Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council
Chamber, Monday, February 11th, 1952, at 8:00 P.M., with all members present except Councilman Bestle.
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspect
the minutes of the previous meeting of the Council and found them correct. They therefore. recommend that the
same be approved.

Councilman Muszynski made a motion that the report be accepted. Councilman Glass seconded the motion. Motion
carried.

NEW YORK CENTRAL SYSTEM

Reference is made to the following Ordinances relating to highway crossing protection in the City of South Bend,
Indiana:
Ordinance No. 3832, requiring the New York Central and the New Jersey, Indiana and
Illinois Railroad Company to provide and maintain automatic flashlight signals and
short arm gates at the crossing of Western Avenue (State Route 2)
Ordinance No. 3833, requiring the NewYork Central to provide and maintain automatic
flashing light signals at the crossing of Washington Street
Ordinance No. 3834, requiring the New York :Central, the NJI &I and Indiana Northern
Railroad Co. to provide and maintain automatic flashing -light signals and short -arm
gates at the crossing of South Walnut Street
Ordinance No. 3835, requiring the New York Central, the Pennsylvania Railroad Co.
and, the NJI &IRR Co. to provide and maintain automatic flashing -light signals and
short -arm gates at the crossings of Kemble and Prairie Avenues.
The Ordinances provide, among other things that the Railroad Companies are given a period of six months to comply
and shall notify the-City any time within the period granted that they have complied with the requirements and
until such notification is received the Railroad Companies shall maintain such protection at the crossings as now
exists, further the period of six months may be extended upon proper showing by the Railroads that difficulties
*are being encountered in obtaining the necessary materials.
In this connection, I wish to advise that it will be impossible to complete any of the projects within the six
months' period stipulated in the Ordinances.
The material required for all the projects was ordered during September, 1951. The flashing -light signals and
automatic gate assemblies are on hand, however, shipment of wire and cable and other major items of material has
not been made and delivery date of same is indefinite.
In order to show some progress in this work we are starting the Washington Street project next week and trust
that sufficient material will be available to complete this installation.
In view of the above, I suggest that you request a six month's extension of time to complete the work covered by
the above Ordinances.

Councilman Korpal made a motion that the communication from Mr. C. F. Brooks relating to highway crossing
protection in the City of South Bend be accepted and placed on file. Councilman Niezgodski seconded the motion.
Motion carried.
Councilman Glass made a motion that the railroad companies be given extension of six month's for completion, of
flasher light warning signals at its crossings at Western Avenue, Washington Avenue, South Walnut Street and at
Kemble and Prairie Avenues, -as required by ordinances" adopted last July 2rd,. Councilman Hahn seconded the
motion. Motion carried.
REPORT OF CITY PLAN COMMISSION
To the Common Council
City of South Bend, Indiana
Gentlemen:
Petition of Forest G. Hay for change of zoning of Lots in Leeppr's Second Addition has been given public hearing
by the City Plan Commission and this change is not recommended. These lots are on the south side of Angela
Boulevard from North Michigan Street to the railroad.
Attached hereto is a remonstrance against this change which was filed with the City Plan Commission.

Councilman Korpal made a motion that the report be accepted and placed on file. Councilman Niezgodski seconded
the motion. Motion carried.
REGULAR MEETING
ORDINANCE
AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS
TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF
SOUTH BEND, INDIANA FOR THE USES AND PURPOSES AND IN ACCORDANCE
WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE
STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE
ACTS OF THE GENERAL ASSEMBLY OF 1951,

Councilman Korpal made a motion to refer the ordinance to the Ordinance Committee for further study and to
await figures from City Controller indicating the board's plan for spending the money. Councilman Hahn seconded
the motion. Motion carried.
UNFINISHED BUSINESS
The Council accepted the recommendation of City Attorney Hurwich that it abstain from attempting to legislate
against the sale of "torch" sweaters or other garments made from brushed rayon.
Councilman Korpal made a motion that the next regular meeting of the Council be held March 10th. Councilman
Alford seconded the motion. Motion carried.
NEW BUSINESS
Councilman Hahn made a motion that the President appoint a special committee on Anti -Air Pollution, Councilman
Glass seconded the motion. Motion carried.
Councilman Hahn made a motion to give vote of thanks to the Boy Scouts for attending the Council meeting and
extended-an invitation to them to come at any time. Councilman Muszynski seconded the motion. Motion carried.
There being no further business before the Council, Councilman Korpal made a motion to adjourn, which motion
was seconded by Councilman Hahn. Motion carried, and Council adjourned at 9:11 P.M.
