REGULAR MEETING SEPTEMBER 22ND, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, September 22nd, 1952, at 8:10 P.M., with all members present except Councilman Korpal and Niezgodski. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Attention: Miss Mayme DuMont, City Clerk Gentlemen: I wish to acknowledge receipt of advice that the governing body of your municipality has taken the necessary action under the Housing and Rent Act of 1947, as amended, to continue Federal rent control after September 30, 1952• We have examined the material submitted and find that the action taken is in accordance with 'the provisions of the Housing and Rent Act of 1947, as amended, and Federal rent control will continue in your community after September 30, 1952• Sincerely yours, (Signed) JAMES McI. Motion carried• PETITION To the Common Council City of South Bend, Indiana Gentlemen: We, the undersignec/property owners, petition your honorable body to refuse permission to the Brodbeck Trucking Company for the construction of any building on Indiana Ave. 22 Signatures Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Muswnski seconded the motion. Motion carried* SEPTEMBER PETITION Petition on file with Board of Public works. Councilman Muszynski made a motion that the City Attorney prepare an ordinance declaring West Ewing Avenue a boulevard from Franklin Street West to Dorothy Street. Councilman Pinter seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bends Your Committee of the Whole to whom was referred "An Ordinance transferring monies from P -11, Police Department Salary Fund, to P -332, Police Department Oil, $200.00, and from H -11, Board of Public Works and Safety Salary Fund, to H -241, Board of Public Works and Safety Fund for Advertising and Publication of Notices, $200.00, declaring an emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. W. A. HAHN, Chairman Councilman Glass made a motion that the report be accepted. Councilman Hahn seconded the motion. Motion carried. Motion carried* ORDINANCE AN ORDINANCE TRANSFERRING MONIES FROM SEWER DEPARTMENT, J -11, $2,000.4AND J -12, $5,000 TO SEWER DEPARTMENT J -13, " $7,000 AND FROM DOG POUND K -17 , $400 FROM SALARY OF ASSISTANT POUND MfASTER TO SALARY OF POUND MASTER IN THE PUBLISHED BUDGET FOR 1952 AND DECLARING AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on October 15th. Councilman Bestle seconded the motion. Motion carried. ORDINANCE NO. 3892_ AN ORDINANCE TRANSFERRING MONIES FROM P -11, POLICE DEPARTMENT SALARY FUND, TO P -332, POLICE DEPARTMENT OIL, $200.00, AND FROM'H -11, BOARD OF PUBLIC WORKS AND SAFETY FUND,.TO H -241, BOARD OF "PUBLIC WORKS AND SAFETY FUND FOR ADVERTISING AND PUBLICATION OF NOTICES, $200.00, DECLARING AN EMERGENCY. The ordinance was given third reading and passedby a roll call vote of 7 ayes - 0 nays - absent (Korpal and Niezgodski). ORDINANCE NO. 3893 AN ORDINANCE AUTHORIZING THE SALE OF PERSONAL PROPERTY OWNED BY THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 7 ayes :6 0 nays 2 absent (Korpal and Niezgodski). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 2 absent (Korpal and Niezgodski ). RESOLUT ION BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the Contract heretofore entered into by and between the Board of Public Works and Safety of the City of South Bend, Indiana, and M. H. Rhodes, Incorporated, 30 Bartholomew Avenue, Hartford 6, Connecticut, to supply the Parking Meter Department of the City of South Bend, Indiana, with parking meters, as per proposal submitted by them in accordance with provisions of advertised request for bids, for the price of $46.00 each, Less 5f for cash within 60 days, is hereby confirmed and approved. Motion carried by a roll call vote of 7 ayes - 0 nays - 2'.:absent (Korpal and Niezgodski). 825 REGULAR MEETING SEPTEMBER 22ND, 1952 RESOLUTION BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the Contract heretofore entered into by and between the Board of Public Works and Safety of the City of South Bend, Indiana, and the Rieth -Riley Construction Company of South Bend, Indiana, for the paving of SHERMAN AVENUE from the south line of Rose Street to the north line of Bryan Street for the contract price of Nineteen thousand, eight hundred ninety -seven dollars and fifty cents ($19,897950) is confirmed and approved. WALTER C. ERLER, SR. Member of the Common Gouncil Councilman Korpal made a motion for the adoption of the resolution. Councilman Hahn seconded the motion. Motion.carried by a roll call vote of 8 ayes - 0 nays - absent (Niezgodski). UNFINISHED BUSINESS Councilman Glass made a motion to request the Secretary of the Retail Merchants Division:of the Association of Commerce to circularize all merchants of the city to correct the situation of sweeping trash into the street. Councilman Korpal seconded the motion. Motion carried. NEW BUSINESS Councilman Muszynski made a motion that the Board of Public Works contact the State Highway Commission relative to installing a stop light at the intersection of Western and Sheridan Avenues. Councilman Korpal seconded the motion. `Motion carried. There being no further business before the Council, Councilman Glass made a motion -to adjourn, which motion wa,s seconded by Councilman Muszynski. Motion carried, and Council adjourned at 9:.05 P.M.
