HomeMy WebLinkAbout07-12-54 Council Meeting MinutesREGULAR MEETING DULY 12TH, 1954 Be it remembered that the Common Council, of the City of South Bend met in regular session in the Council Chamber, Monday, July 12th, 1954, at 8:00 P.M., with all members present except 'Councilman Pinter. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of June 28th, 1954. WALTER C. ERLER SR. ) W. A. HAHN ) Committee STANLEY C. KORPAL ) Councilman Niezgodski made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. COMMUNICATION Communication received from H. S. Cover protesting against the use of W. Chippem Ave. by the Soap Box Derby organi zation. Councilman Hahn made a motion that the communication be referred to the Board of Public Works, Councilman Niezgodski seconded the motion. Motion carried, PETITION Petition of Ruth M. Welsheimer to rezone Lot No. 3 as shown on the recorded Plat of Burroughs Sub - division of Bank Out lot of No. 115, et al. Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlmen: A communication has been received co- signed by Mr. Wilbur Young, Superintendent, State Department of Public ` In.struotioil, end Mr. R• H: Rayburn, Director, Special Education, recommending that the City of South Bend annex the Northern Indiana. Children's Hospital, which area is bounded by Eddy Street, Angela Boulevard, Notre Dame Avenue, and the City Limits lying north of Napoleon Street. Should the City annex the balance of the grounds, it would enable the City: - School system to accept transfer of children from other school corporations and to extend their special education program to the Children's Hospital. The communication was sent to the Commission as one agency to initiate and do the necessary paper work involved in the annexation procedure, it being difficult and time consuming for the State of Indiana as such to do so. ORDINANCE ORDINANCE ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDTANA. (Northern Indiana Crippled Children's Hospital) The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Glass seconded the motion. Councilman Muszynski withdraws motion for suspension of rules. Councilman Glass withdraws second to the motion. Councilman Glass made a motion that the ordinance be held up for two weeks and that a representative of the School Board be notified to attend this meeting. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: Attached petition of Mary J. Droege., et al to rezone Lot 6 and part of Lot 5, Rockefeller's 1st Addition from B Residence and B Height and Area to C Commercial and C Height and Area Districts was legally advertised under date of June 21, 1954 and given public hearing under date of July 1, 1954. Councilman Korpal seconded the motion. Motion REGULAR MEETING ORDINANCE N0. 3991 AN ORDINANCE AMENNNG ORDINANCE 3702 OF THE CITY OF SOUTH BEND, INDIANA. (Northeast corner of Elm & Washington) JULY 12TH, 1954 The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 1 absent ('Councilman Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Councilman Pinter). ORDINANCE AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($1,000,000.00) TO BE APPLIED ON THE COST OF CONSTRUCTION, RECONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the ordinance be set for public hearing on August 9th. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE' AN ORDINANCE AMENDING SECTION 11 OF ORDINANCE N0. 3324 (AS AMENDED) KNOWN AS THE MILK ORDINANCE FOR THE CITY OF SOUTH BEND, INDIANA BY THE ADDITION OF A PROVISION FOR INSPECTION OF DAIRY FARMS AND MILK PFDDUCTION PLANTS BEYOND THE LIMITS OF ROUTINE INSPECTION OF THE BOARD OF HEALTH OF SOUTH BEND. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be help up until July 26th. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN AMENDED ORDINANCE AMENDING ORXNANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Two Side Yards) Councilman Korpal made a motion that the ordinance be held up until July 26th. Councilman Hahn seconded the motion. Motion carried. ORDI NCE �e AN ORDINANCE CONCERNING DEALERS IN SCRAP OR JUNK MATERIALS, AND PROVIDING FOR THE LICENSING AND REGULATION THEREOF; PENALTIES FOR VIOLATIONS AND REPEALING ALL ORDINANCES IN CONFLICT. Councilman Niezgodski made a motion that the ordinance be held up until July 26th. Councilman Muszynski seconded the motion. Motion carried. NEW BUSINESS Councilman Glass made a motion that the City Attorney prepare an ordinance requiring that all fuel oil trucks be metered so that the customer can receive a statement of the quantity of oil delivered at the time of delivery. Councilman Niezgodski seconded the motion. Motion carried. Councilman Korpal made a motion that a resolution be sent to the State Highway Commission requesting the Commission to widen the Colfax Avenue bridge as a part of the current repair project. Councilman Hahn seconded the motion. Motion carried. Councilman Niezgodski made a motion that the Traffic Engineer appear at the next meeting of the Council on July 26th to explain the reason for routing traffic on E. LaSalle Ave. Councilman Korpal,seconded the motion. Motion carried. There being no further business before the Council, Councilman.
