The members of the Council were shown to be present or absent as follows: Present: Councilmen Walter C. Erler Sr., Stanley Korpal, Michael Pinter, Cloyd Bestle) Clem Niezgodski, William Hahn and Chester Muszynski. Absent: Walter Glass. (Garage - private). Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to the Ordinance Committee for further study. W. A. The attached petition of Christian Gospel Assembly by Earl Broadwell, Trustee, and Pauline Broadwell, owners, to rezone Lots 112, 113, 114 and F of Second Addition to Riverdale in River Park, from A- Residence Use District and A- Height and Area District to B- Residence District and B- Height and Area, was advertised 26 October, '54, and given Public Hearing on 4 November '54. These lots are southwest of the intersection of Logan St. and the Grand Trunk Railroad right -of -way. The adoption of the Ordinance is recommended. Councilman�Hahn seconded the motion. Motion carried. ORDINANCE NO. 4021 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN_'AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (Southwest of the intersection of Logan St. and the Grand Trunk Railroad right -of- way). The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. Councilman Korpal seconded the motion. The presiding officer asked if there were any remarks or anyone in the audience who cared to be heard on this ordinance before the Council votes on this ordinance. There being no objections, motion was carried by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman Glass). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman Glass). REPORT OF CITY PLAN COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The petition of Paul and Mae Tuesley to rezone Lots 1, 2, 3, and 4 of Lincoln Terrace Addition from B -Use and A- Height and Area District to C- Commercial Use and A- Height and Area District, was legally advertised on date of 22 November, '54, a public hearing held thereon by the City Planning Commission under date of 2 December, '54. These lots located on the northwest corner of Kaley St. and Lincolnway West. The adoption of the ordinance relative thereto is not recommended for the following reasons, as transcribed from the 2 December meeting of your City Planning Commission: 1. "There now exists a 239.5 foot frontage on Lincoln Way West immediately to the East of subject property, separated only by Kaley Street, a street of 60 foot right -of -way and that this frontage is now zoned commercially and has been Vacant since its rezoning in November 13, 1951. 2. That the use of lands in the immediate area is predominantly residential use. 3. That the granting of petition would, in effect,be a continatuion of "strip zoning" along Lincoln Way West, which is against the best concepts of zoning for consolidated shopping districts with sufficient off - street parking. That there exists sufficient commercially zoned lands in the general neighborhood, and that rezoning of subject property would not be in the interest of the public's safety, convenience, and general welfare; and would, in fact, be detrimental to the property values and amenities of the neighborhood. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman Glass)._,-, ORDINANCE AN ORDINANCE REGULATING ALL MATTERS CONCERNING OR PERTAINING TO THE CONSTRUCTION, ALTERATION, REPAIRS AND ADDITIONS TO REMODELING, USE AND OCCUPANCY OF BUILDINGS OR THEIR PARTS AND STRUCTURES OF EVERY NATURE IN THE CITY OF SOUTH BEND, INDIANA: ADOPTING THE PROVISIONS OF THE BUILDING RULES AND REGULATIONS OF THE ADMINISTRATIVE BUILDING COUNCIL OF THE STATE OF INDIANA, PROVIDING FOR THE CONDEMNATION AND THE STOPPAGE OF THE USE OF INADEQUATE AND UNSAFE BUILDINGS, AND WRECKING OF THE SAME, CREATING A BUILDING DEPARTMENT AND PROVIDING OFFICERS AND ASSISTANTS, AND SPECIFYING THEIR DUTIES FOR THE ENFORCEMENT OF THIS ORDINANCE: CREATING A BOARD OF REVIEW, REPEALING ALL FORMER ORDINANCES CONFLICTING HEREWITH AND PROVIDING PENALTIES FOR VIOLATIONS. The ordinance was given first reading by title only. Councilman Korpal made a motion that the ordinance be held in the Councillor further study. Councilman Bestle seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF SIXTEEN YEARS IN PUBLIC STREETS AND OTHER PUBLIC PLACES BETWEEN CERTAIN HOURS; DEFINING DUTIES OF PARENTS AND OTHERS IN RELATIONSHIP THERETO; PROVIDING FOR ARREST AND PENALTIES AND REPEALING ORDINANCES IN CONFLICT THEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be referred to the Council for further study. Councilman Hahn seconded the motion. Motion carried. ucenr rrrrnM RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED CITY EMPLOYEES. WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year, and WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous and complicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified when possible; now, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana; SECTION 1. That all salaried officers and employees of the City shall be paid their salaries for month of December, 1954, on the 20th day of said month. SECTION 2. The Controller of the City of South Bend is hereby authorized to make said salary payments upon said date. SECTION 3. This Resolution shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. WALTER C. ERLER SR.
