HomeMy WebLinkAbout01-14-52 Counicl Meeting MinutesREGULAR MEETING JANUARY 14TH, 1952 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, January 14th, 1952, at 8:02 P.M., with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of Organization Meeting January 7th, 1952. WALTER C. ERLER, SR. ) WM. A. HAHN ) Committee STANLEY C. KORPAL There being no objections, the report of the minutes was accepted and placed on file. REPORT OF BUILDING DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR OF 1951. Councilman Niezgodski made a motion that the report of the Building Department for the year of 1951 be accepted. Councilman Bestle seconded the motion. Motion carried. PETITION The Common Council City, of South Bend South ,Bend, Indiana Gentlemen: We, the undersigned, owners of the described real estate set opposite our names, do hereby respectfully request the members of the Common Council to rezone the said described real estate from its present Classification "Residential B" to the Classification "Commercial. C ", "D" Height and Area District. Lots Numbered Five (5), Six (6), Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12), Thirteen (13), in Morris Park Addition to the City of South Bend, Indiana, also Lots Numbered One Hundred Seventeen (1111), One Hundred Eighteen (118), One Hundred Nineteen (119), One Hundred Eighty -seven (187), One Hundred Eighty -eight (188), One Hundred Eighty -nine (189) in the Northwest Addition, Second Plat, to the City of South Bend, Indiana, also the lot located on the Northeast Corner of Portage Avenue and Kinyon Street owned by the Portage Greenhouses, Inc., described as follows, to -wits A lot or parcel of land bounded by a line running as follows, VIZ: Beginning on the North line of the South Half (2) of the Southwest Quarter (4) of Section Number Thirty -five (35), Township Number Thirty -eight (38) North, Range Number Two (2) East, at a point One Hundred and Fifty -two (152) .feet East of the Easterly line of Portage Avenue in the City of South Bend; thence running East on said North line of said half Quarter (4) of Section 361 feet, mores or less, to the Northwest corner of a lot conveyed to Willis W. Councilman Glass seconded the motion. Motion carried. REPORT OF TAE. CITY CONTROLLER OF THE CITY OF SOUTH BEND, INDIANA, FOR THE MONTH OF NOVEMBER, 1951. Councilman Korpal seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION Gentlemen: Petition of William M. Smith for change of zoning of Lot No. 1085 LaSalle Park Addition from residence district to commercial district was given public hearing by the City Plan Commission at their regular meeting January 3, 1952. With the approval of the petitioner, the petition has been amended for a change from B residence and A height and area districts to C commercial and D height and area districts and in this form the change is recommended by the City Plan Commission. REGULAR MEETING ORDINANCE NO. 3857 AN ORDINANCE AMENDING ORDINANCE NO. 37029 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Northwest corner of Falcon and Washington Streets) JANUARY 14TH. 1952 160 The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Hahn seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND THE SUM OF SIXTEEN HUNDRED EIGHTY ($10680.00) DOLLARS TO CERTAIN BUDGETARY ITEMS OF THE 1952 BUDGET OF THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion that the ordinance be referred to the Committee of the Whole for public hearing on January 28th, 1952, at 8:00 P.M. Councilman Niezgodski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REDUCING CERTAIN STEMS IN THE 1952 BUDGET FOR THE POLICE DEPARTMENT OF THE CIVIL CITY OF SOUTH BEND, INDIANA, IN THE AGGREGATE AMOUNT OF $17,906.00 AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY TO THE 1952 BUDGET FOR THE POLICE DEPARTMENT OF SAID CITY IN THE AGGREGATE AMOUNT OF $170P898.00 AND 'DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that the ordinance be referred to the Committee of the Whole for public hearing on January 28th, 1952, at 8:00 P.M. Councilman Hahn seconded the motion. Motion carried. RESOLUTION BE IT RESOLVED by the Common :Council of the City of South Bend, Indiana: That pursuant to Section 1 of Chapter 127 of the 87th Session (1951) of the General Assembly of the State of Indiana, the full time and /or part time deputies appointed by the City Clerk of South Bend, Indiana, at the salaries set forth in the Municipal Civil City budget of said City for the year 1952 are herein in all things approved and ratified. Walter C. Erler, Sr. Member of the Common Council Councilman Hahn made a motion that the resolution be adopted. Councilman Muszynski seconded the motion. Motion carried. PROCEDURE OF CITY PLAN PETITIONS There is considerable delay encountered from the time a petition for a change to zoning is given to the City Clerk, then presented to the Council at next regular meeting, referred from the Council to the 'Plan Commission (which is a matter 'of routine) . After Plan Commission receives petition ten days is required for notice of public hearing after which Plan Commission recommendations are referred back to the City Council. As an example: The delay could be from January 14th when petition is given to City Clerk to March 31st with the normal procedure. I, therefore, move that when a petition is presented to the City Clerk a duplicate copy immediately be given to the Plan Commission so that the Plan Commission can make provi -sion for the public hearing at the earliest possible date. Councilman Hahn made a motion that the above procedure be adopted. -Councilman Bestle seconded the motion. Motion carried. ORDER OF BUSINESS In order that the City Council may more thoroughly identify tk:e location of property to be zoned in the various zoning ordinances, I move that the Plan Commission's report tothe Council describe the location of property affected by street and house numbers to be read first preceding the ordinance to which it refers. The description and location of property to be zoned in the ordinance is in technical language of which the layman is unfamiliar. Councilman Bestle made a motion that the Order of Business be adopted. Councilman Niezgodski seconded the motion. Motion carried. NEW BUSINESS Councilman Glass made a motion that the question of street parking be referred to the Streets and Alleys Committee and the advice of the City Attorney relative to an ordinance. Councilman Niezgodski seconded the motion. Motion carried. (Continued) 769 JANUARY 14TH, 1952 NEW BUSINESS (CONTINUED) Councilman Niezgodski made a motion that the Streets and Alleys Committee and City Attorney investigate the parking of heavy delivery trucks, particularly coal trucks, be prohibited from blocking sidewalks thereby forcing pedestrians to walk into the street to get around them. Councilman Bestle seconded the motion. - Motion carried. There being no further business before the Council, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Hahn. Motion carried, and Council adjourned at 8:45 P.M.
