The meeting was called to order by President, Walter C. Erler Sr., who presided. The members of the Council were s #own to be present or absent as follows: Present: -Councilmen Walter C. Erler Sr., Stanley Korpal, C1oyd Bestle, Clem Niezgodski, Walter Glass, William Hahn and Chester Muszynski. Absent: Councilman Michael Pinter. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: ' Your Committee on the inspedtion and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Bestle seconded the motion. Motion carried. PETITION Petition of Christian Gospel Assembly by by Earl Broadwell, Trustee, and Pauline L. Broadwell to rezone Lots No. 112, 113, 114 and F as shown on the recorded Plat of the Second Addition to River Dale in River Park from "A" residence use district and "A" height and area district to "B" residence use district and "B" height and area district. Councilman Hahn moved that the petition be referred to the City Plan Commission. Cou cilman Korpal seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE. To the Common Council of the City of South Bend: 4 Your Committee of _.the Whole to whom was referred "An Ordinance transferring and appropriating from S -261 Street and Traffic Fund N'- epiace Railing- Lincolnway East) $8,000.00 to S -12 Services Personal $4,000.00 and to S -43 Materials (Street and Alley) $4,000.00 and from T -726 Traffic Department (Other Equipment) $1,000.00 to T -43 Materials General $1,000.00, and from General Fund B -11 Services Personal (salary of Second Traffic Clerk) $174.00 to B -11 Services Personal (Salary of First Traffic Clerk) $174.00, all of the budget for the year 1954 of the Civil City of South Bend, Indiana, and declaring an emergency." Respectfully report that they have examined the matter and that in their opinion this ordinance be reported to the Council as favorable. W. A. REPORT OF CITY PLAN COMMISSION Honorable Common Council City of South Bend South Bend, Indiana Gentlemen: The petition of David and Patricia Rydzinski to rezone a parcel of land on the south-cast corner of Olive and Longley Streets from A- residential and C- height and area district was given public hearing by your Planning Commission on October 21, 1954. The petition is not recommended for the following reasons, as quoted from the last Minutes "This would constitute spot zoning, as the entire area is predominantly single family residential use, and that there is ample commercially zoned areas within a block of the subject property." REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: Your City Planning Commission has been unable to date to comply with Common Council resolution requesting the Planning Commission to make the necessary study and submit the recommendations relative to the adoption of legislation for off- street parking requirements. The Commission and the Commission staff are and have been working towards this recommendation and will report it out at the earliest possible date. In the meantime, Ordinance 3702, the Zoning Ordinance of South Bend, does not give the Board of Appeals explicit or implicit authority to grant off- street'parking lots as a transitional use between residential and commercial or industrial use in an area zoned residentially. Parking lots developed under certain restrictions and conditions imposed by the Board of Appeals offer a very good transitional use between the different areas.. The proposed Ordinance presented herewith will give the Board of Appeals the necessary authority to grant such uses. The Ordinance was legally advertised under date of September 28, 1954 and a public hearing was h6ld by your Planning Commission under date -,of October 21, 1954. (Off - Street Parking) The ordinance was given first reading by title and second reading in full. Councilman Muszynski moved for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 7 ayes (Council- men Erler, Korpal, Bestle, Niezgodski, Glass, Hahn and Muszynski) - 0 nays - 1 absent (Councilman Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes (Councilmen Erier, Korpal, Bestle, Niezgodski, Glass, Hahn and Muszynski) - 0 nays - 1 absent (Councilman Pinter). ORDINANCE AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM STREET AND TRAFFIC FUND $18,000.00 TO 251E REPAIRS OF BRIDGES $18,000.00; ALL?OF -THE BUDGET FOR 1954 OF THE CIVIL CITY OF SOUTH BEND, INDIANA AND DECLARING AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that the ordinance be referred to the Committee of the Whole for public hearing on November 8th. Councilman Muszynski seconded the motion. Motion carried. NEW BUSINESS Councilman Niezgodski moved that the Streets and Alleys Committee, including Councilman Niezgodski as chairman, study a method for property ownerswhosecurbs are broken down at alley intersections by heavy trucks. Councilman Korpal seconded the motion. Motion carried. 0 There being no further business before the Council, Councilman Muszynski moved to adjourn, which motion was seconded by Councilman Hahn.
