President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous *.meeting of the Council and found them correct. Councilman Glass seconded the motion. Motion carried. COMMUNICATION The Common Council of the City of South Bend City Hall Request to remove name from petition. South Bend, Indiana Gentlemen: The Portage Avenue Green Houses, Incorporated, by its President, Irma Collmer, requests your honorable members to remove the 'name of the Portage Avenue Greenhouses, Incorporated, from the petition filed in the Clerk's office of the City of South Bend on March 19, 1952; that said petition was signed by said Irma Collmer as President of the Portage -Avenue Greenhouses requesting that your Honorable members rezone the sixteen hundred block of Portage Avenue from the classification of "B" residential to "C" Commercial. Woodka, Vice - President of Lock Joint Tube Company, an Indiana corporation, and the owner of the following described property in fee simple, situate in the City of South Bend, St. Joseph County, State of Indiana, do hereby respectfully request the members of the Council to rezone the said described real estate from its present classification Residential "B" to the classification "D" Light Industrial District and "E" Height and Area District. We the residents of the South side of South Bend, object to the smoke, fire and health hazards of the factories, the Vandalia section of the Pennsylvanis Railroad and especially the soot and dust from the ventilating fans, the flay ash and smoke fumes from cupola's from the Sibley Machine and Foundry :Corp., located rear of 2700 So. Main St., and we insist that some action be taken to give us relief from the conditions as stated above. (150 Signatures) Councilman Hahn made a motion that the petition relative to Anti -Air Pollution be referred to the Board of Public Works and Safety. Councilman Korpal seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Carl J. Rudolph et al for change of zoning of portion of Lot'15 in J. G. Bartlett First Addition from "C" height and area district to "E" Height and area district was given public hearing before the City Plan Commission at their regular meeting April 3, 1952. This change is recommended as petitioned for. This property is at the southwest corner of North Michigan Street and Bartlett Street. REPORT OF CITY PLAN COIDAISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Joseph -Bartkowiak for change of zoning of Lot No. 3 in Bulla and Patton's Addition from A -1 residence and A Height and Area Districts to C Commercial and E Height and Area Districts was given public hearing before the City Plan Commission at their regular meeting April 3, 1952. ORDINANCE AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1952 BUDGET FOR THE FIRE DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA, IN THE AMOUNT OF $20,000 AND FOR THE CEMETERY DEPARTMENT IN THE AMOUNT OF $500 AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY TO THE 1952 BUDGET FOR SAID DEPARTMENTS IN SAID AMOUNTS AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 2 absent (Councilmen Pinter and Niezgodski). 787 ORDINANCE NO. 3866 AN ORDINANCE MIENDING ORDDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lot located at 1015 -1017 Portage Avenue) APRIL 14TH, 1952 The ordinance was given first reading by title and second reading in full. Councilman Hahn made a motion for suspension of rules. RESOLUTION BE IT RESOLVED by the Common Council of the Civil City of South Bend, Indiana, that said City, through its Board of Park Commissioners, grant a lease of land located at Greenlawn Ave. and North Side Blvd. in said City for the use of the United States of America for an Armory for the United States Army Reserve Corp. for a period of not exceeding fifty (50) years at an annual rental of One Dollar-.($1.00) per year with an option on the part of the Lessee at the termination of the lease to restore the site, or transfer ownership of the building erected thereon to the Lessor. (TEN MINUTE RECESS) Councilman Glass made a motion that this meeting of the Council be recessed until next Monday evening, April 21st, 1952, at 7:30 P.M., to make a decision on the adoption of said resolution.
