Niezgodski made a motion for the adoption of the Resolution. Councilman Glass seconded the motion.
Motion carried by a roll call vote of 8 ayes - 0 nays.

REGULAR: - MEETING AUGUST 22ND, 1955
NEW BUSINESS
Councilman Muszynski made a motion that.the Board of Health take immediate steps to combat roaches-and bugs
at 229 and 231 So. Chapin St. Councilman Niezgodski seconded the motion. Motion carried.
Councilman Korpal made a motion to instruct the Street Department to grade alley at 1301 N. Wilbur St.
Councilman Muszynski seconded the motion. Motion carried.
Councilman Glass made a motion that the City Attorney check and determine what could be done about the rotating
flasher lights in various parts of the city. Councilman Muszynski seconded the motion. Motion carried.
There being.no further business before the Council, Councilman Muszynski made a motion to adjourn, which motion
was seconded' by Councilman Hahn. Motion carried, and Council adjourned at 9:37 P.M.
