HomeMy WebLinkAbout09-08-52 Council Meeting Minutes821 �I REGULAR MEETING SEPTEMBER 8TH, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, September 8th, 1952, at 8:05 P.M., with all members present except Councilman Muszynski. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. STANLEY C. KORPAL ) WALTER C. ERLER, SR. ) Committee Meeting of august 25th, 1952. W. A. HAHN ) Councilman Hahn made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. PETITION To the Common Council of the City of South Bend, Indiana Gentlemen: I, the undersigned, property owner in the City of South Bend, Indiana, hereby petition your honorable body that the zoning of the following described real estate Lot No. 93, Swygart Addition, be changed from "C" Commercial and "DII. Height and Area District to "B" Residential and "A" Height and .Area District. (Signed) Anton Kovacsics Councilman Hahn made a motion that the petition be referred to the City Plan Commission. Councilman Korpal seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Phillip Smith for change of zoning of lot at the northwest corner of West Washington Avenue and Taylor Street from B residence. and C height and area districts to C commercial and F height and area district was given public hearing before the City Plan Commission at its regular meeting September 4, 1952. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Immanuel Methodist Church for change of zoning of a part of Lot A in Raff's 4th Addition from B residence and A height and area districts to C commercial and E height and area districts was given public hearing before the City Plan Commission at its regular meeting on September 4, 1952. ORDINANCE NO. 3890 AN ORDINANCE AMENDING ORDDINANCE NO. 3702 (Lot at the Northwest corner of West Washington Ave. and Taylor Street) The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays - 1 absent ( Muszynski). The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent ( Muszynski). REGULAR MEETING ORDINANCE NO. 3891 AN ORDINANCE AMENDING ORDINANCE NO. 3702 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Property on the East side of Catalpa St. South of Indiana Avenue) 822 The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays - 1 absent (Muszynski). ORDINANCE AN ORDINANCE TRANSFERRING MONIES FROM P -11, POLICE DEPARTMENT SALARY FUND, TO P -332, POLICE DEPARTMENT OIL, $200.00, AND FROM H -11, BOARD OF PUBLIC WORKS AND SAFETY SALARY FUND, TO H -241, BOARD OF PUBLIC WORKS AND SAFETY FUND FOR ADVERTISING AND PUBLICATION OF NOTICES, $200.00, DECLARING AN EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion that the ordinance be referred to the Committee a_" the Whole for public hearing on September 22nd. Councilman Korpal seconded the motion. Motion carried. UNFINISHED BUSINESS Board of Public Works and Safety City of South Bend, Indiana . Ro: Repair of New York Central Railroad Gentlemen :. crossings at Walnut, Harris, Sample and Olive Street and Twyckenham Drive Mr. Lem Schuster, supervisor of tracks of the New York Central Railroad, was notified of the bad condition of the above crossings and.was asked.to give :the matter his immediate attention. A.Mr. Cosner, assistant supervisor of tracks, was in my office Thursday afternoon, September 4th, and made the following verbal report: That the New York Central Railroad would start the repair of the Harris and Walnut Street crossings Tuesday,;,September 9, 1952. Another crew will start the repair and raising of tracks at the Twyckenham Drive crossing immediately. This will take approximately three weeks as the tracks will be raised for some distance on each side of Twyekenham Drive. The general repair of the Sample and Olive Street crossing is being held up temporarily until a decision can be mq,de by the ra-ilroad on the possible permanent removal of some of the tracks. In the meantime Mr. Cosner promised that a temporary patch job would be made at this location immediately. Very truly yours, Traffic Engineer Councilman Niezgodski made a motion that the report be accepted. Councilman Hahn seconded the Motion. Motion carried. NEW BUSINESS Councilman Korpal made a motion that the Board of Public Works and safety take action against merchants in all parts of the city who sweep store debris into the street. Councilman Niezgodski seconded the motion. Motion carried. Councilman Korpal made a motion that the Board of Public Works instruct the Police Department to cooperate with the street Department in clearing streets of parkers at night when streets are scheduledt o be cleaned. Councilman Niezgodski seconded the motion. Motion carried. Councilman Hahn made a motion that the Board of Public Works investigate the parking on the sidewalk on Colfax Avenue East of Michigan Street. Councilman Glass seconded the motion. Motion carried. There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was seconded by Councilman Korpal. Motion carried, and Council adjourned at 9 :53 P.M.
