Council Chambers March 9th, 19530 at 8.-15 P.M., with all members present except Councilmen Bestle and Niezgedski*

PETITION
We believe that South Bend should follow Mishomka's example and adopt an ordinance confining dogs to their
owner's property at all times, and not just in the summer months. 'When a dog ruins our lams and shrubs it is
trespassing with its owner's permission. A dog that challenges the right of anyone, child or adult, to walk
on a public sidewalk is a menace and usually owned by someone completely indifferent to the rights of the
neighbors and the general public*
Councilman Muszynski made a motion that the City Attorney prepare an ordinance relative to the above petition
for the next Council meeting* Councilman Glassheconded the motion. Motion carried.

situated in the City of South Bend, Indiana, and described as follows, to wits
A lot or parcel of land forty (40) feet in width, North and

to the City of South Bend, Indiana, be changed from "C " Commercial

The undersigned hereby respectfully petition the Common Council to amend and supplment present zoning ordinances
by the adoption of an ordinance zoning the following described real estate in the City of South Bend, County
of St. Joseph, State of Indiana, as "A" Residential. District and "A"" Height and Area Districtt
Beginning on the present city limits at a point 200 ft, south of the
center of section 19 T. 37 N. R. 3 East; thence east along the present
city limits 200 ft* south of the east and west center line of said section
19 a distance of 1320 ft., more or less, to the east line of the North
West Quarter of the South East Quarter; thence south 955 ft., more or less,
to a point 165 ft north of the south line of the North West Quarter of the
South East Quarter; thence west 1320 ft., more or less, to the north and
south center line of said section 19; thence north along the north and

MARCH 9TH. 1953
Your Committee of the Whole to whom was referred "An Ordinance prohibiting the passing of motor vehicles by
trucks, trailers and certain other vehicles on public streets in the City of South Bend, Indiana%
Respectfully report that they have examined the matter and that in their opinion th6ireport of the Traffic
Committee be accepted and the ordinance be tabled for six months.

REPORT OF THE COMMITTEE OF THE WHOLE
To the Common Council of the City of South Bends
Your Committee of the Whole to whom was referred "An Ordinance for safeguarding persons and property and promoting
the welfare of the publict creating the office of electrical inspector and prescribing his duties: establishing
standards for electrical equipment t£nd for its installation and requiring conformity therewith: making it unlawful
to undertake the installation of electrical equipment without a permit therefor, and creating an electriealexaminii
board and a board of review and prescribing their dutiest providing for the licensing by the electrical examining
board of persons, firms, and corporations undertaking the installation of electrical equipment, and operators of
moving pie'ture projectors, and electrical contractors and dealers in electrical equipment, and making it unlawful
to undertake the installation of electrical equipment or operation of moving picture projectors without a license
except as otherwise provi dedt: providing penalties for the violation of this ordinance, and repealing all ordinance:
and parts of ordinances in conflict herewith ".
Respectfully. report that they have examined the matter and that in their opinion this ordinance be referred to a
committee of three for further study and to report back to the Committee of the Whole at its next meeting.

The attached petition was presented to the Board of Zoning Appeals at its regular meeting on February 26th.
The Board has directed the secretary to return the petition to the 'Council stating that the petition is not in
regular order and that the Board of Zoning Appeals cannot hear petition or make recommendations in matter of
zoning change.

Petition for change of zoning of property on the west side of N. Michigan Ste from Bartlett St. to Park Lane
from B residence and C height and area.distriots to C commercial and D height and area district was given public
hearing before the City Plan Commission on February 5, 1953.
The Board of Park Commissioners have made a suggestion (see attached letter) that this change would be more
satisfactory if made to the C -1 district instead of C commercial.
Petitioners have verbally amended their petition to conform to the above suggestion and to leave the height and
area district as it is at present (C height and area)• At their meeting on Feb* 5, 1953s, the City Plan Commissi
acted to recommend that the change be made from B residence to 0-1 Commercial*

ORDINANCE
AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND
FUND TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL
CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET
FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS
OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945,
AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY
OF 1951.
The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that
the ordinance be held up until March 23rd. Councilman Korpal seconded the motion. Motion carried.
Bond of 011ie Fries, Treasurer of the City of South Bend, Indiana, for a four year term dated January 1st, 1953,
in the amount of $100,000.00 with Travelers Indemnity Company was submitted to the Council.
Councilman Hahn made a motion to approve the bond for 011ie Fries, City Treasurer. Councilman Pinter seconded
the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 2 absent (Councilmen Bestle and Niezgodski•.
NEW BUSINESS
Councilman Muszynski made a motion that the Board of Public Works contact the officials of the railroad company
relative to installing flasher signals at the crossings in the 1400 -1500 block of South Kendall, Chapin streets
and Catalpa Avenue. Councilman Pinter seconded the motion. Motion carried.
Councilman Muszynski made a motion that the Board of Public Works notify the Traffic Engineer to meet with union
officials relative to solving the parking situation on Franklin St. from Garst St. to Broadway. Councilman Korpa
seconded the motion. Motion carried.

REGULAR MEETING MARCH 9TH, 1953
Councilman Muszynski made a motion that.the Board of Public Works notify the Police Department to check on cars
parking on the sidewalk in the vicinity of Franklin Street between Garst St. and Broadway. Councilman Korpal
seconded the motion.
Councilman Korpal made a motion that the Board of Public works submit a report to the Council relative to the
agreement with the Dependable Disposable Company. Councilman Muszynski seconded the motion. Motion carried.
There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was
seconded by Councilman Korpal. Motion carried.
