President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bendr Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF THE COMKIT TEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance transferring monies from various transportatidn allowances to travel expenses of the budget of 1954". Respectfully report that they have examined the matter and that in their opinion this ordinance be held over for two weeks. x.: Councilman Korpal made a motion that the report be accepted. carried. Motion To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance establishing a fixed mileage rate for reimbursement for city officials and employees in the use of private conveyances for city business ". REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance concerning dealers in scrap or junk materials, and providing for the licensing and regulation thereof, penalties for the violation, and repealing all ordinances in conflict therewith ". Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to the Ordinance Committee and any councilman interested in this ordinance be invited to attend this meeting and amendments drawn and presented at the next Council meeting on May 10th. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: 11 Petition of Willy's Overland, Inc. of South Bend and Gasterial Inc. to rezone lots on the northwest corner of Indiana and Michigan Street from C commercial to D light industrial was legally advertised under date of March 24, 19540 and given public hearing under date of April 1, 1954. ='This change is not recommended for the following reasons, which are transcribed from the Planning Commission minutes: "1. Michigan Street is predominantly a commercial street, is so zoned; and with few exceptions, so used. , 2. Granting of petition would in effect set a precedent for future industrial development along this artery. 3. There is considerable light and heavy industrially zoned areas immediately to the west of petition area. 4. The use of the land in the petition area precludes off- street parking and loading. ". Very truly yours, Robert L. Huff, Secretary Councilman Hahn made a motion that the Council concurr with report of City Plan Commission in rejecting this zoning. Councilman Glass seconded the motion. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gent lemon: Returned herewith, after further consideration by the City Planning Commission under date of April 23rd in special meeting, is ordinance to amend the district map of the South Bend zoning ordinance from A use and A height and area to E use and E height and area in the area at Lincoln Way West and Bendix Drive, which ordinance was originated by the Planning Commis sion and which o rdinance honors, in effect, the recommendat ion of the Council regarding suaVight industrial district'as opposed to an original petition recommending heavy industrial for a part of said area. This proposed ordinance was given public hearing under date of January 7, 1954. This ordinance is strongly recommended for the following reasons s 1. Subject area is served by a railroad spur, a major thoroughfare of sufficient eapaoity to handle additional traffic load that would be generated by industrial use of area, a 48 inch trunk sewer on Lincoln Way West the capacity of which is entirely sufficient to handle increased load that would be occasioned by industrial use on subject property. There is adequate water pressure available to supply increased demand occasioned by industrial. use. (rnn-Fi nnAA) 29 The area involved, amounting to 53 acres of level, adequately- drained land, is sufficient to provide adequate site, or sites, for modern one -story plant facilities and to provide adequate off- street parking and setbacks from adjacent streets and areas of future residential use. 3. The subject area can readily expand to the north, can be readily annexed, and therefore be on South Bend tax rolls. 49 Subject area is contiguous to 80 acres now zoned for heavy industry. 5. Zoning Ordinance allows no obnoxious uses in a light industrial district. 6. The use of subject area by light industry will help to diversify the existing industrialized economic base of the community. 79 There is a gross shortage of industrially zoned areas within the city and within the South Bend region. 8. Since commercial developments cannot expand beyond the volumes of local purchasing power, industrial development provides the best method of building up the city's tax base from which each citizen directly benefits economically. 9. The best indication of the need for new industry, and therefore of industrial sites, is the $392,0009 over one -third of a million dollars, pledges by the citizens of our community to the Committee•.of 100 for the purpose of assistance to existing industries and the attraction of new industries to the area, which will give the eitizens of the community an increasingly higher standard of living. Motion carried.by a roll call vote of 6 ayes (Councilmen Erler, .Alford, Pinter, Bestle, Glass and Muszynski) 2 Not Voting (Councilmen Korpal and Niezgodski) - 1 Nay (Councilman Hahn). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, ADOPTED JUNE 13, .1949, AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (53 acre tract lying West of Bendix Drive and Nort# of Elwood Ave.) The ordinance was given third reading and lost by a roll call vote of 1 aye (Councilman Glass) - 8 nays (Councilmen Erler, Alford, Korpal, Pinter, Bestle, Niezgodski, Hahn and Muszynski). ORDINANCE NO. 3974 AN ORDINANCE APPROVING CONTRACTS BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND THE SEVERAL CONTRACTORS FOR THE CONSTRUCTION AND PURCHASE OF A SMI GE TREATMENT PLANT, LIFT STATIONS, INTER- CEPTING SEWERS, AND RE- ENFORCED CONCRETE CULVERT PIFE BY THE CITY OF SOUTH BEND. 910 The ordinam a was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE AN ORDINANCE TRANSFERRING FUNDS FROM C -11 SERVICES - PERSONAL (CITY CLERK) $238.64 TO A -11 SERVICES - PERSONAL (OFFICE OF MAYOR) AND ESTABLISHING SALARY OF DEPUTY CITY CLERKS AT $3600.00 EACH; ALL OF THE BUDGET FOR 1954 OF THE CIVIL CITY OF SOUTH BEND, IN=DIANA AND DECLARING IT AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be referred to the Committee of the Whole for public hearing on May 10th. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING CERTAIN MONIES FROM THE GENERAL FUND TO THE GENERAL IMPROVEMENT FUND OF THE CITY OF SOUTH BEND, INDIANA AND DECLARING AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on May 10th. Councilman Bestle seconded the motion. Motion carried. 9"iS, . . Councilman Hahn made a motion that the ordinance be tabled. Councilman Niezgodski seconded the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was seconded by Councilman Bestle. Motion carried, and Council adjourned at 9 :14 P.M.
