President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council, of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of'.January 11th, 1954. Motion Your Committee of the Whole to whom was referred "An Ordinance amending Ordinance Not 3 702 commonly known as the Zoning Ordinance of the City of South Bend, Indiana% Respectfully report that they have examined the matter and that in their opinion this ordinance shall be referred to the Council with recommendations that the Council return this ordinance to the Plan Commission for further study. W. A. HM, Chairman Councilman Niezgodski made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Tot The Common Council City of South Bend Gentlement Petition of Jook McCormack to rezone Lots 13, 14 and 15 in Fernwood Addition from A residential and A height and area district'to D light industrial and E height and area districts was given public hearing under date of December 3, 19'53, before the City Planning Commission. This change is not recommended for the following reasons: It is an unwarranted intrusion of industrial use into a residential district and no evidence of need from a neighborhood standpoint for industrial use in this area was shown. This property is located between Sunrymsde. Avenue and the railroad tracks, adjacent to the north -south alley one block west and parallel to Logan street. Very truly yours, Robert L. God in His infinite wisdom has called from this life.ANTHONY MILLER, Battalion Chief of the South Bend Fire Department, and WHEHUS: His sudden death was brought about by his courage and his devotion to duty for the cause for which he dedicated his life, and WHEREASs The City of South Bend has been deprived of an able and conscientious public servant, and 161EREASs His sudden death has brought much grief and sorrow to his wife, daughter, relatives and his many friends, NOW, THEREFORE, BE IT RESOLV'EDs That we, the Common Council of the City of South Bend, do hereby extend to the entire family of Anthony Miller, our sincere sympathy in this, their deepest hour of sorrow, and BE IT FURTHER RESOLVED that a page in the Council Records of the City of South Bend be set aside and this Resolution be copied therein and a copy duly certified by the Clerk be sent to the bereaved. Motion carried. 1954 JANUARY 25TH, 1954 PETITION TO WITHDRAW Common Council City of South Bend, Indiana Gentlemen: The undersigned, Jack McCormack, owner of Lots Numbered 13, 14 and 15 in Ferrwood Addition to the City of South Bend, County of St. Joseph, State of Indiana, hereby withdraws petition for rezoning the above property. Jack McCormack, Petitioner Councilman Niezgodski made a motion that the petition for withdrawal be accepted and placed on file. Councilman Hahn seconded the motion. Motion carried. ORDINANCE NO. 3958 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951. 0 The ordinance was given first reading by title and second reading in full. Councilman Glass seconded the motion. Motion carried. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on February 8th. Councilman Hahn seconded the motion. Motion carried. REGULAR MEETING JANUARY 25TH, 1954 ORDINANCE AN ORDINANCE AMENDING CHAPTER 29 OF GENERAL ORDINANCE N0. 3709 KNOWN AS THE 1949 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA BY ADDING THERETO SECTION 38A ENTITLED "YIELDING RIGHT OF WAY"e The ordinance was -given first reading by title and second reading in full. Councilman Niez.godski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on February 8th. Councilman Glass. seconded the motion* Motion carried. There being no further business before the Council, Councilman Glass made a motion to adjourn, which motion was seconded by Councilman Niezgodski.
