HomeMy WebLinkAbout11-13-51 Council Special Meeting MinutesSPECIAL MEETING NOVEMBER 13TH, 1951 Be it remembered that the Common Council of the City 'of South Bend, Indiana, met in Special Session in the Council Chamber, Tuesday, November 13th, 1951, at 8:15 F.M., with all members present. STATE OF INDIANA ) COUNTY OF ST. JOSEPH ) CITY OF SOUTH BEND ) CALL FOR SPECIAL MEETING To the President, and Members of the Common Council of the City of South Bend, Indiana: Gent lemen You are hereby notified that under and by virtue of the authority vested in me by law as Mayor of the City of South Bend, in the State of Indiana, a Special Meeting of the Common Council of said City is hereby called to meet in the Council Chamber, in the City Hall at the hour of 8 :00 o'clock P.M., Central Standard Time, on Tuesday, November 13th, 1951, for the purpose of considering and taking action . upon the following ordinances, petition and reports, to wit: "An Ordinance reducing certain items in the 1951 South Bend, Indiana, Municipal Civil 'City Budget and appropriating from the General Fund of said City the sum of Twelve Thousand Six Hundred ($12,600.00) Dollars, to certain other budgetary items of the 1951 budget of said city, and declaring an extraordinary emergency ", ALSO 'Four (4) Ordinances amending Ordinance No. 3702 commonly known as the Zoning Ordinance ", ALSO "Petition for Rezoning of Lot 1085, LaSalle Park Addition ", ALSO "Three (3) Financial Reports of City Controller for 1951 ", ALSO "Four.(4) Reports of City Plan Commission on Rezoning ", ALSO "An Ordinance reducing certain items in the 1951 South Bend, Indiana, Municipal Civil City Budget., and appropriating from the Gene ral Fund of said City the sum of #215.00, to certain other budgetary items of the 1951 budget of said city, and declaring an extraordinary emergency'. The Chief of Police or any member of the Police Force is hereby directed to forthwith serve a copy of this notice on each and every member of the Common Council and make due return of such service of said Special Meeting. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspec the minutes of the previous meeting of the Council and found them correct. SPECIAL MEETING PETITION NOVEMBER 13TH. 1951 To The Honorable South Bend City Council City Hall South Bend, Indiana Re: Petition of Dr. William M. Smith for Rezoning of Lot 1085, LaSalle Park Addition J. Chester Allen, being first duly sworn says: That he is the attorney and duly authorized representative of Doctor William M. Smith, a resident and property owner residing at 2801 Lincolnway West, South Bend, Indiana. That the said :Doctor William M. Smith is the owner of Lot Number 1085 in the LaSalle Park Addition to the City of South Bend, St. Joseph County, Indiana, which real estate is an unimproved parcel of land on the northwest corner of Falcon and Washington Streets and adjacent to the city dump immediately north of said real estate. That said real estate is at the present time zoned as Residential property. That the said Doctor William M. Smith is desirous of rezoning said real estate from Residential to Commercial in order that he may erect a drug store thereon. WHEREFORE, for and on behalf of the said Doctor William M. Smith, the affiant respectfully petitions the South Bend City Council to pass a resolution according to law rezoning the above described parcel of real estate from Residential to Commercial. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1951 South Bend, Indiana, Municipal Civil City Budget and appropriating from the General Fund of said city'the sum of Twelve Thousand Six Hundred ($12,600.00) Dollars, to certain other budgetary items of the 1951 budget of said city, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KOTPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT- OF CITY PLAN "COMMISSION. To the Common Council City of South Bend, Indiana Gentlemen: Petition of Harry R. Green for change of zoning of an unplatted tract of land on the south side of `Lincolnway West, East of Sheridan_;Avenue, as described by meets and bounds in the petition asking for a change of zoning from B residence and A height and area districts to C - commercial was given public hearing at the meeting of the City Plan Commission on November 1, 1951, and,it is recommended that change be made to C commercial and D height and area district. Councilman Korpal made a motion that the report be accepted. carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Yours truly, D. Moomaw, Secretary Councilman Bestle seconded the motion. Motion Petition of First Bank and Trust Company by their attorney, William E. Voor, for zoning land recently annexed to the City of South Bend by annexation Ordinance No. 3828 was given public hearing at the meeting of the City Plan Commission on November 1, 1951. This property is at the northeast corner of Ireland Road and Miami Street and extends north to the property. of St. Mary's Academy. 'The platting of this landhas not yet been done and hence it cannot be described as numbered lots in a recorded addition. The City Plan Commission recommends the zoning of this territory as petitioned for. Yours truly, D. Moomaw, Secretary Councilman Korpal made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. 757 SPECIAL MEETING REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Roy E. Bullard for change of zoning of lots 7, 8, 9 and 10 in Kensington Addition and lot 37 in Kaley's Second Lincoln Way Addition from B residence and A height and area districts to C commercial and D height and area districts was given public hearing at the meeting of the City Plan Commission on November 1, 1951, and this change is recommended as petitioned for. These lots are on the north side of Lincolnway West between Meade and Kaley Streets. Yours truly, D. Moomaw, Secretary Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen :, Petition of Jackson Corporation by its attorneys 'Voor, Jackson, Grant and McMichael for a change of zoning of Lots 35 to 42 inclusive in Monticello Addition from C commercial and D height and area districts to A residence and_A height and area districts was given public hearing at the meeting of the City Plan Commission on November 1, 1951. This change is recommended by them. The lots on the south side of Sunnymede Avenue at 30th Street. Yours truly, D. Moomaw, Secretary Councilman Korpal made a motion that the report be accepted. ORDINANCE NO. 3846 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF TWELVE THOUSAND SIX - HUNDRED ($12,600.00) DOLLARS, TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1951 BUDGET OF SAID CITY, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given given third reading and passed by a roll call vote of 8 ayes -.0 nays. Mr. Frederick K. Baer, City Attorney, informed the Council that bids have previously been received, but did not have sufficient funds to let the contract and that the low bidder agreed to hold our bid open until the Council appropriated this additional sum. As soon as the Council appropriates and approves this additional sum, the contract wil-l- be let for the construction of a new fire station on Portage Avenue at Queen Street. ORDINANCE NO.` 3847 AN ORDINANCE AMENDING - ORDINANCE N0. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE -OF THE CITY OF SOUTH B&D, INDIANA. (Unplatted tract of land on the South side of Linoolnway West, East of Sheridan Avenue) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3848 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE. (Property at the Northeast corner of Ireland Road and Miami Street and extends North to the property of St. Mary's Academy) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. (Lots on North side of Lincolnway West between Meade and Kaley Streets) The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. .Councilman Bestle seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. SPECIAL MEETING NOVEMBER 13TH, 1951 ORDINANCE NO. 3850 AN ORDINANCE AMENDING ORDINANCE NO. 3 702 COMMONLY KNOWN AS THE ZONING ORDINANCE. (Lots on the South side of. Sunnymede Ave..at 30th Street) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes ­0 nays. Councilman Glass made a motion that the ordinance be referred to the Committee of the Whole for public hearing on November 26th, 1951. Councilman Korpal seconded the motion. Motion carried. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on November 13th, 1951. Councilman Bestle seconded the motion. Motion carried.. NEW BUSINESS A move by Councilman Tellson to insure that a portion of the $300,000.00 remaining unspent of a $500,000.00 bond issue for the improvement of arterial streets be spent by the administration of Mayor -Eleot John A. Scott on Indiana Avenue both east and west will be embodied in a written motion to be prepared ,by the City .Attorney Frederick K. Baer and presented to the present Council at the next meeting. Councilman Erler seconded the motion. Motion -carried. Councilman Glass made a motion that the Clerk notify Mr. John M. Bowman, Superintendent of Power Plant, Studebaker Corporation, to appear at the next regular meeting of the Council on-November 26th, 1951, to give a report on what is being done about the escaping steam on Sample St. Councilman Muszynski` seconded the motion. Motion carried. Councilman Korpal made a motion that the Board of Public Works notify officials of the New York Central and Grand Trunk railroads to appear at their next meeting to explain blocking of their crossings. Councilman Glass seconded the motion. Motion carried. Councilman Korpal withdraws his motion. Councilman Glass withdrew his second. Councilman Muszynski made a motion that the Clerk notify officials, of the-New- York Central and Grand Trunk railroads to appear at the next meeting of the Council on November 26th to explain crossing blocking by their trains. Councilman Glass seconded the motion. Motion carried. There being no further business before the Council, Councilman MusWnski made a motion to adjourn, which motion was seconded by Councilman Korpal.
