HomeMy WebLinkAbout05-10-54 Council Meeting MinutesREGULAR MEETING MAY 10TH, 1954 Be it remembered that the Common Council of the City of South Bend met in regular session in the Council Chamber, Monday, May 10th, 1954, at 8:14 P.M., with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the;Common'Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF THE COMMITTEE OF THE WHOLE I To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance transferring funds from C =11 Services Personal (City Clerk) $238.64 to A -11 Services- Personal (Office of Mayor) and establishing Salary of Deputy City Clerks at $3600900 each; all of the budget for 1954 of the Civil City of South Bend, Indiana and declaring it an emergency." 9'73 REGULAR MEETING MAY 10TH, 1954 Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. REPORT OF THE CITY CONTROLLER OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR ELIDING DECEMBER 31ST, 1953. As the councilmen have copies of the Controller's Report, there being no- objections, the report was accepted and placed on file. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: Petition of Homer and Maxine Fitterling to rezone Lots No. 1 through 287 in Sunset Park Addition from E Indus- trial and F.hei ght and area to A Residence was given legal notice under date of April 26, 1954, and public hearing before your City Planning Commission under date of May 6, 1954. These lots are located north of Calvert Street between Dundee and Industrial Streets. This petition is recommended unfavorably for the following reasons: 1. Subject property is in close proximity to railroad trackage. 2. Subject property would be surrounded by industrially zoned districts. Very truly yours, Robrert L. REPORT OF CITY PLAN COMMISSION Common Council City of South "Bend South Bend, Indiana Gentlemen: Petition of Downey- Hodson Realty Co., Inc. to rezone Lot No. 81 in Walnut Second Addition from B Residence and A height and area to C -1 Commercial. and D height and area districts was given legal notice under date of April 26, 1954, and public hearing before your City Planning Commission under date of May 6, 1954. This real estate is located on the southeast corner of Indiana Avenue and Nash Street. This petition is, recommended unfavorably for the reason that the granting of petition constitutes spot zoning. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: Petition of John Campbell et al to rezone 98 feet of the east end of Lot No. 6 of Hibberd Place Addition from B Residence and A height and area to C Commercial and F height and area districts was given legal notice under date of April 26, 1954, and public hearing before your City Planning Commission under date of May 6, 1954. This lot is on east side of Oakland Street immediately south of first east west alley south of Mishawaka. Avenue. This petition is recommended unfavorably for the reason that the granting of this petition vumuld allow an unwarranted intrusion into a residential district. Very truly yours, Robert L. MEETING REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: MAY 10TH, 1954 Petition of Kreamo Bakers, Inc. to change zoning of Lots 1, 2, and 3 and vacated alley in rear, from C Commercial to D Light Industrial, F height and area districts, and Lot 17, all in Elias Rupelts Addition, to F height and area was given legal notice under date of April 26, 1954, and public hearing before your City Planning Commission under date of May 6, 19549 These lots are located southwest corner Brookfield Street and Lincoln Tay West. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE. (Southwest corner of Brookfield Street and Lincoln Way West) The ordinance was given first reading by title and second reading in full. Couneilmm Niezgodski made a motion that the ordinance be held up until May 24th. Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen— Petition of Place and Co., Inc. to rezone that part of Sorin Street in McKinley Terrace Additiom between east boundary of McKinley Terrace Addition west to east line of Preston Avenue produced north from C -1 Commercial D height and area, to.A Residence and A height and area districts was given legal notice under date of April 26, 1954, and public hearing before your City Planning Commission under date of May 6, 1954. Councilmna Hahn seconded the motion. Motion carried by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter)* ORDINANCE N0, 3976 AN ORDINANCE TRANSFERRING MONIES FROM VARIOUS TRANSPORTATION ALLOWANCES TO TRAVEL EXPENSES OF THE BUDGET OF 1954. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilman Alford and Pinter). ORDINANCE N09 3977 AN ORDINANCE ESTABLISHING A FIXED MILEAGE RATE FOR REIMBURSEMENT FOR CITY OFFICIALS AND EMPLOYEES IN THE USE OF PRIVATE CONVEYANCES FOR CITY BUSINESS. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). MAY 10TH, 1954 The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). ORDINANCE NO. 3981 AN ORDINANCE APPROVING THE CONTRACT BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND G. W. FALCON, D /B/A FALCON MARM COMPANY, FOR THE CONSTRUCTION OF SEWER RIVER CROSSINGS. The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 2 absent (Councilmen Alford and Pinter). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COffliONLY KNOWN AS "THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA ". The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the ordinance be referred to committee on Miscellaneous Business for further study. Councilman Bestle seconded the motion. ORDINANCE AN ORDDINANCE CONCERNING DEALERS IN SCRAP OR JUNK MATERII-LS, AND PROVIDING FOR THE LICENSING AND REGULATION THEREOF, PENALTIES FOR THE VIOLATION, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. Councilman Hahn, Chairman of Ordinance Committee, announced that the committee will have report in two weeks on the above ordinance. Councilman Glass made a motion that the question of "garbage collection" be postponed until May 24th. Councilman Hahn seconded the motion. Motion carried. There being no further business before the Council, Councilmen Muszynski made a motion to adjourn, which motion was seconded by Councilman Hahn. Motion carried, and Council adjourned at 8:53 P.M.
