REGULAR MEETING FEBRUARY 9TH, 1953 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, February 9th, 1953, at 8:35 P.M., with all members present. President Erler presided.. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: YFour Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION City Council City of South Bend South Bend, Indiana Gentlemen: February 3, 1953 The Common Council of the City of Goshen, Indiana, at its regular meeting held February 2, 1953 went on record as favoring the adoption of Eastern Standard Time on a year round basis. The following is a copy of the above mentioned action as the same is written in the minutes of said meeting. COUNCIL FAVORS ADOPTION OF EASTERN STANDARD TIME ON YEAR ROUND BASIS Councilman Baxter moved that'the Council go on record as favoring the adoption of Eastern Standard Time on a year round basis, and that the Clerk- Treasurer forward copies of this action to the City Councils of Indianapolis, Fort Wayne and South Bend, as well as to the members of the 1953 Assembly who represent our area. REGUTA R MEETING PETITION STATE OF INDIANA ) SS: ST. JOSEPH COUNTY j IN THE MATTER OF THE PETITION OF LOUIS MAJOR FOR REZONING OF REAL ESTATE. FEBRUARY BEFORE THE COMMON COUNCIL OF THE CITY OF SOUTH BEND TO: The Common-Council of the City of South Bend, Indiana: PETITION FOR REZONING REAL ESTATE The undersigned, Louis Major, respectfully petitions and shows this Honorable body the following: 1. That he owns the following described real estate situate in St. Joseph County, State of Indiana, which is now zoned and classified under the zoning ordinance of the said City of South Bend, being known as Ordinance No. 3702, as amended June 13, 1949, as C -1 Commercial district and D Height and Area District, to wit: A parcel of land described as beginning 184.5 feet South of the North one quarter corner of Section 8, Township 37 North, Range 3 East, being a point on the South line of U. S. Highway No. 20, thence South a distance of 165 feet, thence East a distance 192 feet, thence North a distance of 165 feet more or less to a point on the South line of said highway, thence West along the South line of said highway to the place of beginning. 2. That he also. owns the following described real estate in said County, adjoining the above described real estate on the south and east, which is now zoned and classified under said ordinance as A Residential District and A Height `and Area District, to -wit: A parcel of land described as beginning 349.5 feet South of the North one quarter corner of Section 8, Township 37 North, Range 3 East, thence South a distance of 106 feet, thence east a distance of 232 feet, thence North a distance of 263.85 feet more or less to a point on the South line of said U. S. Highway No. 20, thence West along the South line of said highway a. distance of 40 feet, thence South a distance of 165 feet, thence West a distance of 192 feet to the place of beginning. 3. Attached hereto and made a part hereof is a plat of all the real estate above described, indicating the portion thereof now zoned as C -1 Commercial by the designation "Area C -1 ", and the portion thereof now zoned as A Residential by the designation `Area A ". ') 4. That your petitioner desires to have the real estate described in paragraph 2 hereinabove (Area A) rezoned and reclassified by amendment of said zoning ordinance from the above classification to C -1 Commercial District and D Height and Area District. 5. That your petitioner intends to make the following use of the real estate first above described if this petition is granted" and said rezoning permitted& Your petitioner prop '6ses to erect a small retail shopping center on the above real estate which is now zoned C -1 Commercial (Area C -1) and to construct an off street parking lot and driveway on the portion of the above real estate for which this rezoning is requested (Area A). Said shopping center will consist of a grocery store, A hardware store, a bakery and a drug store. Your petitioner then plans, after the construction of said shopping center and said off street parking lot, to lease said individual retail stores to individual lessees for use by them as integral parts of said shopping center. 6. That the nature and location of the residential area surrounding said real estate indicates that the majority of the customers of sail proposed shopping center will utilize automobile transportation in their patronage thereof and will be in need of adequate parking facilities; that the use of the real estate designated Area A as an off street parking lot for the use of customers of said shopping center will - avoid excessive parking on U. S. Highway No. 20, on which highway said real estate fronts, and will thus avoid a serious traffic hazard in the proximity of said shopping center; your petitioner believesthat because of the modern trend in automobile shopping the commerical use of Area A is consistent with ' -and necessary to the commercial use of Area C -1 as a shopping center and will cause much latter commercial use t be more beneficial to the surrounding residential community and this city than it would be without such,off street parking facilities for said customers. 7VEREFORE your petition respectfully prays that the zoning ordinance of said City of South Bend may be amended to allow the rezoning hereinabove proposed. (Signed) LOUIS MAJOR Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Korpal seconded the motion. Motion carried. PETITION To the Common Council City of South Bend South Bend, Indiana Gent lemen: Petition for change of zoning of Lot No. 36 in Gorsuch Addition, located at 822 So. Kosciuszko St., from "B" Residential and "A" Height and Area District to "C" Commercial and "E" Height and Area District. (19 Signatures) Councilman Korpal made a motion that the petition be referred to the Board of Zoning Appeals. Councilman Pinter seconded the motion. Motion carried. 853- REGULAR MEETING FEBRUARY 9TH, 1953 REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance prohibiting the passing of motor vehicles by trucks, trailers and certain other vehicles on public streets in the City of South Bend, Indiana ". Respectfully report that they have examined the matter and that in their opinion the President appoint a committ to meet with the trucking industries and report back to the next Council meeting on March 9th. W. A. HAHN$ Chairman Councilman Korpal made a motion that the report be accepted. Councilman Niezgodski seconded the motion* Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance for safeguarding persons and property and promot the welfare of the public; creating the office of- electrical inspector and prescribing his duties: establishing standards for electrical equipment and for its installation and requiring conformity therewith: making it unlawful to undertake the installation of electrical equipment without a permit therefor, and creating an electrical examining board and a board of review and prescribing their duties: providing for the licensing by the cleetrieal examining board of persons, firms and corporations undertaking the installation of electrical equipment,and operators of moving picture projectors, and electrical contractors and dealers in electrical equipment, and making it unlawful to undertake the installation of electrical equipment or operation of moving picture projectors without a license except as otherwise provided: providing penalties for the violation of this ordinance, and repealing all ordinances and parts of ordinances in conflict herewith% Respectfully-report that they have examined the matter and that in their opinion this ordinance be held up until next meeting on March 9th. Councilman Hahn seconded the motion. Motion carried. ORDINANCE NO. 3906 AN ORDINANCE AUTHORIZING THE SALE OF PERSONAL PROPERTY OWNED BY THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title-and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE NO. 3907 AN ORDINANCE M,1ENDING ORDINANCE N0, 3702 CMUTONLY KNOWN AS THE ZONING ORDINANCE. (Property bounded by Swygart St, on the West, the alley North of Indiana Ave. on the South, McPherson Sto on the East & railroad property on the North). The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. RESOLUTION WHEREAS, the Board of Public Works and Safety of the City of South Bend, Indiana, has heretofore unanimously adopted a Resolution determining that it is in the best interest of said City that the municipal government institute a system of collection and disposition of garbage and trash throughout said City, and WHEREAS, a preliminary study of the subject has been informally made by the members of this Council, NOW, THEREFORE, BE IT RESOLVED: By the Common Council of the City of South Bend, Indiana, that a system of municipal collection of garbage and a limited system of collection and disposition of trash be instituted by said City and that prompt steps be taken by the Board of Public Works and Safety and the proper legal officers of said City to formulate and institute. plans for issuance of a General Obligation Bond Issue in the amount of Three Hundred Thousand Dollars ($300,000) and specifications of details of the plans for such project to be submitted to this Council for consideration. REGUTA R MEETING FEBRUARY 9TH, 1953 The Boy Scouts who were appointed officials for the day were introduced to the Council. There being no further business before the Council, Councilman Muszynski made a motion to adjourn, which motion was seconded by Councilman Bestle. Motion carried, and Council adjourned at 9:05 P.M.
