JOSEPH ) SS: CITY OF SOUTH BEND ) CALL FOR SPECIAL MEETING To the Preside2a.t, and Members of the Common Council of the City: of South Bend, Indiana: Gentlemen: You are hereby notified that under and by virtue of the authority vested in me by law as Mayor of the City of South Bend, in the State of Indiana, a Special Meeting of the Common Council of said City is hereby called to meet in the Council Chamber, in the City Hall at the hour of 8 :00 P.M., on Wednesday, October 15th, 1952. This meeting is called to take the place of the regular meeting held the second Monday of the month.an.d is for the purpose of conducting all general business that would normally come before a regular meeting of the Common Council. HADRICK Member of the South Bend Po lice Department The Special Call was read by the Clerk and ordered placed on file. 827 SPECIAL MEETING OCTOBER 15TH ,_1952 REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. HAHN ) Councilman Niezgodski made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATIONS & PETITIONS TO: The Hon. John A. Scott The Common Council Mayor - City of South Bend and City of South Bend South Bend, Indiana. South Bend, Indiana Gentlemen: For your 'consideration, we are submitting to the City of South Bend petitions signed by over 9,000 citizens and taxpayers of South Bend, along with out -of -city shoppers and visitors. The petitions request that the City of South Bend improve its parking facilities which apparently are inadequate in the judgment of at least these more than 9,000 citizens and motorists. The "petitions specifically endorse municipal development of off - street parking facilities. Such a program originally was recommended by the Mayor's Off- Street Parking Committee, and today also has the endorsement of business, professional, industrial, civic, and labor organizations of our community. COMMUNICATION South Bend Common Council City Hall South Bend, Indiana Gent lemen: October 8, 1952 The Bus Driver's Union would like to call your attention to the letter we sent you on May 20, 1952 in regards to reduction in service the Northern Indiana Transit put into effect June 7, 1952, which reduced the Saturday service from 10 to 15 minute head -way on the following lines North Side, Western Ave., South Side, Bendix, Michigan and Portage. At that time the Company classified these reductions as normal summertime reductions. On Sept. 8, 1952 the Company restored its soycalled normal winter schedules and did not attempt to restore the 10 minute headway on the above mentioned lines. In addition to this they reduced -the Madison- Mishawaka service from 15 to 30 minute headway on Saturday. We are also told that on October 24 . 1952 the company is going to terminate the service on Angela at.6:30 P:M* instead of 10 :00 P.M. which has been the practice in the past. The Company claims that by running a few tripper buses instead of replacing the 10 minute headway on the above mentioned lines they can cut mileage and still give the public proper and efficient service. It is true that they can save on mileage but under a system of this type however, again the bus riding public is the one who suffers because they are not receiving the service they are entitled to. We appeal to you as representatives of the public to investigate this for the public instead of letting the Company make these cuts as they see fit. Sincerely yours, James B. Wilson, Rec. Motion carried* OCTOBER 15TH, _1952 SPECIAL MEET Mrs. Mayme Dumont Clerk of the Common Council City of South Bend, Indiana Dear Mrs, Dumont* We have your letter of September 29 requesting that local merchants be circularized to correct the situation of, sweeping trash into the streets. You will be interested to know that after long study and consideration we have come to these conclusions on the subject. 1. Merchants do not sweep store waste into the gutters. 2. The trash placed in the gutters is trash originating on the streets. 3. If the streets were cleaned periodically, there would be little or no trash. 4. A realistic. approach to the problem would be for the City of South Bend to clean and flush our streets as is done in other cities (downtown streets are seldom if ever flushed). lye trust vie can have your cooperation in this rmtter. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance transferring monies from Sewer Department J -11, X2,000 and J -12, x$5,000 to Sewer Department J -13, $7,000 and from Dog Pound K -11, $400 from Salary of Assistant Pound Master 12 Salary of Pound Master in the published budget for 1952 and declaring an emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. W. A. HAHN, Chairman Councilman Glass made a motion that the report be accepted. Councilman Korpal seconded the motion. Motion ca4ried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition for change of zoning of 51 lots in Oliverts Second Addition from residence district 1952� was given public hearing at the regular meeting of the City Plan Comm2s p s As was disclosed at the hearing the objective sought by the property. petitioners Plan rCommission fis no through streets of that area rather than control of the use of the property. to control or to authorize the control of street traffic. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Behd, Indiana Gentlemen: Petition of George W. Williams, eto al. for change of zoning of Lots No. 60 to 75 inclusive in West End Addition was given public hearing before the City Plan Commission at its regular meeting September 4, 1952. It was brought out in the hearing that the objective sought in this change was the control of the use of two lots on Lawton Street at Fremont Street which are how in industrial use. The owners of these lots did not sign the petition. A change to residence district would not accomplish what they desire in this case. This change is not recommended Yours truly D. ORDINANCE NO. 3894 AN ORDINANCE TRANSFERRING MONIES FROM SERVER DEPARTMENT, J -11, $2,000 AND J -12, $5,000 TO SEWER DEPARTMENT J -13, $79000 AND FROM DOG POUND K -11, $400 FROM SALARY OF ASSISTANT POUND 14ASTER TO SALARY OF POUND lMSTER IN THE PUBLISHED BUDGET FOR 1952 AND DECLARING AN EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE AN ORDINANCE DESIGNATING WEST EWING AVENUE A BOULEVARD FROM FRANKLIN STREET TO GERTRUDE STREET. The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the ordinance be held up for two weeks for further study and to have the Traffic Engineer attend the meeting for further explanation. ORDINANCE AN ORDINANCE TRANSFERRING MONIES FROM P -11, POLICE DEPARTMENT, SERVICES PERSONAL, $5,200 TO P.38, GENERAL. SUPPLIES, $200; P -7242 MOTOR EQUIPMENT, $5,000, AND FROM V -11, ELECTRICAL DEPARTMENT, SERVICES PERSONAL, $1,394.14 AND FROM V -2161 TRAVELING EXPENSES, $118.11 TO V -724, MOTOR EQUIPMENT, $1,512.250 AND FROM Q -11, FIRE DEPARTMENT, SERVICES PERSONAL, $4,000 TO Q -251, REPAIRS OF BUILDINGS AND STRUCTURES, $4,000, AND FROM T -261, TRAFFIC DEPARTMENT, OTHER CONTRACTUAL SERVICES, $300 TO T -252, REPAIRS OF EQUIPMENT, $300. The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that the ordinance be referred to the Committee of the Whole for public hearing on October 27th, 1952. Councilman Glass seconded the motion. Motion carried. RESOLUTION BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the Contract heretofore entered into by and between the Board of Public Works and Safety of the City of South Bend, Indiana, and the Rieth- Riley Construction Company of South Bend, Indiana; for the paving of MIAMI STREET from the south line of Ewing Avenue to the "south line of Ridgedale Road for the contract price of Fifty -six thousand,five.hundred eighty -six dollars and no� cents ($56,586.00 is confirmed and approved. CLOYD BESTLE Member of the Common Uouncil Councilman Hahn made a motion for the adoption of the resolution. Councilman Korpal seconded the motion. Motion carried. RESOLUTION BE IT RESOLVED by the common Council of the City of South Bend, Indiana, that the Contract heretofore entered into by and between the Board of Public Works and Safety of the City of South Bend, Indiana, and the Rieth -Riley Construction Company of South Bend, Indiana, for the paving of 'NEST SAMPLE STREET from the east line of Walnut Street to the wdst line of Kosciuszko Street for the contract price of Sixteen thousand, six hundred ninety -two dollars and fifty cents $16,692.50) is confirmed and approved. RESOLUTION BE IT RESOLVED by the Common Council of the Civil City of South Bend, Indiana, That, The use of the property located at the Northeast corner of Marietta & Sample Stso in said City be dedicated to the Board of Park Commissioners of said City for park and playground purposes. WALTER G. GLASS Member of Common Council Councilman Hahn made a motion for the adoption of the resolution. Councilman Muszynski seconded the motion. Motion carried. SPECIAL MEETING RESOLUTION OCTOBER 15TH. 1952 WHEREAS, the use and number of automobiles has grown in the past twenty years of economic progress in the city of South Bend, by reason whereof acute problems are being created in moving and in parking of said vehicles to the greatest convenience of the motorists and citizens of this community; and 4 WHEREAS, the Association of Commerce has suggested that a survey be made of the parking situation now prevalent in the entire city of South Bend; and WHEREAS, parking meter funds are available for use in such a survey and these funds are intended to be used for the improvement of the general traffic problem in the city of South Bend; NOW, THEREFORE, BE IT RESOLVED that the Polish American Business Menst Association does hereby state its approval of the plan suggested by the South Bend Association of Commerce for an independent, impartial city -wide survey to be made of the parking situation in the city of South Bend, which proposal contemplates the use of parking meter funds to pay for this - ervice; and BE IT FURTHER RESOLVED that the Common Council of the City of South Bend be, and it is hereby urged to appropriate such sums of money as may be reasonably necessary to permit'such city-wide survey to be made. The foregoing was adopted at a regular meeting of the Polish American Business Men's Association held September 30, 1952. Edward Minczeski President ATTEST: Irvi4 F. NEW BUSINESS Mr. Dan-Clark, Chairman, Parking Committee of the Association of Commerce, presented petitions signed by more than 9,000 residents of South Bend and nearby towns and cities asking for better parking conditions. Councilman Hahn made a motion t hat the question of parking be referred to the Committee of the Whole for further study and notification of public hearingio Councilman Glass seconded the motion. Motion carried. Mr. John Zrinyi also presented petitions to the Council to enforce the limit on parking vehicles in front of residences a.nd. dwellings• Councilman Korpal made a motion that the petitions be accepted and placed on file. Councilman Hahn seconded the motion.
