Home My WebLink About08-22-54 Council Meeting MinutesREGULA..R MEETING AUGUST 23RD, 1954 The Common Council of the City of South Bend, Indiana, met in the Council Chambers on the 23rd day of August, 1954, at the hour of 8:00 P.M. in regular session in accordinance with the rules of the Council. The meeting was called to order by the President, Walter C. Erler Sr., who presided. The members of the Council were shown to be present or absent as follows: Present: Councilman Walter C. Erler Sr,, Stan-163r Korpal, Michael Pinter, Cloyd Bestle, Clem Niezgodski, Walter Glass, William A. Hahn and Chester Muszynski. Absent: None. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting -qf August 9, 1954. WALTER C. ERLER SR. ) STANLEY C. KOPPAL ) Committee W. A. HAHN ) Councilman Niezgodski moved that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. PETITION Petition of Bernard E. Vodnoy and Daniel Robert Lindborg to rezone a tract of land 90 feet in length east and west taken off of and from the entire east end of the south one -half of Lot 16 as shown on the recorded plat of J. Co Bartlett's first Addition to the City of South Bend, from "C" 1 Commercial and "C" Height and Area District to "F" Height and Area District. Councilman Glass moved that the petition be referred to the City Plan Commission. Councilman. Hahn seconded the motion* Motion carried. PETITION Petition of David T. Rydzinski and Patricia Ann Rydzinski to r econe the following described real estate: Beginning on the East line of Olive Street, in the City of South Bend at a point 40 feet North of the intersection of the East line of said Olive Street, as now established (which street is 50 feet wide), and the South line of Lot Numbered 11 as shown on the recorded Plat of Kundtman and Meyers Addition to the City of South Bend; thence running North on the East line of Olive Street, 86.18 feet, T ore or less, to the South line of Longley Avenue in said City; thence East along the South line of Longley Avenue a distance of 135 feet; thence South on a line parallel with the East line of Olive Street, 85.25 feet; thence West to the place of beginnings from "Residential to Commercial." Councilman Korpal moved that the petition be referred to the City Plan Commission. Councilman Niezgodski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana August 6, 1954 Gentlemen: The attached petition of F. H. Frisbie, et al, to rezone Lots 1, 2 and 3 of Riversale 1st Addition from B Residence District to C Commercial and D height and area districts was given legal notice under date of June 21st and public hewing by the Planning Commission under date of July 1, 1954. These lots located southwest corner Mishawaka and 36th Streets. It is recommended that this petition be denied for the following reasons: 1. The granting of petition would be an intrusion into a residential distri et. 2. It would tend to promote strip zoning along Mishawaka Avenue as opposed to consolidated shopping districts. 39 85% of the frontage on Mishawaka Avenue between Ironwood Drive and 34th Street is now zoned for commercial use; therefore, there is no justifiable need for additional Commercial use to serve the immediate community. REGULAR MEETING REPORT OF CITY PLAN COMMISSION August 23, 1954 Common Council City of South Bend South Bend, Indiana Gentlemen: AUGUST 23RD, 1954 Resubmitted herewith after further consideration by the Planning Commission is an ordinance providing for side yard,- and setback regulations, as an amendment to the zoning ordinance. Many suggestions of the Committee of the Whole have been incorporated in this proposal. Favorable action is re commended. Very truly yours, CITY PLANNING COMMISSION (Signed) Robert L. Councilman Korpal moved that this Ordinance be referred to the same Committee who previously studied it, namely, Councilmen Hahn, Bestle, Glass, Muszynski and Korpal, to report back to the Council on September 13, 1954. REPORT,OF CITY PLAN COMMISSION Common Council City of South Bend South Bend,.Indiana Gentlemen: Presented herewith is an ordinance to zone the land now owned and occupied by the Northern Indiana Children's Hospital, which land was recently annexed to the City of South Bend, to "A" Residence District and_ "A" Height and Area District. This ordinance was legally advertised as required under date of August 9, 1954, and public hearing held under date of August 19t, 19540 Favorable action on this ordinance is respectfully recommended. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE NO. 4001 AN ORDINANCE AMEDTDING ORDINANCE N0. 3702 COMMONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA." (Northern Indiana Children's Hospital) The ordinance was given first reading by title and second reading in full. Councilman Glass moved for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote as follows: AYES: Councilmen Walter C. Erler Sr., Stanley Korpal, Michael "Pinter, Cloyd Bestlg, Clem Niezgodski, Walter Glass, William A. Hahn and Chester Muszynski. NAYS: None. The ordinance was given third reading and passed by a roll call vote as follows: ORDINANCE AYES: Councilmen Walter C. Erler Sr., Stanley Korpal, Michael Pinter, Cloyd Bestle, Clem Niezgodski, Walter Glass, William A. Hahn and Chester Muszynski. NAYS: None. Councilman Niezgodski moved that the Ordinance be referred to the Committee of the Whole for Public Hearing on September 13, 1954. Councilman Bestle seconded the motion. Motion carried. REGULAR MEETING NET BUSINESS AUGUST 23RD, 1954 Councilman Korpal moved that the Council ask Traffic Engineer Ernest J. Miller to attend the next regular meeting of the Council (September 13, 1954) to give the Council information as to why there is no traffic light at the cornerof Arnold Street and Western Avenue. Councilman Muszynski seconded the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was seconded by Councilman Muszynski. Motion carried and Council adjourned at 8:40 P.M.
