REGUTAR MEETING JULY 13TH, 1953 Be it remembered that the Common Council of the_City of South Bend, met in regular session in the Council Chamber, Monday, July 13th, 19530 at 8:07 P.M., with all members present except Councilman Hahn. President Erler presided. REPORT OF COMMITTEE ON MINUTES Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Korpal seconded the motion. Motion carried. PETITION PETITION DIRECTED TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: The undersigned our hereby respectfully petition the Common Council to amend and supplement the present zoning ordinance No. 3702 by the adoption of an ordinance zoning the following described real estate in the City of South Bend, County of St. Joseph, State of Indiana, as "A" Residential District and "A" Height and Area Districts Beginning at point on the one - eighth (1/8) line 336 ft* west of the Southeast corner of the North Half of the Northeast Quarter section 5 T. 37 N. R. 3 East, which point is the present pity limits; thence east 336 ft* to the east line of said section 5 (center line of Hickory Road); thence north along the east line of said section 5 a distance of 572.22 ft., to a point 737.15 ft., more or less, south of the Northeast corner of section 5; -thence west parallel with the north line of said section 5 a distance of 553.08 ft., more or less, to the present city limits; thence south along the present city limits a distance of 549.45 ft.; thence east along present city limits a distance of 216948 ft, to a point 22.44 ft* north of beginning; thence south 22.44 ft* to place of beginning. Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City'of South Bend, Ind. Gentlemen: Petition of 0. R. Robertson for change of zoning of a tract of unplatted land on Lincolnway West has been given public hearing before the City Plan Commission as advertised. This change is not recommended. Yours truly, D. Moomaw, Seoy. Councilman Niezgodski made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council. City of South Bend, Ind. Gentlemen: Petition of Land Developers Co. Inoe for annexation of a 74 acre tract of land west of Hickory 140and south of Edison Rde was considered by the City Plan Commission at their regular meeting on July 2, 1953. The annexation of this area is approved by them* Yours truly, D. Moomaw, Secy. Councilman Glass made a motion that the report be accepted. Councilman Korpal seconded the motion. Councilman Niezgodski seconded the motion. Motion carried. ORDINANCE N0. 3932 ANNEXING LANDS TO AND DECLARING SAME TO BE A PART OF THE CITY OF SOUTH BEND, INDIANA,. (74 acre tract of land west of Hickory Rd* and south of Edison Rd.) The ordinance was given first reading by title and second reading in full. 'Councilman Niezgodski made a motion for suspension of rules* Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Hahn). The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Councilman Hahn). ORDINANCE AN ORDINANCE TSFERRING FUNDS FROM POLICE DEPARTMENT, P -119 SALARIES, $5,000.00 TO P -334, OTHER GARAGE AND MOTOR SUPPLIES; AND FROM POLICE DEPARTMENT, P -111, SALARIES, $19000.00 TO P -261, MECHANICAL ASSISTANCE. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be referred to the Committee of the Whole for public hearing on July 27th, 1953 at 8:00 P.M• Councilman Niezgodski seconded the motion. Motion carried* UNFINISHED BUSINESS A number of officials from the New York Central Railroad, headed by Mr. W. H. Farrell of Elkhart, Chief Road Foreman of Engineers, appeared before the Council relative to complaints of smoke and cinder in the vicinity of the 1600 block of West Dunham Street. Councilman Korpal made a.motion that Mr. Farrell obtain g report from Chicago relative to moving their servicing facilities near the Olive Street crossing. Councilman Muszynski seconded the motion. Motion carried. NEW BUSINESS Councilman Niezgodski made a motion that the Board of Public Works notify the Chicago South Shore and South Bend Railway to repair their right -of -way East from LaPorte Avenue. Councilman Muszynski seconded the motion. Moth on carried.- w. Councilman Korpal made a motion that the $oard of Public Works notify Mr. Tomlinson, Street Commissioner, to investigate and correct the situation of smoke, dust and fumes from the mi.xang_,plant and the noise fromtrucks hauling dirt and report back to the Council at its next meeting on July 27th. Councilman Muszynski seconded the motion. Motion carried. Councilman Glass made a motion that the City Attorney prepare an ordinance forbidding the practiQe of sweeping debris into the street. Councilman Muszynski seconded the motion. Motion carried. - Councilman Korpal made a motion that the Board of Public Works investigate the noise created at night by trucks from the Brodbeok Trucking Co. on West Indiana- gvenue between Walnut and Olive Streets. Councilman Niezgodski seconded the motion. Motion carried* There being no further business before the Council, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Glass.
