REGULAR MEETING AUGUST 25TH, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, August 25th, it 10:25 P.M., with all members present. President Erler presided. REPORT OF CCdITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee of the inspection and supervision of the minutes, would respectfully report that they have inspected-the minutes of the previous meeting of the Council and found them correct. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance appropriating monies for the purpose of defraying the expenses of all budget - operated departments of the Civil City of South Bend, Indiana, for the fiscal year beginning January 1, 1953, and ending December 31, 1953, including departments, funds and commissionsfor/ hich money is appropriated, in whole or in part, from funds other than the general funds, of said city, to -wit: Street, Traffic and Park Departments, Firemen's Pension and Policemen's Pension Funds, and the City Plan Commission: Providing that such appropriations shall include all outstanding claims and obligations: fixing the salaries of all City officials and employees, repealing all ordinance and parts of ordinances in conflict herewith :' providing a time when the same shall take effect'. ReppeotfulTy report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. W. A. REPORT OF THE CITY CONTROLLER OF THE CITY OF SOUTH BED, INDIANA, FOR THE MONTH OF JUNE, 1952. RESOLUTION A RESOLUTION OF THE COMMON COUNCIL OF THE CIVIL CITY OF SOUTH BEND, INDIANA, IN RE- FERENCE TO THE EXTENSION OF FEDERAL RENT CONTROL WITHIN SAID CITY. WHEREAS, there is an alleged shortage of rental housing accommodations in the area, and, WHEREAS, there is an anticipated expanded activity in local industry and an increase of defense activities generally, and WHEREAS, the alleged shortage of rental housing accommodations might possibly become more severe. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the Civil City of South Bend, Indiana, that Federal Rent Controls be temporarily continued in the City of South Bend, Indiana, until April 30, 1953, and the C -ity Clerk is hereby directed to forward a copy of this Resolution -to the Office of Rent aStabilization in Washington, % Co WALTER GLASS Member of Common ouncil Councilman Muszynski made a motion for the adoption of the Resolution. RESOLUTION „ BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the Contract heretofore entered into by and between the Board of Public Works and Safety of the City of South•Bend, Indiana, and MOTOROLA, INC., 4545 West Augusta Boulevard, Chicago, Illinois, to supply the Fire Department of the City of South Bend, Indiana, with a complete system of radio communications equipment, as itemized in bid submitted by them in accordance with provisions of advertised request for bids, for the contract price of Thirteen Thousand, Five Hundred Ninety- eight dollars and six -five cents ($13,598.65), is hereby confirmed and approved. UNFINISHED BUSINESS MEMORANDUM TO CITY PLAN COMMISSION Reasons for rejection of Amendment to Zoning Ordinance requesting a change from Classification "B" Residential to "C" Commercial on the East side of the 2900 block South Michigan Street. 1. From the commercial center at Ireland Road and Highway 31 to Woodside St. with the exception of three commercial spots is occupied by residential. Michigan Street is the South gateway to South Bend and one of the heaviest traveled streets in the city and gives us a pleasing approach to the city. 2. One of our difficult problems today is a lack of off street parking with the zoning of an addition of 60 feet frontage on Michigan St. for a super market in addition to the frontage on Michigan Street now operated by petitioner as a restaurant and without sufficient off street parking creates a heavily congested area and as this is at the bottom of a grade on Michigan, which when icy, has caused many accidents in the past. 3. Mr. Heston's supplementary petition was not confined to property owners, but carries names from throughout the rural section as well as Lakeville. 4. The petitioner for zoning always has the advantage of prior knowledge of what is desired and can build up his case. The only notice citizens in the area have regarding what is attempted in zoning is a legal fine print notice in the newspapers required by law, which people affected by change of zoning do not read. The Plan Commission has a moral responsibility to see that those affected are notified. This lack of knowledge prevents a public hearing before the Plan Commission by all desiring to be heard. (Continued) AUGUST 25TH, 1952 MEMORANDUM TO CITY PLAN COMMISSION (Continued) Woodside..St.is now congested since trucks stop and park along the North side of Heston's store over the street curb on sidewalk, curbs broken and busses cannot get thru.. The City is the unit of government nearest to and most directly operated.by the individual citizen. It is the only area of direct democracy at work in America. The City is the instrumentality of the people, therefor subject to their opinions and desires and serving their needs where they live. Ours is also their government, the only level where they can exert influences, the point where they can be heard. This is very essential.and to our way of thinking, municipal government is by far the most important and the most impressive level of government. It feels the pressure of the individual and, in turn, its exerts a decided influence on the same individuals. Councilman Hahn made a motion that the report be accepted. carried. NEW BUSINESS WALTER C. ERLER, SR. Member of the Common touncil Councilman Glass seconded the motion. Motion Councilman Korpal made a motion that the Board of Works contact the Armour Company, 531 S. Chapin St., in regard to the parking of trucks and trailers in front of their - property making it necessary for people to walk out in the street. Councilman Hahn seconded the motion. Motion carried. Councilman Hahn made a motion that the Board, of Public Works investigate the crossing at McKinley and Ironwood Drive relative to speed of traffic. Councilman Niezgodski seconded the motion. Motion carried. Councilman -Glass made a motion that the Board of Public Works contact the officials of the Pennsylvania Railroad in regard to the condition of the,Garst Street crossing. Councilman Hahn seconded the motion. Motion carried. Councilman Niezgodski made a motion that the Hospital Boards submit their reports to the Council prior to the first reading of the budget relative to the Hospital Fund -for the year 1954.
