President Erler presided. REPORT OF COMMITTEE ON MINUTES F To the Common Council of the City of South Bend: Your Committee on the inspection and supervision -of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REGULAR MEETING COMMUNICATION Members of the Common Council FEBRUARY 1954 I see where the New York Central kept their part of the bargain that was promised use But I am quite sure that without your cooperation we would never see the Deiselts this soon. There were times when we gave up hope of ever seeing Deisels put in for switching out on the west side, but with your whole support we have, and its really hard to believe. I do think that this will make our neighborhood -more liveable and cleaner for our youngsters to grow up in. I want to thank one and all of your gentlemen for the wonderful help you gave us. Also the Chief of Police for the grand support he gave by posting his men out here on duty every week. Respectfully, Mr. & Mrs. Ed. Spyehals ki and the Ladies of the West side. PETITION TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: The undersigned, owners of Lot Numbered 4 as shown on the recorded Plat of Charles Weidlers 1st Addition to the City of South'.Bend, Indiana (2311 Miami Street) hereby petition your honorable body to amend and supplemo t the present zoxiing ordinance by the adoption of an ordinance changing the zoning classification of the aforesaid described.property from "A" residential district, "A" height and area district to "C" commercial district and "D" height and area district. The undersigned petitioner would represent and show to the Honorable Common Council of the City of South Bend, Indiana, that he is the legal owner of the following described real estate situate in the City of South Bend, ;` Iounty of St. Voseph, State of Indiana, to wit: All of that real estate which consists of one (1) square block in said City and County bounded on the East by Miami Street, on the North by Dubail Avenue, on the West by Dale Avenue and on the South by Dayton Street, all of which said square block is more particularly and legally described as follows: Lots Numbered Fifty -seven (57) through Seventy -Six (76) inclusive in the Recorded Plat of Oak Park Second Addition, an Addition to the City of South Bend, Indiana. Your petitioner would further represent and show to this Honorable Body that at the time of the recording of the plat herein above set forth that there were various and divers alleys running East and West and North and South through said square block and that all 'of said alleys have heretofore been vacated by legal process and the fee title thereto has by operation of law reverted to the undersigned petitioner. Your petitioner now prays the Common Council of the City of South Bend that Lots Numbered Fifty -Seven (57) through Sixty Four (64) inclusive in said plat be changed from their present zoning of "C" Commercial to the zoning classification of "B" Residential District and that the "E" Height and Area District now provided for said lots remain unchanged, and your petitioner would further pray the Common Council of the City of South Bend that all of the rest and remainder of the real estate herein described including the vacated alleys hereinbefore referred to, be changed from the present zoning of "A"-Residential District and A" Height and Area District to "B" Residence and "E" Height and Area District for the following reasons: 1. That it is the purpose of the undersigned, to cause a rectory to be constructed for the use of the priests on a portion of the property now zoned Commercial and that under said Commercial zoning, a building being erected for dwelling purposes, is not permitted. 2. Your petitioner desires to have all of said tract of real estate in the same zoning and Height and use classification. (Continued) 3. That it is contemplated that a gymnasium and auditorium be erected on a portion of the real estate fronting on Dale Avenue, which said use will be an accessory building incident to the operation of the private school to which use the property is presently being put andthat such use is not permitted as a matter of right in "A" Residential District but is allowed under "B" Residential clarification. Your petitioner would further state and say that the granting of this petition as prayed for would not impair the value of the property in the immediate vicinity or in any way damage the health, morals, or the general well being of the community but would in fact tend to protect the health, morale and general well being of the commun WHEREFORE, your petitioner respectfully asks that said above described real estate be changed to the zoning and the Height andkrea Districts prayed for above. MEMO TO THE CITY PLAN COMMISSION With reference to amendment to zoning Ordinance No. 3702 changing the Hennings property on East Jefferson Blvd. from "Alt residential to "B" residential and which was returned to the Plan Commission for further study. The motion returning this ordinance to the Flan Commission having been carried by a voice vote. The Council feels that their thinking in this matter has not been clearly understood. The Council is not opposed to the hospital, but does not.favor changing the zoning classification from "A" residential. to "B" residential. The Coun oil 'would therefore suggest that the Plan Commission give some consideration to placing hospitals in the "A" residential classification, giving some thought to restrictions, eteerequired, such as: 10 Minimum lot areas to be about 4 acres or more. 2. No part of any building to be less than 50 feet from any bounding lot or street line, 39 Adequate space provided for off street parking. 4. Restrictions to height limitations to two stories. The foregoing is merely a suggestion of approximate restrictions which might be included. This memorandum was adopted by unanimous vote of the Council. Walter C. REPORT OF THE CITTEE OF THE WHOLE ' To the "Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance amending Chapter 29 of General Ordinance No. 3709 known as the 1949 Municipal Code of the City of South Bend, Indiana by adding thereto Section 38A entitled "Yielding Right`:`of Way% Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Counil as favorable. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance amending Section 36 of Chapter 29 of General Ordinance No. 3709 known as the 1949 Municipal Code of the City of South Bend, Indiana by adding thereto a section to be known and designated as Section 36b Regulating Parking of vehicles on Certain Streets% Respectfully report that they have examined the matter and that in their opinion this ordinance go to theCouncil as favorable. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance transferring funds from E -215A Transportation Allowance - Bailiff $120.00 to'E -11 Salary of Bailiff $120.00; from E -215B Transportation Allowance- Probation Office; $520.00 to E -11 Salary of Probation Officer $520900; from ME -215 Transportation Allowance $1920.00 to ME -11 Salary of Chief Electrical Inspector $500.00 and to Salary of Assistant Electrical Inspectors $1420.00 all of the budget for 1954 of the Civil City of South Bend, Indiana and declaring an emergency ". REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: On the petition of Kenneth Bateman, at al, for change of zoning of south half of Lot 14 in Samuel Cottrell's First Addition from B residence and B height and area to C commercial and D height and area districts, specifi6&1-3 located on north side of Colfax between Notre Dame Avenue and Francis Street is not recommended for the following reasons as transcribed from the Planning Commission minutes under date of January 28, 1954: l.' The granting of this petition would constitute a continuation of strip zoning as opposed to consolidated shopping districts. IT- 2. It would adversely affect property values of surrounding area. 3. It would create eight additional residential units as non - conforming. 4. There is sufficient commercially zoned districts in the immediate vicinity. Very truly yours, Robert L. REPORT OF CITY PLAN COMMISSION Common Council City of South Bend South Bend, Indiana Gentlemen: On the petition of Earl W. and Gertrude Menzie for change of zoning on Lot 177, the second plat of Roseland Park,!I from B residence and A height and area to C commercial and D height and area districts, the lot being located at 1514 East Calvert Street, is not recommended for the following reasons as transcribed from the Planning Commissi.ox minutes under date of January 28, 1954. 19 The surrounding neighborhood is predominantly in residential use. 2. There is sufficient area now zoned for commercial use in the neighborhood and that such area now zoned for commercial use is now predominantly in residential use. 3. The petitioner failed, to the satisfaction of the Commission, to show the need of increased commercial use from a neighborhood standpoint* 4. A commercial use in proximity to a public school is undesirable. 59 An additional commercial use would serve neither the school nor the neighborhood. Very truly yours, Robert L. REPORT OF CITY PLAN COMMISSION Common Council City of South Bond South Bend, Indiana Gentlemen: Petition of W. C. Gammons for change of zoning of Lots No. 17, 18 and 19 in the proposed plat of Sunnyside Land Co's Addition, an unrecorded plat known as Jefferson Manor, was given legal notice under date of December 24, 1953 and public hearing under date of January 7, 1954. These lots are on the south side of Jefferson Blvd* on both the east and west sides of Ironwood Drive and include the west half of the vacated 22nd Street. This change is not recommended for the following reasons as transcribed from the Planning Commission minutes under date of.. January 28, 1954: 1. This change would be an unwarranted intrusion into residential area. 2. The area in question is unsuitable for commeroial development. Very t ruly yours, Robert L. Vance, 2109 Elwood Avenue, et al, being petition to rezone Lots 1, 2, 3, 4, 50 6, 270 48 and 49 of Elwood Park Addition; and Lots 1, 2, 3 of Huey Heights Second Addition, Lots 26, 27 and 28 proposed; Lots 4 through 12 inclusive of Elwood Avenue Addition, and more particularly located for this purpose on Elwood Avenue between Johnson and Huey from C commercial and D height and area district to residential use and resident height and area district. This petition was given public hearing under date of December 3, 1955s and petition is recommended by amending same as follows:. ORDINANCE NO. 3961 AN ORDINANCE AMENDING ORDINANCE N0. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF S WTH BEND, INDIANA. . (Elwood Ave. between Johnson and Huey Sts.) The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. 09T "OF` CITYIPLAX COMMON Common Council City of South Bend South Bend, Indiana Gentlemen: Submitted herewith is an ordinance to amend the district map of the South Bend zoning ordinance from A use and A height and area to E use and E height and area in the area at Lincoln Way West and Bendix Drive, which ordinance was originated by the Planning Commission and which ordinance honors, in effect, the recommendation of the Council regarding such light industrial district as opposted to an original petition recommending heavy industrial for a part of said area. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to a special oo�mittee, namely, Councilmen Niezgodski, Glass, Pinter and Bestle, and the Councilman in that district serve as chairman of the committee and report back to the next regular Council meeting on March 8th. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE N0. 3959 AN ORDINANCE CONCERNING THE CONSTRUCTION AND OPERATION BY THE CITY OF SOUTH BEND, INDIANA, OF SELVAGE TREATMENT WORKS, THE ISSUANCE OF REVENUE BONDS TO PROVIDE THE COST THEREOF, THE COLLECTION, SEGREGATION AND DISTRIBUTION OF THE REVENUES OF SAID WORKS, THE SAFEGUARDING OF THE INTERESTS OF THE HOLDERS OF SAID BONDS, AND OTHER MATTERS CONNECTED THEREWITH.. Under date of February 4, 1954, the following resolution was adopted by the City Planning Commission: WHEREAS the proposed dewage disposal plant is a publicly owned and operated building for the purpose of public health, safety and welfare, and, WHEREAS it is to the clear advantage of the City-.of South Bend to annex the site proposed for the sewage disposal plant to the City and recently purchased by the City of South Bend, THEREFORE, BE IT RESOLVED: That the City Planning Commission recommends that said site be annexed to the City of South Bend and simultaneously be zoned A use and A height and area district.
