Be it remembered that the Common Council of the City of South Bend, met in regular session in the Council
Chamber, Monday, July 27th, 1953, at 8:13 P.M., with all members present. President Erler presided*
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Petitioners alleges
PETITION OF SOUTH BEND SAND AND GRAVEL
CORPORATION, LOUIS GRUSZYNSKI AND
PELAGIA KANIEMKI.
1. South Bend Sand and Gravel Corporation is the owner in fee simple of a tract bounded by a line running
as follows:
Commencing at a point of intersection of the center lines of Kenmore Street and Marquette
Boulevard produced; thence North to the City Limits; thence East to Bendix Drive; thence
South to the center line of Marquette Boulevard produced; thence West to the place of
beginning; which tract for convenience is called Parcel le
2. Louis Gruszynski and Pelagia Kaniewski are collectively the owners in fee simple of two tracts, which for
convenience are called Parcels 2 and 3, to wit:

Parcel 2 is bounded by a line running as followsr. Commencing; at the point of intersection

Bendix Drive; thence South to the center line of Elwood Avenue produced; thence West to
a point 603 feet West of the center line of Bendix Drive; thence North to the center line
of Keller Street produced; thence West to the center line of Kenmore Street produced;
thence North to the place of beginning.
Parcel 3 is bounded by a line running as follows: Commencing at the intersection of
;x Bendix Drive and Lincoln Way West; thence Northwesterly along Lincoln Way West to a point
712 feet West of the center line of Bendix Drive; thence North to the center line of
Elwood Avenue produced; thence East to Bendix Drive; thence South to the place of
beginning.

4. A large area on the East side of Bendix irive opposite said three parcels is zoned for heavy industry
and has long been used and is now used for the mining and processing of sand and gravel and the manufacture
of concrete and other products* Such area has long been served., and is now being served by the Chicago South
Shore and South Bend Railroad. The frontage opposite parcel 3 on Lincoln. Way West is zoned "C" Commercial*

Their best use, both from the standpoint of the interests of petitioners and of

Industrial Use District and "E" Height and Area 'District.
7. Louis Gruszynski and Pelagic Kaniewski propose to develop Parcel 2 for uses consistent with "D" Light
Industrial Use District and "D" Height and Area District.
8. Louis Gruszynski and Pelagia Kaniewski propose to develop Parcel 3 for uses consistent with "C" Commercial
Use District and "D" Height and Area District.
9. Petitioners are ready, able and willing to dedicate for highway purposes a strip of land 20 feet in width
East and West along the entire East side of said three parcels to be used for the widening of Bendix Drive
to the West.
10. Attached hereto and filed herewith is a proposed amendment of the zoning ordinance, the adoption of which
is sought by this petition.
WHEREFORE, petitioners prays
1. That the Council refer this petition and the proposed amendment to the Plan Commission for hearing and
recommendations.
2, Upon receipt of favorable report from the Plan Commission, that the Council adopt such proposed amending

Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Bestle
seconded the motion. Motion carried.
REPORT OF COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bend:
Your Committee of the Whole to whom was referred "An Ordinance transferring funds from Police Department, P -11,
Salaries, $5000900 to P -334, Other Garage and Motor Supplies; and from Police Department, P -11, Salaries, $1000,00
to P -261, Mechanical Assistance.
Respectfully report that they have examined the matter and that in their opinion this ordinance go to the
Council as favorable.

Councilman Korpal made a motion that the report be accepted. Councilman Hahn seconded the motion. Motion

AN ORDINANCE TRANSFERRING EUNDS FROM POLICE DEPARTMENT,
P -110 SALARIES, $5000.00 TO P -334, OTEER GARAGE AND
MOTOR SUPPLIES; AND FROM POLICE DEPARTMENTS P -11,
SALARIES, $1000.00 TO P -261, MECHANICAL, ASSISTANCE.
The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays.

CLINIC U -342 LAUNDRY AND CLEANING $125.00 TO U -38 GENERAL
SUPPLIES $125,00 AND FROM U -343 MEDICAL $185.00 TO U -12
TEMPORARY HELP $185,00; ALL OF THE BUDGET OF 1953 OF THE
CIVIL CITY OF SOUTH BEND, INDIANA.
The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion
that the ordinance be referred to the Committee of the Whole for public hearing on August 10th. Councilman
Muszynski seconded the motion. Motion carried.
UNFINISHED BUSINESS
Councilman Korpal made a motion that the Board of Public Works contact Mr. Farabaugh as to when the New York
Central Railroad Company intends to give an answer relative to moving their servicing facilities, Councilman
Niezgodski seconded the motion. Motion carried,
Councilman Niezgodski made a motion that the City Attorney examine the statutes to see what legal steps can
be taken to force removal of the servicing facilities of the New York Central Railroad Company and report hack
to the next Council meeting on August 10th. Councilman. Muszynski seconded the motion. Motion carried*
Councilman Glass made a motion that the City Attorney prepare an ordinance appropriating additional money for
the purchase of a dust and smoke arrester for the asphalt plant. Councilman Hahn seconded the motion. Motion

NEW BUSINESS
Councilman. Muszynski made a motion that the City Engineer contact Mr. Colpaert relative to improving the grade
of the alley at Prairie Ave. and Brookfield St• Councilman Pinter seconded the motion. Motion carried.
There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion
was seconded by Councilman Glass. Motion carried, and Council adjourned at 9 :13 P.M.
