HomeMy WebLinkAbout07-26-54 Council Meeting MinutesREGULAR ?MEETING JULY 26TH, 1954 Be it remembered that the Common Council of the City of South Bend met in regular session in the Council Chamber, Monday, July 26th, 1954, at 8:05 P.M., with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. -They therefore recommend that the same be approved. COMMUNICATION Communication from the League of Women Voters of South Bend that some one office be equipped and delegated to duplicate, mimeograph or print in an economical way such letters, ordinances and other documents as are necessary for the information of the civil city and interested groups and people. Councilman Korpal made a motion that the communication be accepted* Councilman Hahn seconded the motion. Motion carried. COMMUNICATION Communication from South Bend Civic Planning. Association, Inc. regarding $1,000,000.00 bond issue. Councilman Hahn made a motion that the communication be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION Communication from residents of Lagoon Court and Joyce Drive relative to parking in that vicinity. Councilman Niezgodski made a motion that the communication be referred to the Board of Public Works. Councilman Bestle seconded the motion. Motion carried. PETITION Petition of Harold E. Grise to rezone Lot No. 16 in Samuel L. Cottrell's Third Addition from "C" Commercial to "B" Residential and "B" Height and rea. District. Councilman Hahn made a motion that the petition be referred to the City Plan Commission, Councilman Glass seconded the motion. Motion carried. PETITION �. Petition of Jerry Claeys Jr. to rezone Lot No. 57 as shown on the Recorded Plat of Jefferson Heights Addition from "A" Residential to "B" Residential. Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Muszynski seconded the - 'motion. Motion carried. PETITION Petition of the South Bend Columbus Club, Inc. to rezone Lot Nos. 36 and 37 as shown on the Recorded Plat of J. G. Bartlett's Second Addition to "F" Height and Area District. Councilman. Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Niezgodski seconded the motion. Motion carried. Councilman Bestle seconded the motion. Motion carried. ORDINANCE N0. 3993 ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA. (Northern Indiana Crippled Children's Hospital) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE N0. 3994 (AS AMENDED) AN ORDINANCE CONCERNING DEALERS IN SCRAP OR JUNK MATERIALS, AND PROVIDING FOR THE LICENSING AND REGULATION THEREOF; PENALTIES FOR VIOLATIONS AND REPEALING ALL ORDINANCES IN CONFLICT. Councilman Niezgodski made a motion that the ordinance be amended by adding the following to Article III, Section 1, paragraph (g) : "in such reasonable manner as to create the least possible detriment and annoyance to occupants of adjoini;zg properties." Councilman Hahn seconded the motion. -Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given thud reading and passed by a roll call vote of 8 ayes - 0 nays. REGULAR MEETING JULY 26TH, 1954 ORDINANCE NO. 3995 AN ORDINANCE PROVIDING FOR A CHANGE IN NAME OF A PART OF VARSITY DRIVE AND HOLIDAY DRIVE IN THE CITY OF SOUTH BEND, INIKANA. (SWANSON CIRCLE) The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3996 AN ORDINANCE APPROVING THE CONTRACT BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE SISTERS OF THE HOLY CROSS, INC., NOTRE DAME, INDIANA, FOR FURNISHING SEWAGE TREATMENT SERVICE. The ordinance was -given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3997 AN ORDINANCE APPROVING THE CONTRACT BETWEEN THE CITY OF SOUTH BEND, INDIANA., AND THE UNIVERSITY OF NOTRE DAME DU LAC, AN INDIAN& CORPORATION, NOTRE DAME, INDIANA, FOR FURNISHING SEWAGE TREATMENT SERVICE. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN AMENDED ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNO17N AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Two Side Yards) Councilman Niezgodski made a motion that the ordinance be given third reading. Councilman Muszynski seconded the motion. Motion Todtby a roll call vote of 1 aye (Eyler) - 7 nays (Korpal, Pinter, Best le, Niezgodski, Glass, Hahn,and Muszynski). g; ORDINANCE AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE 3913 (AS AMENDED) PROVIDING ADDITIONAL POWERS AND DUTIES OF ELECTRICAL EXAMINING BOARD. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be held up until August 9th. Councilman Hahn seconded the motion. Motion carried. ORDDINANCE AN ORDINANCE-AMENDING SECTION 11 OF ORDINANCE N0. 3324 (AS AMENDED) KNOWN AS THE MILK ORDINANCE FOR THE CITY OF SOUTH BEND, INDDIANA BY THE ADDITION OF A PROVISION FOR INSPECTION OF DAIRY FARMS AND MILK PRODUCTION PLANTS BEYOND THE LIMITS OF ROUTINE INSPECTION OF THE BOARD OF HEALTH OF SOUTH BEND. Councilman Glass made a motion that the ordinance be held up until August 9th and the City Attorney contact the City of Rochester relative to this ordinance. Councilman Muszynski seconded the motion. Councilman Muszynski withdraws second to the motion. Councilman Niezgodski made a motion for roll call vote on the ordinance. Councilman Hahn seconded the motion. Motion lost b roll call vote of 2 ayes ( Erler and Hahn) - 6 nays (Korpal, Pinter, Bestle, Niezgodski, Glass and Muszynski�._ UNFINISHED BUSINESS Report received from Traffic Engineer Ernest Miller explaining the reason for routing U.S. 20 traffic on East LaSalle Ave. Councilman Muszynski made a motion that the report be accepted and placed on file. Councilman Korpal seconded the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was seconded by Councilman Muszynski.
