President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Benda Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them. correct* They therefore recommend that the sage be approved. Meeting of May 11th, 1953* Councilman Hahn made a motion that the report be accepted. carried. REPORT OF THE COMMITTEE OF THE WHOLE To the- - Common Council of the City of South Bend: WALTER C. ERLER SR. ) STANLEY C. KORPAL ) Committee W. A. HAHN ) Councilman. Niezgodski seconded the motion. Motion Your Committee of the Whole to whom was referred "An Ordinance of the City of South Bend, Indiana authorizing the issuance and sale of bonds of said city for the purpose of providing funds to be applied on the cost of acquisition of the necessary land and equipment for the collection and disposal of garbage of said city, and expenses incurred in connection. therewith% Respectfully report that they have examined the matter and that in their opinion this ordinance go to .the:- Council as favorable. Wf A. HAHN, Chairman Councilman Glass made a motion that the report be accepted* Councilman Bestle seconded the motion. Motion carried* REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY TO: CITY CLERK The following is an excerpt from the minutes of the regular meeting of the Board of Public Works and Safety of May 25th: y ' "A'letter .from'the law offices of Hammerschmidt & Johnsen under date of May 21, addressed to the City Comptroller, and enclosing three copies of Agreement between the Board of Public Works and the Board of County Commissioners, was next read and examined. The Agreement, dedicating for street purposes a 3O- foot strip of land off . the entire east side of Veterans' Memorial Park, and conveying to the City of South Bend, the real estate now comprising Pottawatomi Park in fee simple, was found to be satisfactory and in order, and was accordingly signed and accepted by the Board of Public Works"* ` Councilman Korpal made a motion that the report be accepted* Councilman Muszynski seconded the motion. Motion. carried. �I REGULAR MEETING _ MAY 25T$ 1953 VERBAL REPORT FROM DR. RAUSCH OF THE PARK BOARD Dr. Rausoh, President of the Park Board, appeared before the Council to explain why the Park Commissioners entered into an agreement with the Bendix Aviation Corporation under which the corporation will build a $30,000.00 parking lot for 325 oars in Bendier Park* The contract is for five years at a $1200904 annual rental and all improvements will belong to the Park Department on expiration of the contract. The public will have use of the parking lot on Sundays and holidays* Councilman Niezgodski made a motion that the report from the Park Board be accepted. Councilman Hahn seconded the motion. Motion. carried. ORDINANCE N0. 3926 AN ORDINAANCE OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF ACQUISITION OF THE NECESSARY LAND AND EQUIPMENT FOR THE COLLECTION AND DISPOSAL OF GARBAGE IN SAID CITY, AND EXPENSES INCURRED IN CONNECTION THEITH. The Clerk presented to the Council proof of publication and posting of notice of the public hearing on the ordinance proposed to be passed and authorizing the issuance and sale of bonds of said City for the purpose of providing funds to be applied on the oust of aequisition of the necessary land and equipment for the collection and disposal.of garbage in said city, and expenses incurred in connection therewith* On'motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved• The presiding officer then announced that the Council was ready to hear all taxpayers interested in the said ordinance* After hearing all taxpayers desiring to be heard on said ordinance, the ordinance was given third reading in full* Councilman Niezgodski made a motion that the ordinance be held up for two weeks* Councilman Muszynski seconded the motion. Motion lost by a roll call vote of 4 ayes kCouneil.men Korpal, Pinter, Niezgodski and Muszynski) • 5 nays (Councilmen Erler, Alford, Bestle, Glass and Hahn)* FIVE MINUTE RECESS • St41 P.ld. Councilman Glass made a motion for a five minute recess. Councilman Hahn seconded the motion* Motion carried• N RECONVENED MEETING - 8:53 P.M. Councilman Glass reconsiders his motion. Councilman Niezgodski seconded the motion. Motion carried, and the ordinance be held up for two weeks* Councilman Niezgodski thereupon introduced Ordinance No* 3927. entitled "An Ordinance of the City of South Bend, Indiana appropriating the sum of One Hundred Fifty Thousand Dollars ($150,000.00) to be applied on the cost of acquisition of land and equipment necessary for the collection and disposal of said city of garbage in said city, and expenses :fxeurred in aonneetion therewith ". The ordinance was given first reading'by title and there being no objections the ordinance was given second reading in full, Councilman kvzgodski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on Juice 8th, 1953, and that the City Clerk be instructed to publish a notice to taxpayers of such publie hearing once each week for two weeks in the South Bend Tribune and the Tri- County News, the dame being newspapers published in the -Xity of South Bend and representing tiro leading political parties, and to post said notice in three public places in said City, the first publication and posting to be at least ten (10) days prior to 'said date* This motion was seconded by Councilman Muszynski, and on call of the roll was adopted by the following vote: Ayes: Councilmen Erler, Alford, Korpal, Pinter, Bestle, Niezgodski, Glass, Hahn and Muszynski• Nays: None The presiding offeer declared said motion carried and instructed the City Clerk to publish and post notice of said public hearing as provided in the foregoing motion* ORDINANCE AN ORDINANCE TRANSFERRING FUNDS FROM Q -11, SERVICES PERSONAL, FIRE D EPARTMENT, TO Q•724, MOTOR EQUIPMENT, FIRE DEPARTMENT IN THE AMOUNT OF $16,700.001 AN"EMERGENCY APPROPRIATION OF $3,200.00 FROM GENERAL STREET AND TRAFFIC FUND TO S -2510 REPAIRS OF BUILDINGS AND STRUCTURES, STREET DEPARTMENT, OF THE BUDGET OF 1953 OF THE CIVIL CITY OF SOUTH BEND, INDIANA• The ordinance was given first reading by title and second reading in full. Councilman Muszyn.ski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on June 8th. Councilman Glass seconded the motion. Motion carried* 'UNFINISHED BUSINESS Mr. William E. Voor, attorney for the South Bend Public Housing Authority, made a report to the Council to the effect.that the authority can proceed with the Maggies Court federal low rent housing project, if the Council will approve a new cooperation agreement. REGULAR MEETING UNFINISHED BUSINESS MAY 25TH, 1953 Councilman Bestle made a motion that President Erler appoint one member of the Council to the housing committee* Councilman Hahn seconded the motion. Motion carried* President Erler appointed. Councilman Pinter as a member of the Council to serve on the housing committee• Councilman. Korpal made a motion that the Mayor's committee meet with the Council on housing. Councilman Muszynski seconded the motion, Motion carried by a roll call vote of 9 ayes ( Councilmen Erler, .Alford,,Korpal, Pinter, Bestle, Niezgodski, Glass, Hahn. and Muszynski) - 0 nays. There being no further business before the Council, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Niezgodski.
