Home My WebLink About09-27-54 Council Meeting MinutesREGULAR MEETING SEPTEMBER 27TH, 1954 The Common Council of the City of South Bend, Indiana, met in the Council Chamber on the 27th day of September, 19540 at the hour of 8:25 P.M. in regular session in accordance with the rules of the Council. The meeting was called to order by President, Walter C. Erler Sr., who presided. The members of the Council were shoarn to be present or absent as follows: Presents Councilman Walter C. Erler Sr., Stanley Korpal, Michael Pinter, C1oyd Bestle, Clem Niezgodski, Walter Glass, William Icahn and Chester Muszynski. Absent: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Your Committee of the 'Whole to whom was referred "An Amended Ordinance amending Ordinance No. 3702 commonly known as the Zoning Ordinance of the City of South Bend, Indiana." (Side Yard). Respectfully rep, rt that they have examined the matter and that in their opinion this ordinance be held up for further study. W. A. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Amended Ordinance Amending Ordinance No. 3702 commonly known as the Zoning Ordinance of the City of Sout# Bend, Indiana•" ( Garage- private). Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to the City Plan Commission for public hearing. W. A. REGULAR-MEETING SEPTEMBER 27TH, 1954 REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: On the amended Ordinance pertaining to side yards, the first -line of paragraph three (3) should be amended, before third reading, by the addition of the following: "and recorded after the adoption of this Ordinance." Huff, Secretary Councilman Glass moved that the Side Yard Ordinance be referred to committee consisting of Councilmen Hahn, chairman; Glass, Bestle and Muszynski, and that committee meet with City Plan Commission on October 21st to study this ordinance. Councilman Korpal seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Common Council - City of South Bend South Bend, Indiana Gent lemon: The petition of the Lock Joint Tube Company, 1400 Riverside Drive to rezone 19 acres now under their ownership from B Use and B Height and Area District to D Tight Industrial and F Height and Area District vacs legally advertised, ..under date of August 23, 1954 and given public hearing under date of September 2, 1954• It is recommended that the petition be granted on the following basis: "D Light Industrial and D Height and Area, thus assuring a setback along Riverside Drive. REGULAR MEETING ORDINANCE SEPTEMBER 27TH9 1954 AN ORDINANCE TRANSFERRING AND APPROPRIATING FROM SANITATION DEPARTMENT SERVICES PERSONAL XX -12 02462.00 TO BUILDING DEPARTMENT MB -11 SALARY OF BUILDING COMMISSIONER $1839.00 AND TO SALARY OF FIRST ASSISTANT BUILDING COMMISSIONER 1623.00; FROM SANITATION DEPARTMENT XX -12 SERVICES PERSONAL $29000.00 TO XX 38 GENERAL SUPPLIES 129000.00; ALL OF THE BUDGET FOR 1954 OF THE CIVIL CITY OF SOUTH BEND, INDIANA AND DECLARING AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Glass moved that the ordinance be referred to the Committee of the Whole for public hearing on October 11th. Councilman Korpal seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING SECTION 4 OF CHAPTER 26 OF ORs1DINANCE 3709 TO PROVIDE FOR THE RATES OF FARE FOR TAXICABS. The ordinance was given first reading by title and second reading in fall. Councilman Korpal moved that the ordinance be set for public hearing on October 11th. Councilman Muszynski seconded the motion. Motion carried* Councilman. Niezgodski moved that the City Attorney make a study of the ordinance with reference to a light on the meter in order for passengers to see it and report back to the next meeting on October 11th• (Councilman Hahn seconded the motion. Motion carried. ORIE NANCE AN ORDINANCE PROHIBITING POSSESSION, DISPLAY OR USE OF ALCOHOLIC BEVERAGES IN CERTAIN PUBLIC PLACES AND PROVIIDING PENALTIES FOR VIOLATIONS. The ordinance was given first reading by title and second reading in full. :Councilman Muszynski moved for suspension of rules. Councilman Hahn seconded the motion. Motion lost by a roll call vote of 6 ayes (Councilmen Elder, Pinter, Bestle, Glass, Hahn and Muszynski) - 1'�Not Voting (Councilman Korpal) - 1 nay (Councilman Niezgodski). Councilman Glass moved that the ordinance be set for public hearing on October 11th. Councilman Bestle seconded the motion. Motion carried. NEW BUSINESS Councilman Korpal moved that the Traffic and Transportation Committee make a study for widening Western Avenue from Maple to "Jacob Streets and' take the matter up with the Board of Works. Councilman Niezgodski seconded the motion. Motion carried. UNFINISHED BUSINESS Councilman Korpal moved that a meeting be called next Monday night, October 4th, for the purpose of inviting heads f v of various student groups and officers oarious youth clubs to attend this meeting on the question of "curfew". Councilman Hahn seconded the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to ._adjourn, which motion was seconded by Councilman Muszynski.
