President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council. of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. RE GULAR MEET IN G R E S O L U T I O N AREAS, God in His infinite wisdom, has seen fit to take from this life our colleague, Percy Alford, Councilman -at- Large. NOW, THEREFORE, BE IT RESOLVED, That the Common Council of the City of South Bend, Indiana, record its deep sense of official and personal loss on the occasion of the death of an honest and respected public official. Councilman Niezgodski made a motion for the adoption of the Resolution. Councilman Muszynski seconded the motion. Motion carried. JUNE 28TH, 1954 984 REGULAR MEETING COMMUNICATIONS JUNE 28TH, 1954 Communications were received from the United Garment Works of America, Local #182, and United Brotherhood of Carpenters & Joiners of America, r relative to the curtailment of bus service* Councilman Niezgodski made a motion that the communications be referred to the Board of Public Works. Councilman Glass seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE VEOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance transferring $1220.00 from ME -216 Electrical Inspection Department (Travel Expense) to ME -11 Services Personal; from L-38 General Supplies (Engineering Department) $50.00 to L -725 Office Equipment; from Q -11 Services Personal (Fire Department) $3700.00 to Q -222 Gas $12000000, Q -223 Instruction $200.00, Q -251 Repairs of Buildings and Structures $2,000.00, Q -262 Medical, Surgical andDental $500.00; from 721 Furniture and Fixtures (City Plan Commission) $150.00 to 36 Office Supplies; all of the budget for 1954 of the Civil City of South 'fiend, Indiana and declaring an emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. W. A. HAHN, Chairman Councilman Korpal made a motion that the report be accepted. Councilman Niezgodski seconded the motion. Motion carried. REPORT' & THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance providing for the vacation, removal, repair or demolition of any building or structure which is or threatens to be a public nuisance, dangerous to the health, morals, safety or general welfare of the people of the City of South Bend or which might tend to constitute a fire menace; establishing a department of substandard buildings and dwellings; providing for inspection and enforcement and fixing penalties and procedures for violations ". Respectfully report that they have examined the matter and that in their opinion that Section "E" be amended by adding the following: "Provided, however, that the duties of the In-speetor set forth in subsections (c), (d), and (e) shall not be exercised until the Council shall have, by ordinance, ordered the Inspector to proceed to effectuate the purposes of this ordinance with respect to the particular property or properties which the Inspector shall have found to be unfit for human habitation or dangerous, and which property or properties shall be described in the ordinance ", and that the ordinance go to the Council favorably as amended. REGULAR MEETING ORDINANCE NO. 3989 (AS AMENDED) AN ORDINANCE PROVIDING FOR THE VACATION, REMOVAL, REPAIR OR OEMOLITITION OF ANY BUILDING OR STRUCTURE WHICH IS OR THREATENS TO BE A PUBLIC NUISANCE, DANGEROUS TO THE HEALTH, MORALS, SAFETY OR GENERAL WELFARE OF THE PEOPLE OF THE CITY OF SOUTH BEND OR WHICH MIGHT TEND TO CONSTITUTE A FIRE MENACE; ESTABLISHING A DEPARTMENT OF SUBSTANDARD BUILDINGS AND DWELLINGS; PROVIDING FOR INSPECTION AND ENFORCE - MENT AND FIXING PENALTIES AND PROCEDURES FOR VIOLATIONS. JUNE 28TH, 1954 Councilman Korpal made a motion to accept the amendment to the ordinance. Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND. WHEREAS, the Board of Public Works and Safety of the City of South Bend, Indiana, has found that many streets in the City of South Bend are deteriorated and have become defective to a great and serious extent and accordingly has created an emergency requirint immediate construction, reconstruction and improvement of said streets; and WHEREAS, this, Board finds that the construction, reconstruction and improvement of such streets is necessary in-order to protect the safety and well -being of the citizens of said City and will be of general benefit to the entire City; and WHEREAS, this Board finds that the estimated cost of the construction, reconstruction and improvement of said streets and the incidental expenses in connection therewith will be in the amount of One million dollars ($1,000,000.00); now therefore, BE IT RESOLVED by the Board of Public Works and Safety of the City of South Bend, Indiana, that this Board request the City Controller and Common Council to take proper steps immediately to provide the necessary funds for said purpose, in the amount of One million dollars ($1,0009000.00), and to that end that a copy of this resolution be filed with the City Controller and City Clerk, and presented to the Common Council at the next meeting thereof. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. The Board of Public Works and Safety of the City of South Bend, Indiana, has requested an appropriation in the amount of One Villion Dollars ($1,000,000.00) for application on the cost of construction, reconstruction and improvement of streets in said City and the incidental expenses to be incurred in connection therewith. I recommend that said appropriation be made, am submitting herewith, for the consideration of the Council, a form of ordinance authorizing such appropriation. The City does not have funds available to pay the cost of said project, and in order to provide funds to meet said appropriation it wilike necessary to authorize, issue and sell bonds of the City in the amount of One Million Dollars ($190002000.00), and I am handing you herewith a form of ordinance drawn for such purpose. Dated this 24th day of June, 1954. Respectfully submitted, James A. Bickel City Controller Councilman Niezgodski made a motion that the request be accepted and placed on file. Councilman Muszynski seconded the motion. Motion carried. The City Clerk presented to the Council a petition filed by owners of taxable real estate in the City ofSouth Bend requesting the Common Council to issue the bonds of the City in an amount not exceeding $1,000,000.00, for the purpose of providing funds to be applied on the cost of construction, reconstruction and improvement of streets, and expenses incurred in connection therewith. Said petition having been examined and found to be sufficient, and to be properly verified and certified, on motion duly made, seconded and carried, the same was approved and ordered file. ORDINANCE N0, 3990 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS IN SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF CONSTRUCTION, RECONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on July 12th. Councilman Glass seconded the motion. Councilman Niezgodski made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. Mouncilman Hahn made a motion that the Auditor's Certificate be accppted and placed on file. Councilman Bestle seconded the motion. Motion carried. ORD9INANCE AN AMENDED ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Two,Side Yards) Councilman Niezgodski made a motion that the ordinance be held up for two weeks. Councilman Korpal seconded the motion. Motion carried. ORDINANCE AN ORDINANCE CONCERNING DEALERS IN SCRAP OR JUNK MATERIALS, AND PROVIDING FOR THE LICENSING AND REGULATION THEREOF; PENALTIES FOR VIOLATIONS AND REPEALING ALL ORDINANCES IN CONFLICT. Councilman Hahn made a motion that the ordinance be held up for two weeks. Councilman Niezgodski seconded the motion. Motion carried. The Honorable Mayor John A. Scott issued a Call for Special Meeting at the hour of 5:30 P.M., on Wednesday, June 30th, for the purpose of electing a successor for the office of Councilman-at-Large, which call was served upon the President and each member of the Common Council. There being- no further business before the Council, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Korpal.
