HomeMy WebLinkAbout04-28-52 Council Meeting MinutesREGULAR MEETING APRIL 28TH, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the .Council Chamber, Monday, April 28th, 1952, at 8:01 P.M., with all members present except Councilman Pinter. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. KORPAL ) Councilman Niezgodski made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. PETITION Gentlemen: We, the undersigned property owners, petition your honorable body to protest against the building of a truck terminal or truck parking in the 1500 block of Swygart Street. (138 Signers) Councilman Korpal made a motion to refer the petition to the Board of Public Works. Councilman Muszynski seconded the motion. Motion carried. Motion carried. 791 REGULAR MEETING APRIL 28TH, 1952 REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1952 budget for the Fire Department of the Civil City of South Bend, Indiana, in the amount of $20,000.00 and for the Cemetery Depart -' ment in the amount of $500.00 and appropriating from the General Fund of said +City to the 1952 budget for said departments in said amounts and declaring an extraordinary emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. VA. A. HAHN, Chairman Councilman Korpal made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the 'Whole to whom was referred "An Ordinance appropriating all Parking Meter Fees and Funds to the Board.of Public Works and Safety of the Civil City of South Bend, Indiana, for the uses and purposes set forth therein in accordance with Chapter 236 of the Acts of the General Assembly of the State of Indiana of 1945, as amended by Chapter 303 of the Acts of the General Assembly of 1951 ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. WM. A. HAHN, Chairman Councilman Muszynski made a motion that the report be accepted. Councilman Hahn seconded the motion. Motion carried. ORDINANCE NO. 3867 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1952 BUDGET FOR THE FIRE DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA, IN THE AMOUNT OF $20,000.00 AND FOR THE CEMETERY DEPARTMENT IN THE AMOUNT OF $500.00 AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY TO THE 1952 BUDGET FOR SAID DEPARTMENTS IN SAID AMOUNTS AND DECLARING AN EXTRAORDINARY EMERGENCY. ORDINANCE NO. 3868 AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR THE USES AND PURPOSES SET FORTH THEREIN IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - 1 absent (Pinter). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE 'ZONING ORDINANCE. (Property is on the south side of McKinley Ave. east of but not touching upon Ironwood Drive) President Erler called on the proponents to speak, and Mr. Robert A. Grant, Attorney for Louis Major, Jr., informed the Council that the petitioner intended to occupy only twenty"-five per cent of the four and one -half acres involved with buildings, and use the remainder for off - street parking and that the buildings would be modern and in keeping with the community and not lead to a decline in real estate values but enhance them. The - following also spoke: Professor J. B. Searles, marketing teacher in the University of Notre Dame college of commerce and Forest J. Armstrong, 332 North Ironwood jPrive spoke in behalf of Messrs. Wekony, Fisher, Gallanteen, Hess and Cissne. The opposition group was also heard and consisted of the following: Mr. William Shanahan, 113 North Ironwood Drive; Clyde Reynolds, 217 North Ironwood Drive; Irving J. Smith, 2116 E. Bader Ave., Albert H. Rerrick, 822 E. Donald, Trustee of the First Brethren Church, Ironwood Drive at Washington and Orie Parker and George M. Eichler, Attorneys. They indicated that the residents in that vicinity were not in favor of the shopping center and pleaded to the Council to defeat the ordinance for rezoning. The ordinance was given third reading and lost by a roll call vote of 0 ayes - 7 nays (Erle r, Alford, Korpal, Bestle, Niezgodski, Hahn and Muszynski) - 1 Not Voting (Glass) - 1 absent (Pinter). GULAR MEETING RESOLUTION APRIL 28TH, 1952 792 BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that the Contract heretofore entered into between the Board of Public Works and Safety of the 'City of South Bend, Indiana and the Reed Construction Company of Mishawaka, Indiana, for the-resurface paving of SAMPLE STREET from the easterly line of Lincolnway, East to the southerly line of Mishawaka_ Avenue for the contract price of Sixteen thousand, one hundred twenty - two dollars and twenty cents ($16,122.20) is confirmed and approved. WALTER G. GLASS Member of the Common Council Councilman Niezgodski made a motion for the adoption of the Resolution. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays 1 absent (Pinter). There being no further business before the Council, Councilman Muszynski made a motion to adjourn, which motion Seconded by- Councilman Hahn. Motion carried, and Council adjourned at 10:20 P.M.
