COMMITTEE OF THE NHOLE MEETING
AUGUST 9th, 1954
Be it remembered that the Common Council of the City of South Bend, IncE ana met in theCommittee of the Whole
Meeting in the Council Chamber on Monday, August 9th, 1954 at 8:10 P.R. with all the members present. Councilman
Hahn presided.
ORDINANCE NUMBER 3992
AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
APPROPRIATING THE SUM OF ONE MILLION DOLLARS
($1,000,000.00) TO BE APPLIED ON THE COST OF
CONSTRUCTION, REDONSTRUCTION AND IMPROVEMENT OF
STREETS, AND EXPENSES INCURRED IN CONNECTION
THEREWITH.
Councilman Korpal made a motion that Section 1 on page two after the word 'streets" in Line 6 be amended to add:
"The program to include -these minimums:
1. The resurfacing and improvement of Olive Street from Lincolnway West to
Sample Street.
2. The aresyrfacmng of Miami Street from Ridgedale to Ireland Road.
3. The resurfacing of Jefferson Street from 26th to Logan Street.
4. The resurfacing of portions of Portage Avenue.
5. The resurfacing of portions of Mishawaka Avenue.
6. The resurfacing and improvement of Eddy Street. -
7. The resurfacing of Sample Street from Grant Street to Olive Street.
8. The engineering estimates on the widening and resurfacing of La Porte Avenue.
C-ounoilman Mus*iiaki seconded the motion. Motion Amending'-0rdinance was carried.
Councilman. Niezgodski moved that the Ordinance as Amended be approved and that the -AmendedYOrdinance go to the
Council -as favorable. Councilman Muszynski seconded the motion. Motion carried.
There being no further business, Councilman Korpal made a motion to adjourn, which motion was seconded by
Councilman Bestle. Motion carried, and Council in Committee of the Whole adjourned at 9:12 P.M.

REPORT OF C0119MITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on' the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They t herQfore recommend
that the same be approved.

Councilman Korpal made a motion that the report be approved and placed on file. Councilman Glass seconded the
motion. Motion carried.
COMMUNICATIONS
A communication in form of a petition was received from Bertha Krueger, et al., asking for removal of junkyard
at southeast corner of Sample and Fellow Streets.
Councilman Hahn made a motion that the communication be referred to the Board of Public Works. Councilman Glass
seconded the motion. Motion carried.
PETITION
Petition to rezone the following described real estate situate in the City of South Bend, St. Joseph County,
State of Indiana, to-wit:
Beginning at the Northeast corner of the South Half of the Southwest
Quarter of Section 35, Township 38 North, Range 2 East in St. Joseph
County, Indiana; thence South 492 feet; thence West 176 feet; thence South 830 feet
to the South line of said section; thence East to the St. Joseph River;
thence downstream along the edge of the river to a point due East of the
point of beginning; thence West to the place of beginning.
from "A" Residential and "A" Height and Area District excepting South 322 feet of said real estate which was zoned
"I;" Light Industrial Diistrictq all to "D" Light Industrial and "F" height and Area District.

REGULAR MEETING
PETITION
AUGUST 9th, 1954
Petition to rezone lots 24 and 25 of Belleville First unit, which lots are located facing on Falcon Street
and extending East and West immediately South of the first alley South of Western Avenue in the City of
South Bend, St. Joseph County, Indiana. from "B" Residence and Height and Area to "C" Commercial and
Height and Area District.

Councilman Niezgodski made a motion that the petition be referred to the City Plan Commission. Councilman
Korpal seconded the motion. Motion carried.
REPORT OF COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole to whom was referred "An Ordinance of: the 'City of South Bend, Indiana,
Appropriating the Sum of One Million Dollars ($1,000,000.00) to be Applied on the Cost of Construction,
Reconstruction and Improvement of Streets, and Expenses Incurred in Connection Therewith, respectfully
report that they have examined the matter and that in their opinion, Section 1, page 2 of the ordinance
following the phrase, "Reconstruction and Improvement of streets" be amended by adding: "The Program to
include these .minimums:

seconded the motion. Motion carried.

Councilman Muszynpki made a motion to accept the amendment to the ordinance. Councilman. Hahn seconded the
motion. Motion carried by a roll call vote of 8 ayes and b nays.
The ordinance, as amended, was given third reading and passed by a roll call vote of 8 ayes and 0 nays.

Gentlemen:
The attached petition of H.F. Taylor, et al., to rezone lots 36 and 37 of Bartlett's 2nd Addition
from "C" Height and area to "F" Height and area was given legal advertising under date of July 26th and
public hearing by the Planning Commission under date of August 5, 1954. Lots 36 and 37 are 5 lots north of
the intersection of Bartlett Street and Michigan Street on the west Bide of Michigan Street.
It is recommended that this petition be granted as petitioned for.

OF SOUTH BEND, INDIANA.
This ordinance was given first reading by title and second reading in full. Councilman Glass made a motion
of suspension of the rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of
8 ayes and 0 nays.
The ordinance was given third reading and passed by a roll call vote of 8 ayes and 0 nays.

AUGUST 6th, 1954
The petition of Harold E. Grise for change of zoning of Lot 16, Samuel L. Cottrell's 3rd Addition from
"C" Commercial to "B" Residence and "B" Height and Area was given legal notice dnder date of July 26, 1954,
and public hearing.under date of August 5, 1954. This lot is located on the east side of 600 block of Hill
Street.
It is recommended by the City Planning Commission that this petitaon be granted.

The attached petition of Jerry Claeys, Jr., for change of zoning of Lot No. 57 Jefferson Heights
Addition from A. Residence was given public hearing under date of August 5, 1954, and legal notice under date of
July 26, 1954. Su#ject property is located on the east side of Ironwood Drive at Colfax Avenue projected.
It- isy'.reeommended that this petition be denied as the entire area surrounding subject area is now
zoned single family residential and is fast developing in this manner. Petitioners did not show the need of
B residential use in the area.

NUMBER 3913 (AS AMENDED) PROVIDING ADDITIONAL
POWERS AND DUTIES OF THE ELECTRICAL EXAMINING
BOARD.
The ordinance was given third reading and passed by a roll call vote of 5 ayes and 3 nays.
There being no further business before the Council, Councilman Niezgodski made a motion to adjourn, which motion
was seconded by Councilman Glass. Motion Carried, and Council adjourned at 9 :45 P.M.
