Home My WebLink About05-09-55 Council Meeting Minutes0165 REGULAR MEETING COMMUNICATION R E S O L U T I O N MAY 9TH, 1955 WHEREAS: Discrimination is recognized nationally as a detriment to the public welfare, and the United States Supreme Court has taken the initiative in its decision on non- segregation in our public schools; and WHEREAS: We, of South Bend, are very grateful for the Brotherhood Award which has been awarded to our city for its work in furthering brotherhood. We are proud of this award, and we are desirous of making it a living document through the enactment of a Fair Employment Practices Ordinance that is now on the agenda of the City Council of South Bend for action. THEREFORE BE IT RESOLVED: That Bendix Local No. 9 officially go on record as supporting the proposed Fair Emplosment Practices Ordinance for the City of South Bend, Indiana; that BE IT FURTHER RESOLVED: That copies of this Resolution be sent to the Mayor of South Bend, to the Clerk and members of the South Bend City Council, to the St. Joseph County C I 0 Industrial Union Council, to the St. Joseph County Council of Churches, to the National Conference of Christians and Jews, to the St. Joseph County Ministerial Association, to the National Association for the Advancement of Colored People, to all labor-unions in the City, and to all Political Action and Fair Employment Practices Committees ..in' South Bend. Motion carried. PETITION 1 Petition of Mae Brugh, by her attorneys, Feeney and Stratigos, to rezone real estate commonly referred to as the "Oaks" (3222 E. Jefferson Blvd.) from "A -1" residential to "B? residential. Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Hahn seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: May 9th, 1955 Your Committee of the Whole to whom was referred "An Ordinance appropriating from the General Fund $7,936.53 to Police Department P -11 Services Personal - Salary of Patrolmen $7,936.53; all of the budget for the Civil City of South Bend, Indiana and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance be reported to the Council as favorable. W. A. HAHN, Chairman Councilman Glass made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF TRAFFIC ENGINEER April 22, 1955 Memorandum: Raymond S. Andrysiak Re: Western & Walnut intersection Council Resolution dated April 15th, 1955 I have checked the condition at Western and Walnut and it is my opinion that the arrangement and location of signals is not a prime factor in the difficulty. It is my belief that the sequence of operation and movement of traffic on certain phases of the signal cycle, plus the lack of visibility and human error is responsible for the majority of accidents at this location. Since this intersection is under the control of the State Highway Department I will contact them at an early date and see what can be worked out toimprove the condition. REPORT OF CITY PLAN COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gen t retnen: May 9, 1955 Returned herewith, without action, is the petition of the Taube Printing Company to rezone Lots numbered 40, 41 and 42 of Oakland Park. The Commission found the petition in defect under the provisions of Ordinance 3702, Sub- Section 23 (g) and (h). The Commission, therefore, recommends that the said petition be rejected. ORDINANCE NO. 4046 AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND $7,936.53 TO POLICE DEPARTMENT P -11 SERVICES PERSONAL- SALARY OF PATROLMEN $7,936.53; ALL OF THE BUDGET FOR THE CIVIL CITY OF SOUTH BEND, INDIANA AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Councilman Pinter). ORDINANCE NO. 4047 AN ORDINANCE APPROVING CONTRACTS BETWEEN SOUTH BEND BOARD.OF WATER WORKS COMMISSIONERS AND CONTRACTORS FOR LOCATION OF A WELL IN RUM VILLAGE PARK. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent (Councilman Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Councilman Pinter). ORDINANCE AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 3709, APPROVED JULY 12, 1949, COMMONLY KNO14M AS "MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, 1949" AND BEING SECTION CHAPTER , BEING AN ORDINANCE PROHIBITING DISCRIMINATION IN EMPLOYMENT BECAUSE OF RACE, COLOR, RELIGION, NATIONAL ORIGIN OR ANCESTRY BY EMPLOYERS, EMPLOYMENT AGENCIES, LABOR ORGANIZATIONS AND OTHERS, PROVIDING FOR THE CREATION OF THE SOUTH BEND FAIR EMPLOYMENT PRACTICE COMMISSION, PRESCRIBING ITS DUTIES AND POWERS, AND PROVIDING PENALTIES. The ordinance was given first reading by title only. Councilman Hahn made amotion that the ordinance be referred to a special committee for further study. Councilman Bestle seconded the motion. Motion carried by a roll call vote of 6 ayes (Councilmen Erler, Bestle, Niezgodski, Glass, Hahn and Muszynski) - 1 nay (Councilman Korpal) - 1 absent (Councilman Pinter). Councilman Muszynski made a motion that the full membership of the Council serve on the committee. Councilman Hahn seconded the motion. Motion carried. 3 MINUTE RECESS - 8:30 P.M. Councilman Niezgodski made a motion for a three minute recess. Councilman Bestle seconded the motion. Motion carried. RECONVENED MEETING - 8 :35 P.M. Councilman Muszynski made a motion that the ordinance be given second reading. Councilman Niezgodski seconded the motion. Motion carried, and the ordinance was given second reading. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on May 23rd. Councilman Korpal seconded the motion. Motion carried. 'r a ,... REGULAR MEETING ORDINANCE AN ORDINANCE AMENDING CHAPTER 30 OF ORDINANCE NO. 3709 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA PROHIBITING THE USE OF STREET CENTERS AS PLAYGROUNDS. MAY 9TH, 1955 The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Ordinance Committee; consisting of Councilmen Erler, Hahn and Korpal, to meet with the Park Board. Councilman Muszynski seconded the motion. Motion carried. Councilman Muszynski seconded the motion. Motion carried. ANNUAL REPORT OF THE CITY CONTROLLER There being no objections, the Annual Report of the City Controller was accepted and placed on file. UNFINISHED BUSINESS Councilman Hahn informed the Council that the committee on the proposed ordinance known as the "Planned Shopping Center District" will report to the Council on May 23rd. There being no further business before the Council, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Muszynski. Motion carried, and Council adjourned at 9:15 P.M.
