HomeMy WebLinkAbout01-28-52 Council Meeting MinutesREGULAR MEETING JANUARY 28TH, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, January 28th, 1952, at 8:32 P.M., with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, mould respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of January 14th, 1952. W. C. ERLER ) STANLEY C. KORPAL ) Chairman W. A. HAHN ) There being no objections, the report of the minutes was accepted and placed on file. COMMUNICATION Resolution from Mr. Stanley Ladd, President, St. Joseph County Industrial Union Council, CIO, regarding unguarded railroad crossings. Councilman Niezgodski made a motion to refer the resolution to the Board of Public Works. Councilman Muszynski seconded the motion. Motion carried. COMMUNICATION Mr. Walter Erler 310 E. Indiana Ave. Jan. 8, 1952 South Bend, Ind. Dear Sir: I own the Berman Sport Store property at 112 West Washington St., South Bend, Ind. Six properties border on the ALLEY at the rear of the Washington St. stores and the South side and East end of this alley, which extends eastward from the regular north and south alley. For more than 50 years this alley extension eastward from the regular North and South alley -has been used by the PUBLIC to deliver goods, etc. to the rear of abutting stores. Therefore-, the long established Indiana Statute of 20 years occupancy makes this a PUBLIC alley. Your City Council shau_ld put on record a public decree announcing this extension to be, and in fact is, a PUBLIC alley. If so decreed officially, the many Automobile Parkers, who obstruct this long established delivery way of 12 feet width, could be driven off. Fire Department Trucks could then get to rear store fire quickly. Store deliveries could be made with less trouble. �Three automobiles were parked there yesterday and there again today. COVER There being no objections, the communication was placed on file. 771 REGULAR MEETING JANUARY 28TH, 1952 REPORT OF THE COMMITTEE OF THE WHOLE Teo the Common Council of the City of South Bend: Your Committee of the whole to whom was referred "An Ordinance reducing certain items in the 1952 budget for the Police Department of the Civil City of South Bend, Indiana in the aggregate amount of $17,906.00 and appropriati from the General Fund of said City to the 1952 budget for the Police Department of said city in the aggregate amount of $17,898.00 and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. Councilman Bestle made a motion that the report be accepted. carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: WM. A. HAHN, Chairman Councilman Niezgodski seconded the motion. Motion Your Committee of the Whole to whom was referred "An Ordinance appropriating from the General Fund the sum of Sixteen Hundred Eighty ($1,680.00) Dollars to certain budgetary items of the 1952 budget of the Civil City of South Bend, Ind., and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. WM. A. REPORT OF STREET & ALLEY COMMITTEE The Street and Alley Committee, composed of Councilmen Pinter, Bestle and Glass, met with the Superintendent of Streets Harry Tomlinson in the Council Chambers January 23rd, 1952 for the purpose of devising some method of clearing the streets during the time of snow removal and for street cleaning. The Committee fully realizes that a ban on all night parking on the streets would create a hardship for a number ol citizens that do not have a garage or available space to park their cars. The Committee also realizes that to protect the health of the citizens it is necessary for snow removal and the streets cleaned at regular intervals, therefore we recommend that the parking of vehicles from the hours of 12 midnight to 6 A.M. be parked as follows: On the even side of the street on even dates and on the odd side of the street on odd dates. This recommendation includes streets now designated as state highways, providing this plan meets with the approval of the State Highway Commission, but does not include streets having parking on one side of the street. These will be cleaned by posting no parking signs. We believe that this plan will not only give the Street Department a chance to operate at night but will discourage parke rs that have garages or parking space to park their cars on the streets during the night. ORDINANCE NO. 3858 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1952 BUDGET FOR THE POLICE DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA, IN THE AGGREGATE AMOUNT OF $17,906.00 AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY TO THE 1952 BUDGET FOR THE POLICE _ DEPARTMENT OF SAID CITY IN THE AGREEGATE AMOUNT OF $17,898.00 AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. REGULAR MEETING ORDINANCE NO. 3859 AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF SIXTEEN HUNDRED EIGHTY ($1,680.00) DOLLARS TO CERTAIN BUDGETARY ITEMS OF THE 1952 BUDGET OF THE CIVIL CITY OF SOUTH BEND, INDIANA AND DECLARING AN EXTRAORDINARY EMERGENCY. JANUARY 28TH. 1952 The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE AN ORDINANCE APPROPRIATING ALL PARKING METER FEES AND FUNDS TO THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CIVIL CITY OF SOUTH BEND, INDIANA FOR THE USES AND PURPOSES AND IN ACCORDANCE WITH CHAPTER 236 OF THE ACTS OF THE GENERAL ASSEMBLY OF THE STATE OF INDIANA OF 1945, AS AMENDED BY CHAPTER 303 OF THE ACTS OF THE GENERAL ASSEMBLY OF 1951. 772 The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion to refer the ordinance to the next Council meeting on February 11th. Councilman Alford seconded the motion. Motion carried. RESOLUTION WHEREAS, The Studebaker Corporation celebrates its Centennial on February 16, 1952, and WHEREAS, its humble beginnings, pioneering and perseverance, initiated by the energy, skill and acumen of the Studebaker brothers supplied the keystone for a century of community building, and WHEREAS, the industry early established, and has persistently maintained, a high standard of craftsmanship thno.ughout 100 years of progress, ranking fourth in eminence among the world's automobile manufacturers and largest of the independents, and WHEREAS, the industry employs,a community of some 22,000 workers, bespeaking the tremendous interdependence between city and industry and resulting in inestimable gain for the city economically, through population growth, and in the stature of citizenship which the industry's demand for skilled hands and minds has brought, NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CIVIL CITY OF SOUTH BEND, INDIANA, THAT: A formal expression of tribute be designed and presented by the Mayor of the City of South Bend, Indiana, to the Studebaker Corporation in grateful commemoration of 100 years of industrial achievement and community service which have made South Bend world famed. Councilman Hahn m%,de a motion,fo r the adoption of the Resolution. Councilman Niezgodski seconded the motion. Motion carried. NEW BUSINESS Councilman Glass made a motion to invite Boy Scouts to attend next meeting of the Council on February 11th. Councilman Korpal:`seconded the motion. Motion carried. UNFINISHED BUSINESS To the Common Council of the City of South Bend, Ind. Dear Sirs: January 28, 1952 In recent weeks there has been an overwhelming sale of Brushed Rayon Sweaters sold throughout the country. These sweaters are sold by unlicensed transients, and are highly inflammable, and very dangerous to all people who wear them. So far we can find no State or City laws that prohibit the manufacture of sale of this inflammable material called "Brushed- Rayon" that the sweaters are made of. Also there is no provision within oui7 present fire code prohibiting the sale of such material. Therefore we ask that an Ordinance be drawn up by the (City Attorney, prohibiting the manufacture, sale, distributic and storage of all wearing apparel manufactured of this "Brushed- Rayon" material. Bend Fire Prevention Bureau Councilman Glass made a motion that the letter be referred to the City Attorney to prepare an ordinance prohibiting the manufacture, sale, distribution, and storage of all wearing apparel manufactured of "Brushed - Rayon" material. There being no further business before the Council, Councilman Hahn made a motion to adjourn, which motion was seconded by Councilman Niezgodski. Motion carried, and Council adjourned at 9:30 P.M.
